AN ORDINANCE OF THE CITY OF GRAPE-
VINE, TEXAS REGULATING THE SPEED
OF VEHICLES WITHIN THE CITY; SPECI-
FYING THE REASONABLE AND PRUDENT
SPEED FOR PUBLIC STREETS AND ALLEYS
�� WITHIN THE CITY; AUTHORIZING THE
ERECTION OF TRAFFIC REGULATION
SIGNS; REPEALING CONFLICTING ORDI-
NANCES; PROVIDING FOR A PENALTY OF
"'�"' FINE NOT TO EXCEED TWO HUNDRED
DOLLARS ($200. 00) FOR EACH OFFENSE;
PROVIDING A SEVERABILITY CLAUSE;
AND DECLARING AN EMERGENCY
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF
THE CITY OF GRAPEVINE, TEXAS:
Section 1. General Speed Limits
(a) No person shall drive as defined by State Law a
motor vehicle, a motorcycle, bicycle, motor driven cycle,
motor-assisted cycle, or any other vehicle of any kind upon
a public street, alley, highway, or parkway within the cor-
porate limits of the City of Grapevine, Tarrant County,
Texas , at a speed greater than is reasonable and prudent
under the circumstances then existing. Except where a
special hazard exists that requires lower speeds for com-
pliance with paragraph (b) of this section, no person shall
operate or drive any motor vehicle or other vehicle on any
«�=� street within the City of Grapevine at a greater speed than
thirty (30) miles per hour, unless otherwise provided by
subsequent sections of this ordinance or other ordinances ,
and any speed in excess of thirty (30) miles per hour,
unless otherwise provided by subsequent sections of this
ordinance or other ordinances, shall be prima facie evi-
dence that the speed is not reasonable or prudent and is
unlawful.
(b) No person shall drive a vehicle upon a public
street or a public alley within the corporation limits of
the City of Grapevine at a speed greater than is reasonable
and prudent under the conditions and having regard to the
actual and potential hazards then existing. In every event,
speed shall be so controlled as may be necessary to avoid
colliding with any person, vehicle, or other conveyance on
or entering the highway in compliance with legal require-
ments and the duty of all persons to use due care.
Section 2. Speed Limits on Certain Public Streets
Upon the basis of an engineering and traffic investiga-
tion heretofore made, as authorized by the provisions of Sec-
tion 169, V.T.C.S. , 6701d, Uniform Act Regulating Traffic on
�-� Highways , the following prima facie speed limits hereafter
indicated for vehicles are hereby determined and declared to
be reasonable and safe; and such speed limits are hereby fixed
at the rate of speed indicated for vehicles traveling upon the
named public streets and highways, or parts thereof, of the
City, said speed limit to be in force and effect unless other-
wise limited as prescribed by the provisions of this ordinance.
The streets and highways hereby regulated, and the maximum
prima facie speed limits thereof, are as follows :
Dallas Road - Beginning at a point in the
centerline of Dallas Road, said point lo-
cated 110 feet east of Twilight Trail and
extending west a distance of 470 feet, 20
m.p.h. , 4 : 00 p.m. to 8:00 p.m. weekdays
and 8 : 00 a.m. to 8 : 00 p.m. Saturdays .
Section 3. That when, upon the basis of an engineering
�� and traffic investigation, it is necessary that the speed
limit on any street, highway, or alley within the City of
Grapevine, because of the maintenance, construction and/or
repair of such street, highway, or alley, or portion thereof,
- be reduced, the City Manager or his agent shall have the
authority to erect signs at the beginning, end, and other
portions where such street, highway, or alley is under main-
tenance, construction and/or repair limiting the speed to
the maximum speed determined by the City Manager or his
agent, and it is unlawful for any person to operate or drive
any motor vehicle within such posted area at a speed in
excess of said speed, said speed limit hereby being deemed
to be the prima facie evidence of reasonable and prudent
maximum speed at which a vehicle may travel on such portions
of said street, highway, or alley under construction, main-
tenance or repair.
Section 4. That the City Manager, or his agent, is
hereby authorized to have speed limit signs erected, con-
structed, and placed at such points along said highways ,
streets, or alleys, or portions thereof under construction,
maintenance, or repair so that travelers will be reasonably
notified of said speed.
Section 5. That all ordinances or any parts thereof in
�� conflict with the terms of this ordinance shall be and hereby
are deemed repealed and of no force or effect provided, how-
ever, that the ordinance or ordinances under which the cases
currently filed and pending in the Municipal Court of the
City of Grapevine, Texas, shall be deemed repealed only when
all such cases filed and pendinq under such ordinance or ordi-
nances have been disposed of by a final conviction, or a find-
ing not guilty of nolo contendere, or dismissal.
Section 6. Any person, firm, or corporation violating
any of the provisions of this ordinance shall be deemed
guilty of a misdemeanor, and upon conviction in the Municipal
Court, shall be fined in an amount not to exceed the sum of
Two Hundred Dollars ($200. 00) for each offense.
Section 7. If any section, paragraph, subdivision,
clause, phrase or provisions of this ordinance shall be
judged invalid or unconstitutional, the same shall not affect
the validity of this ordinance as a whole or any portion
thereof other than that portion so decided to be invalid or
unconstitutional.
Section 8. The fact that the traffic regulations of
the City of Grapevine do not adequately regulate the traffic
,�:� within the City creates an urgency and an emergency and the
preservation of the public health, safety, and welfare re-
quires that this ordinance shall take effect immediately
from and after its passage and the publication of the cap-
tion of said ordinance, as the law and the City Charter in
such cases provides.
