INVOCATION The Invocation was delivered by Reverend George Clerihew, First Baptist Church. WELCOME & INTRODUCTION Mayor Tate welcomed those in attendance, introduced the members of the Planning & Zoning Commission and explained the procedure for the Public Hearing. PUBLIC HEARING - ZONING APPLICATION Z80-19 , DAVID SPALDING The first order of business was for the City Council and Planning & Zoning Commission to conduct a Public Hearing relative to Zoning Application Z80-19 submitted by David Spalding. � Mayor Tate declared the Public Hearing open. �. City Manager Jim Hancock explained the application and stated that the property in question was a tract of land described as being a lot, tract, or parcel of land lying and being situated in Tarrant County, Texas and being a part of the S . Byrd Survey (Twin Creek � Cove - Lots 1 through 6 on the South side of Timberline near Creekwood Estates) . The applicant is requesting that the zoning be changed from "R-1" Single Family Dwelling District to "SP" 05/06/80 ' Specific Use Permit for the purpose of construction of duplex family dwellings , each structure containing a minimum of 3 , 000 square feet and having a minimum of 60'/o masonry and glass exterior, providing further that all "R-2" construction requirements be met, or in the alternative any higher zoning that is more restrictive by use or restrictions. Mr. Robert Power , Attorney for Mr. Spalding addressed the Council with the following comments : ,� Mr. Power gave a history of the zoning on the property and indicated that at the time it was purchased by Mr. Spalding the ,�, property was zoned in such a manner that duplex development was allowable. He also indicated that Mr. Spalding had invested a substantial amount of money in the property on the assumption that the zoning would remain as it was at the time of its purchase by Mr. Spalding. He further indicated that if the City Council ' would not, through its zoning process , allow duplex development Mr. Spalding would have no alternative but to pursue the matter in the courts . Mayor Tate then asked if there was anyone present to speak in support of or opposition to the request. Mr. Dennis McGrath, 2905 Cresthaven; Mr. Mario Signorelli, 2828 Creekwood Drive North and Mr. Ron Dyer, 2845 West Court spoke in opposition of the proposed zoning application. Mr. George Christian, 1805 Valcord, Richardson, Texas ,( a representative and builder for Mr. Larry Lightner) and Mr. Dennis Moore, 2838 ' Creekwood Drive North spoke in support of Mr. Spalding' s requested zoning. Mayor Tate called on the Acting City Secretary to read letters � received relative_to _the_zoning application________________________ ; � April 14, 1980 � To : Mayor Tate City Council Members Planning & Zoning Commission Members Re: Comments in Opposition to the Proposed Zoning , Change for the Twin Creek Cove Subdivision ' of Timberline Road �, We are writing this letter to express our opposition to the ' proposed zoning change for the Twin Creek Cove Subdivision ', from R-1 single family to the specific use zoning of "duplex family dwellings" . Primary among our concerns is the safety of our child and the other children of the area who must use Timberline Road as their only route to Timberline Elementary School. The proposed change will add twelve dwellings on six lots with the conservatively-estimated potential of twenty-four vehicles , all of which will access Timberline Road from the single cul-de-sac comprising the subdivision. """'"" This traffic will be injected onto Timberline Road in an area that, in our opinion, is already the most dangerous threat to children walking to and from school because of the waw sharp curve in Timberline Road (adjacent to Windy Knoll) the ever-present quagmire resulting from the improper drainage in the same area, and the deep bar ditch parallel to Timberline Road and directly across from the Twin Creek Cove cul-de-sac 05/06/80 which forces the children to walk on the shoulder of the already heavily-travelled road. We are aware of proposed improvements to Timberline Road which will, hopefully, alleviate these hazardous conditions but ask that you consider the present safety of our children in considering a change to the zoning of these ,,,�, six single-family-sized lots that would potentially ; "double" the number of vehicles and compound the already- dangerous situation that exists . Granted, this reasoning is a personal matter with us , but we feel that since it `�`` involves the lives and safety of the real "future" of Grapevine, it warrants equal consideration with the profit- motivated reasoning behind the developer' s request to change the zoning. We were pleased by the Council ' s actions on the seven platted tracts along Timberline Road at the February 19 , 1980, meeting. The actions taken were sound and clearly supported the general development of the area which has been, and should continue to be, single family. In light of the February 19 , 1980, rulings , the requested zoning change for the Twin Creek Cove Subdivision becomes a most "critical" review of these decisions . To now rule in favor of this requested zoning change to an obviously less-restrictive district, will most certainly be considered as a "precedent" for future considerations for multi-family zoning in the area. Although your decision tonight on the Twin Creek Cove Subdivision will affect only six lots which represent minimum acreage, we respectfully ask that you consider the impact that your decision will have on future requests involving the zoning of adjacent property. � Should you rule in favor of the specific use requested, 3 ' it will most certainly become an "issue" as an "ideal � buffer" between Creekwood Estates and the property currently zoned C-2 directly south of the Vineyard should a request be made to rezone the C-2 to R-3 . Such a request is a strong probability since, in the expressed opinion of the owner, R-3 zoning offers the most economical potential for the flood plane property assuming no east-west thoroughfare is constructed through it. In your considerations , it should be noted that single-family dwellings on cul-de-sacs (such as the one already constructed in the 'I�ain Creek Cove Subdivision) are marketable commodities in the area, as evidenced by the Vineyard, and to retain the current R-1 zoning will preclude the Twin Creek Cove Subdivision from becoming a "precedent-setting issue" in future Timberline zoning considerations . It shoudl also be taken into consideration that, as yet, the marketability of duplexes has not been tested in the Timberline area and that ample tracts (i. e. , tracts on both the east and west sides of Timberline Road at Mustang Drive, the two northernmost cul-de-sacs in the Timberline Estates Subdivision east of Timberline, and the entire tract of Timberline Estates west of Timber- line adjacent to the high school) have been zoned R-2 to accommodate a true test of the marketability of the duplex in the area. It was insinuated at meetings that we attended in February and i„� early March regarding zoning along Timberline, that the reputation of the City has suffered in the eyes of potential developers because of the Council ' s decisions to change zoning in various areas and particularly along Timberline. Should this point be raised to you in either open session in regard to Twin Creek Cove or elsewhere, please know that we fully support your decisions to preserve the development of our single family neighborhood. Rest assured that your efforts 05/06/80 toward the controlled and continued development of Grapevine as a family-oriented community will outlive any harmful effect that your decisions regarding zoning might have on the City' s reputation in the eyes of profit-oriented multi-family developers . Drawer 1547 Grapevine, Texas 76051 Re : Zoning Application Z80-19 Gentlemen: The purpose of this letter is to express our strong approval of the zoning change for Twin Creek Cove � from R-1 Single Family to SP Specific Use Permit � allowing "R-2" uses . � It is our opinion this is an excellent use for this property due to its close proximity to Timberline Drive. Since Mr. Spalding purchased the property, platted the property and developed the property for duplex in full cooperation with the City of Grapevine, it seems only fair that he be allowed to use it for duplexes . Christian President -------------------------------------------------------------- April 14, 1980 � Grapevine City Conncil Planning and Zoning Committee Grapevine , Texas 76051 � Members of Planning and Zoning Committee, City Council Members , Mr. Mayor: This letter is written with an appreciation and under- standing that you the members of the Planning and Zoning 05/06/80 Committee and City Council presently have a difficult task of setting zoning restrictions for the community of Grapevine. It is believed however difficult the task, it is of utmost importance that the immenent growth of our city be properly controlled. With fixed boundaries we do at this time control our own destiny, therefore, let us not act in such a hasty manner that � we will regret these decisions in the future. As the Timberline and Mustang Drive area' s presently contain many established apartment units and several tracts are presently zoned for duplex units , we are strongly opposed to additional multi-family units within the area including the Twin Creek Cove-Tract VI area. It should be noted that the lots in the Twin Creek Cove- Tract VI area are extremely small for the type of units the developer has discussed. Not only would the units be overcrowded on the lots , the density would be out of proportion with the surrounding single family units , and parking would be a problem. It should also be pointed out that traffic would be increased in an Elementary School zone that is not presently equipped with proper street crossings and that has no sidewalks along Timberline Drive for the children. It is further believed that the developer has not fulfilled his earlier obligations to the City of Grapevine officials or its citizens when he was asked to submit plans for their approval, therefore, leading us to be concerned with the quality of construction and density of units that would be ultimately constructed. As we do not wish the Twin Creek Cove-Tract VI to become a S precedence for future multi family units , we strongly urge : the Planning & Zoning Committee and the City Council to � maintain the present R-1 zoning within that area. Armstrong : Please be advised that as an adjacent property owner I � am in full support of efforts to change the zoning in the above referred to zoning case in line with the specifics outlined in the notice I received dated April 4, 1980. I believe this to be the highest and best use for the referenced property and any like property immediately adjacent to same. I believe this move would be a definite asset to this particular area and the city as a whole in 05/06/80 furthering growth and expanding the tax base which, of course, will serve to improve the schools , streets , municipal facilities and the general welfare of the community. Councilman Dunn seconded the motion and it prevailed as follows : Ayes : Tate, Ware, Oliver, Brekken, Dunn, Mullendore, Shafer Nays : None PUBLIC HEARING - ZONING APPLICATION Z80-20, BOB TAYLOR � The next order of business was for the City Council and Planning ' rO & Zoning Commission to conduct a Public Hearing relative to wr�wr Zoning Application Z80-20 submitted by Bob Taylor. Mayor Tate declared the Public Hearing open. The Acting City Secretary explained the application. She noted that the applicant was requesting a zoning change on Lot 5 , Watson Addition, City of Grapevine, Texas , (generally located on the third lot to the North from the Northeast corner of Scribner and West Northwest Highway) , from R-2 Two Family Dwelling District to , C-2 Community Business District or in the alternative, any higher , zoning that is more restrictive by use or restrictions . ' Mr. Bob Taylor was in attendance and made a brief presentation to the Council. There were no guests present to speak for or against the application. There being little discussion, Harlen Joyce made a motion to close the Planning & Zoning Commission' s portion of the Public Hearing. The motion was seconded by Ron Cook and prevailed by the following vote: � Ayes : Rogers, Sands , Spencer, Joyce and Cook Nays : None � 05/06/80 Councilman Shafer made a motion to close the Council ' s portion of the Public Hearing. Councilman Mullendore seconded the motion and it prevailed by the following vote : Ayes : Tate, Ware, Shafer, Mullendore, Brekken, Oliver and Dunn Nays : None PUBLIC HEARING - MOBILE HOME APPLICATION 80-3 - IGLESIAS � The next order of business was for the City Council and Planning & Zoning Commission to conduct a Public Hearing relative to Mobile � Home Application 80-3 submitted by Maria lglesias . Mayor Tate declared the Public Hearing open. City Manager Jim Hancock explained that the application, filed in the office of the City Secretary, requested the applicant be allowed to place a mobile home on a 5 . 8 acre tract of land in the G. W. Minter Survey. There was no one in attendance to represent the applicant. The Acting City Secretary then read the following letter of opposition. May 2, 19 8 0 Mrs . Shirley Armstrong, I am definitely against having the mobile home put on the property in question. �""°�� I just received this letter today. I have informed the City of Grapevine numerous time of correct address , both � by telephone and mail. �,�.� Again I will state I am against having the mobile home placed on the property shown on the map which was enclosed in this letter. MINUTES : Two Sets - April 15 , 1980 � The next order of business to come before the City Council was consideration of two sets of Minutes of April 15 , 1980 . ,� Mayor Pro Tem Ware made a motion to approve both sets of Minutes as printed.
