INVOCATION i The Invacation was delivered by Father B. Szarka, St. Francis Catholic Church. PUBLIC HEARING - REVENUE SHARING FUNDS The first order of business was for the City Council to hold a public hearing for the purpose of considering the use of anticipated 1978-79 Revenue Sharing Funds. Mayor Tate declared open the public hearing. Mayor Tate asked if there were any guests present to speak for or against the proposed expenditures. There were none. There was little discussion from the Council. Councilman Dunn made a motian to close the public hearing. The motion was seconded by Councilman Gideon and prevailed by the following vote: Ayes : Tate, Gideon, Florence, Oliver, Dalton, Shafer, and Dunn Nays : None AUDITOR - 1977-78 FISCAL YEAR �`` The next order of business was for the City Council to consider the appointment of an auditor for the 1977-78 fiscal year. Council- man Charles Dunn; Personnel Committee Chairman referred to the auditor' s engagement letter dated May 8, 1978 received from the firm of Pittman & Harris. The letter was reviewed in detail. Following a lengthy discussion, Councilman Gideon made a motion to appoint the firm of Pittman & Harris to audit the 1977-78 city records. The motion was seconded by Councilman Florence and prevailed by the following vote: Ayes: Tate, Gideon, Flarence, Oliver, Dalton, Shafer, and Dunn Nays : None . SPEED LIMIT, MCPHERSON SLOUGH, LAKE GRAPEVINE The next order of business was for the City Council to consider an ordinance relative to the speed limit in McPherson Slough, Lake Grapevine. Acting City Attorney Ray Price explained the o�ntents of the pro- posed ordinance.� It was noted that the general text of the ordi- � nance called for the entrance to the slough to be buoyed and re- stricted to a 5 MPH speed zone. The City Secretary read the caption of the ordinance. There being no further discussion, �uncilman Dalton made a motion that the ordinance be passed on an emergency basis. The motion was seconded by �ouncilman Shafer and prevailed by the following vote: Ayes: Tate, Florence, Oliver, Dalton, Gideon, Dunn, and Shafer I Nays: None � ORDINANCE NO. 78-54 'I . _ AN ORDZNANCE ESTABLISHING A FIVE (5) MILE PER HOUR SPEED LIMIT FOR ALL MOTOR BOATS ON THE SOUTH SIDE OF GRAPEVINE LAKE ADJACENT TO OAK GROVE PARK IN AN AREA S�ECIFICALLY DEFINED IN THE BODY OF THE ORDI- NANCE; REQUIRING FOR SIGNS TO BE PLACED; PROVIDING A SEVERABILITY CLAUSE; PROVIDING A PENALTY AND DE- �� CLARING AN EMERGENCY. ORDINANCE - $2000,.00 . ISSUE CERTIFICATES OF OBLIGATION The next order of business was for the City Council to consider an ordinance authorizing the issuance of $200,000 ot City of Grapevine Certificates of Obligation far the extension of Main Street. x A short history of the proposed issue was given by City Manager Jim Hancock. The City Secretary then read the caption of the proposed ordinance. Financial Advisor, Mike Ashford made a short explanation of the meaning of the issuance of certificates of obligation. There being no further discussion, Councilman Dunn made a motion to adopt the ordinance. The motion was seconded by Councilman Shafer and prevailed by the following vote: Ayes: Tate, Florence, Oliver, Dalton, Shafer, Dunn, and Gideon. Nays: None. ORDINANCE NO. 78-56 AN ORDINANCE BY THE CITY COUNCIL OF THE CITY OF GRAPEVINE, TEXAS, AUTHORIZING THE ISSUANCE OF $200, 000 "CITY OF GRAPEVINE, TEXAS, GENERAL OBLIGATION CERTIFICATES OF OBLIGATION, SERIES 1978-A, "DATED OCTOBER 1, 1978, UNDER AND PURSUANT TO THE AUTHORITY CONTAINED IN THE CERTIFICATE OF OBLIGATION ACT OF 1971, AS AMENDED; MAKING PROVISION FOR THE PAYMENT AND SECURITY OF SUCH OBLIGATIONS; PROVIDING FOR THE SALE AND DELIVERY THEREOF; AND ENACTING PROVISIONS INCIDENT AND RELATING TO THE PLTRPOSES AND SUBJECT OF THIS ORDINANCE. ORDINANCE - $450,000 ISSUE CERTIFICATES OF' OBLIGATION The next order of business was for the C�ty Council to consider an ordinance authorizing the issuance of $450,000 of City of Grapevin� Certificates of Obligation for the completion of the City' s Golf Course. ORDINANCE NO. 78-55 AN ORDINANCE BY THE CITY COUNCIL OF THE CITY OF GRAPEVINE," TEXAS, AUTHORIZING THE I55UANCE OF $450, 000 "CITY OF GRAPEVINE, TEXAS, GENERAL OBLTGATION CERTIFICATES OF OBLIGATION, SERIES 1978, "DATED OCTOBER 1,� 19'�8, UNDER AND PURSUANT TO THE AUTHORITY CONTAINED IN THE CERTIFICATE OF OBLIGATION ACT OF 1971, AS AMENDED; MAKING PROVISION FOR THE PAYMENT AND SECURITY OF SUCH OBLIGATIONS; PROVIDING FOR THE SALE AND DELIVERY THEREOF; AND ENACTING PROVISIONS INCIDENT AND RELATING TO THE PURPOSE AND SUBJECT OF THIS ORDINANCE. � MISCELLANEOUS REPORTS City Manager, Jim Hancock made the following miscellaneous announcements: - (a) The City of Grapevine officially received a grant in the amount of $1.5 million for construction of low rent housing projects. (b) Introduced the new City Finance Director, Mr. Lee Maness. � (c) The Police Department received a grant providing for an additional juvenile officer. MINUTES - Au,gust 8, 1978 The next order of business was for the City Council to consider the minutes of the August 8, 1978 meeting. Councilman Oliver made a motion to waive the reading of the minutes and approve them as published. The motion was seconded by Councilman Dalton and prevailed by the following vote: Ayes: Tate, Florence, Oliver, Dalton, Dunn, Shafer, and Gidean. Nays: None. EXECUTIVE SESSION The next order of business was for the City Council to recess to the Conference Room to discuss pending litigation and the purchase of real estate pursuant to Artile 6252-17, Section 2, Subsections (e) and (f) , Texas Civil Statutes. The Council then reconvened in the Council Chambers and were called �° to order by Mayor Tate, with all members present and took the following action relative to the purchase of real estate: The City Manager explained that on A pril 4, 1978 the Council passed a resolution authorizing the City Manager to make the necessary purchase of right-of-way for the purpose of storm drain- age, sewage easements, and other related utility purposes in con- nection with the development of DFW Industrial Park. He further advised that DFW Industrial Park would pay for fifty-five feet (55' ) � of the right-of-way, with the remaining fifteen feet (15' ) to be purchased by the City of Grapevine. Mr. Hancock advised that the negotiated price for the purchase as $1.50 per square foot. I Councilman Dunn then made the following motion: To authorize the II City Manager to purchase the land in accordance with the contracts, contingent upon DFW Industrial Park entering into a contract satis- � factory with the City Attorney to reimburse the City of Grapevine for their portion of the contract price. The motion was seconded by Councilman Oliver and prevailed by the following vote: Ayes: Tate, Florence, Oliver, Dalton, Dunn, Shafer, and Gideon. Nays : None. PUBLIC HEARING, 1978-79 City Budqet The next order of business was for the City Council to hold a public hearing for the purpose of considering the 1978-79 City Budget, and for the purpose of levying taxes for the year 1978, ' to be assessed on all taxable property within the Timits of the City of Grapevine, Texas. The City Council to also consider an ordinance relating there�o. Mayor Tate declared open the public hearing. City Manager Jim Hancock explained the proposed budget beginning with the Ad Valorem Tax Revenue and Proposed Distribution. The City Manager then advised that the total operating budget of the Tourist and Convention Bureau totaled $510,000.00. A represen- tative of the Tourist and Convention Bureau was not in attandance. Councilman Dunn noted that he would like to recommend the following changes in the proposed Tourist and Convention Bureau Budget: (a) Change the Advertising and Promotional budget from $35,000.00 to $20, 000.00. (b) Change the Personnel Services from $35,000.00 to $20,000.00. (c) Change Travel, Schools, and Dues from $6, 500.00 to $3, 500.00. He then suggested that the reduction of $33,000.00 be added to the purchase of securities for a total of $68, 000.00. After a short discussion, Mayor Tate asked if any member of the Council ob�ec�ed to the recommended changes. There were no ob- jections stated. Mayor Tate as]�ed if the�e were any guests present to speak for or against the recommended changes. There were none. The City Attorney advised that no formal action was necessary at the present time in regard to the recommended changes, but the City Manager �as so instructed to incorporate the _recommended changes into the 1978-79 budget upon formal adoption: The City Manager then explained the Firemen' s Relief and Retirement Fund. The City Manager advised that he had concluded the presentation of the 1978-79 City Budget. Mayor Tate aslced if there were any guests present to speak in regard to the proposed budget. Mr. Jesse Woods noted that he was disappointed that the Eity only anticipated 92/ collection of Ad Valorem taxes. The City-Manager advised Mr. Woods that in accordance with State Law and the City Charter, an anticipated collection rate in excess of 92/o was not allowed. There being no fu�rther discussion in regard to the proposed 1978-79 City budget, Councilman Gideon made a motion to close the public hearing. The motion was seconded by Councilman Florence and pre- vailed by the following vote: Ayes : Tate, Gideon, Florence, Oliver, Dalton, Dunn, and Shafer. Nays: None. Members of the Council then praised members of the City Staff for their efforts in the budget preparation. The City Secretary read the caption of the proposed ordinance. Councilman Oliver made a motion to adopt the ordinance. The motion was seconded by Councilman Dalton. Councilman Oliver then amended his motion to include that the recommended changes in the Tourist and Conventian Bureau Budget be included in the adoption of the budget. Councilman Dalton accepted the amendment to the motion and it prevailed by the following vote: Ayes : Tate, Florence, Oliver, Dalton, Dunn, Shafer, and Gideon. Nays: None. ORDINANCE NO. 78-53 AN ORDINANCE ADOPTING THE BUDGET FOR THE CITY OF i GRAPEVINE, TEXAS, FOR THE FISCAL YEAR BEGINNING OCTOBER 1, 1978 AND ENDING SEPTEMBER 30, 1979: LEVYING TAXES FOR THE YEAR 19_78 TO BE ASSESSED � ON ALL TAXABLE PROPERTY WITHIN THE LIMITS OF THE � CITY OF GRAPEVINE, TEXAS: PROVIDING PENALTIES AND � INTEREST FOR DELIQUENT TAXES; PROVIDING FOR THE INTRA AND INTER DEPARTMENT AND FUND TRANSFERS; PROVIDING FOR THE COLLECTION OF DELIQUENT TAXES AND DECLARING AN EMERGENCY. Mayor Tate advised that the published agenda had been completed and asked if the City Manager had anything further to report to the Council. The City Manager advised that the City Manager of Colleyville had contacted him in regard to the Colleyville-Grapevine Boundary, and advised that Colleyville was interested in obtaining some frontage along Highway 157 to be included in their City Limits. Mr. Hancock stated that he advised the City Manager of Colleyville that in all probability the City Council of Grapevine would not . entertain that sort of concession. There was no discussion and no action was taken relative to the Colleyville Boundary report. There being no further discussion to come before the Council, Councilman Oliver made a motion to adjourn. The motian was seconded by Councilman Dunn and all present voted aye. Whereupon, among ot er business t e fo) owing was transacted at said meeting: An Ordinance by the City Council of the City of Grapevine, Texas, ' authorizing the issuance of $450,000 "City of Grapevine, Texas, `r General Obligation Certificates of Obligation, Series 1978" dated October I, 1978, under and pursuant to the authority contained in the Certificate of Obligation Act of 1971, as amended; making pro- vision for the payment and security of such obligations; providing for the sale and delivery thereof; and enacting provisions incidenfi and relating to the purpose and subject of this Ordinance.
