- AN ORDINANCE AMENDING THE CITY CODE
OF THE CITY OF GRI�PEVINE, CHAPTER 21,
SECTION 21-23 RELATING TO COLLECTION
OF THE HOTEL OCCUPANCY TAX BY PROVID-
ING FOR THE PERSON COLLECTING THE TAX
TO DEDUCT AND WITHHOLD FROM THE PERSON 'S
PAYNIENT TO THE CITY ONE PERCENT (1 0) OF
THE AMOUNT OF THE TAX COLLECTED; PROVID-
ING FOR FORFEITURE OF REIMBURSEMENT FOR
FAILURE TO PAY THE TAX; PROVIDING AN
EFFECTIVE DATE; PROVIDING A SEVERABILITY
CLAUSE AND DECLARING AN EMERGENCY
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
GRAPEVINE, TEXAS:
Section l. That Chapter 21, Section 21-23 of the City
Code relating to collection of the Hotel Occupancy Tax is
hereby amended to read as follows :
"Section 21-23 Collection for City-Required
A. Al1 parties owning, operating, managing or
controlling any hotel shall collect the tax
imposed in Section 21-23 for the City.
B. Al1 parties collecting the subject tax are
hereby authorized to deduct and withhold
from the parties ' payment to the City, as
reimbursement for the cost of collecting
the tax, one percent (1%) of the amount of
tax collected and required to be reported
to the City.
C. Al1 parties collecting the subject tax shall
forfeit the one percent (lo) reimbursement
for failure to pay the tax or to file reports
as required by this Chapter. "
Section 2. The effective date of this ordinance shall be
January 1, 1982 and shall apply to taxes collected on or after
that date.
Section 3. Severability. If any section, sentence ,
phrase, word, paragraph, or provision of this ordinance or the
application of that section, sentence, phrase, word, paragraph,
or provision to any person, situation, or circumstances is for
any reason adjudged invalid, the adjudication shall not affect
any other section, sentence, phrase, word, paragraph, or pro-
vision of this ordinance or the application of any other sec-
tion, sentence, phrase, word, paragraph, or provision to any
other person, situation, or circumstances , nor shall such
adjudication affect any other section, ser.tence, phrase , word,
paragraph, or provision of the Grapevine City Code. The City
Council declares that it would have adopted the valid portions
and applications of this ordinance without the invalid part,
and to this end the provisions of this ordinance are declared
to be severable.
Section 4. Emergency. The fact that the present ordi-
nances and regulations or the City of Grapevine, Texas are
inadequate to properly safeguard the health, safety, morals , .
peace, and general welfare of the inhabitants of the City of
Grapevine, Texas creates an emergency for the immediate preser-
vation of public business, property, health, safety, and general
welfare of the public which requires that this ordinance shall
. become effective from and after the date of its passage, and it
is accordingly so ordained.

GRAPEVINE, TEXAS on the 17th day of November, 1981.
