� ORDINANCE NO. 81-42 � AN ORDINANCE CLOSING ABANDONING AND � � � VACATING A PORTION OF SHORE DRIVE IN THE CITY OF GRAPEVINE, TEXAS, AS HERE— �'.�s;: � �' INAFTER DESCRIBED; PROVIDING A SE��— `��`�� �� #��i���s`'�� ABILITY CLAUSE; AND DECLARING AN —. EMERGENCY WHEREAS, the owner of property abutting a portion of ShorE, Drive in the City of Grapevine, Texas has requested the right-of-way of a portion of Shore Drive, as herein- after described, be closed, abandoned and vacated; and WHEREAS, the right-of-way of said street as herein- after described is not now needed for public use and will not be needed in the future for public use; and WHEREAS, closing, abandoning and vacating the right- of-way of said street will relieve the City of Grapevine, Texas, from the cost and expense of maintaining said prop�rty. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE (�ITY OF GRAPEVINE, TEXAS: Section 1. That the portion of right-of-way of Shore Driv� located within the property described in Exhibit "A" , attaahed and incorporated herein for all practical purposes, is h�reby closed, abandoned, and vacated insofar as all public right, title, and interest in and to said described -- port_i.on of said right-of-way is concerned. Section 2. That the Mayor, be, and is hereby author- ized to execute a Quitclaim Deed to convey the heretofore descr_ibed property to the owners of the property abutting said right-of-way, who officially declare by affidavit that they are the rightful fee owners of the right-of-way vacated and ��bandoned by this ordinance. Section 3. That the terms and provisions of this ordi- nancE� shall be deemed to be severable and that if the valid- ity of any section, subsection, word, sentence or phrase shal:L be held to be invalid, it shall not affect the remain- ing ��art of this ordinance. Section 4. The fact that the said portion of right-of- way c�f Shore Drive is no longer needed by the public for public usage or traveling and would create a hardship or burde:n upon the City of Grapevine to keep open and maintain such drainage and utility easements and such street creates an urgency and an emergency for the immediate preservation of the public health, safety and general welfare which re- quir�s that this ordinance shall take effect immediately from and after its passage and it is accordingly so ordained.
