Tate Mayor Doil Dalton Mayor Pro-tem ' Charles Gideon Councilman Larry Oliver Councilman David Florence Councilman Willis Pirkle Councilman constituting a quorum with Councilman Dunn absent and the follow- ing staff inembers in attendance: James Hancock Acting City Manager John F. Boyle City Attorney Shirley Armstrong City Secretary Mayor Tate called the meeting to order. The Invocation was delivered by Mayor Pro-tem Dalton. The first order of business was consideration of the minutes of November 15 and 22, 1977. Councilman Oliver made a motion to waive the reading of the minutes and approve them as printed. The motion was seconded by Councilman Dalton and prevailed by the following vote: Ayes: Tate, Dalton, Gideon, Florence, Oliver and Pirkle Nays: None Absent: Dunn The next order of business was consideration of citizens re- quests and miscellaneous reports. Mr. A. C. Urbanosky, Presi- dent of Northeast Tarrant County Soccer Association expressed his appreciation to the City Council, Members of the City Staff and to the citizens of Grapevine for their cooperation in the use of soccer fields during the recent soccer season. He especially commended the City Park & Recreation Department for the excellent condition of the fields. The next order of business was for the City Council to hold a public hearing to consider an application submitted by Mr. L. W. Parker to relocate a portable building. Mayor Tate declared open the public hearing. The City Secretary advised that the applicant would not be in attendance and there- fore, explained the nature of the request. Mr. Parker had re- quested that he be allowed to place an 8 'x20� portable frame building on his property at 520 Main Street. The City Secretary provided Council Members a picture of the structure in question. Building Inspector Joe Lipscomb explained that the building was combustible and was located in the first fire district, which was a violation of the building code. Mayor Tate asked if there were guests present to speak for or against the application. There were none. The City Secretary reported that she was not in receipt of any petitions or correspondence relative to the application. � � � � Councilman Pirkle made a motion to close the Public Hearing . ` The motion was seconded by Councilman Florence and prevailed � by the following vote: � � Ayes: Tate, Dalton, F'lorence, Gideon, Oliver and Pirkle � Nays : None � Absent: Dunn � s ' There was then a short discussion among Council Members rela- tive to the fact that approval of the application would constitute vaxiances in the building and electrical codes . � Councilman Pirkle made a motion that the application be denied. � The motion was seconded by Councilman G�deon and prevailed by � the following vote: � > Ayes : Tate, Gideon, Florence, Oliver, Dalton and Pirkle � Nays : None � Absent: Dunn � E The next order of business was for the City Council to consider � the acceptance of right-of-way deeds as presented by Mr. James � F. Mason. Mr. Mason provided Council Members with plats of � D�FW Industrial Park which included dedication of a 60' public � right-of-way. Mayor Tate advised that he had received informa- � tion late in the day that had a direct bearing on the dedica- � tion and preferred to discuss the matter with Mr. Mason prior � to acceptance of the dedication by the Council. � Councilman Dalton made a motion to table the item. The motion was seconded by Councilman Pirkle and prevailed by the follow- � ing vote: , Ayes: Tate, Gideon, Florence , Oliver, Dalton and Pirkle � Nays: None � Absent: Dunn � The next order of business was for the Cit Council to consider � Y � authorizing the City Staff to advertise for bids and set a bid � date relative to construction of the golf course maintenance building. The Acting City Manager advised that the City Staff recommended a bid date of January 11 , 1978 at 2:00 p.m. Councilman Florence made a motion to accept the recommendation of the City Staff. The motion was seconded by Councilman Gideon and prevailed by the following vote: Ayes: Tate, Gideon, Rlorence , Oliver, Pirkle and Dalton � Nays : None � Absent: Dunn � t The next order of business was for the City Council to consider � an amendment to the ordinance pertaining to wrecker service. Mr. Hancock explained that the existing ordinance stated that � after an application for wrecker service was made, a committee � of 3 persons, appointed by the Council would inspect the � equipment of the company making the application and classify � that equipment according to standards set out in the ordinance. He further advised that the recommendation was that the Chief � of Police or his appointee make the inspection rather than the � Committee. He also pointed out that the present Qrdinance re- ! quired wrecker companies to carry liability insurance of � $10,000 bodily injury per person; $20,000 bodily injury per � accident; and $5,000 property damage per accident . Mr. Hancock advised that the City Staff recommended an increase of $100,000 bodily injury per person; $300,000 bodily injury per accident; and $25,000 property damage per accident. � � � � � � r The City Secretary read the caption of the proposed ordinance. There waslittle discussion. Councilman Pirkle made a motion to adopt the ordinance. The motion was seconded by Councilman Dalton and prevailed by the following vote: Ayes: Tate, Dalton, Gideon, Rlorence, Oliver and Pirkle Nays: None Absent: Councilman Dunn ORDINANCE NO. 77-64 AN ORDINANCE AMENDING CHAPTER 10 OF THE CITY CODE OF GRAPEVINE, TEXAS PERTAINING TO WRECKERS BY AMENDING SECTION 4-10�2 TO PROVIDE FOR THE CHIER OF POLICE TO INSPECT THE EQUIPMENT AND BY AMENDING SECTION 4-10-4 PERTAINING TO INSURANCE REQUIREMENTS; PROVIDING A SEVERABILITY CL.AUSE; PROVIDING A PENALTY AND DECL.ARING AN EMERGENCY. The next order of business was for the City Council to consider an amendment ordinance relative to utility rates . Mr. Hancock explained that on October 4, 1977 the Council had passed Ordinance #77-49 pertaining to a 25�o increase in water rates. He advised that a technical error had occurred in computing the increase as shown in the ordinance and that several of the figures needed to be reduced by five cents. He explained that the rate increase had been fed into the computer properly and that no errors had occurred in billing. There was little discussion. The City Secretary read the caption of the proposed ordinance. Councilman Oliver made a motion to adopt the ordinance. The motion was seconded by Councilman Dalton and prevailed by the following vote: Ayes: Tate, Dalton, Gideon, Florence, Oliver and Pirkle Nays: Norie Absent: Councilman Dunn ORDINANCE NO. 77-62 AN ORDINANCE AMENDING TITLE 7, CHA.PTER 2, SECTION 2, OF THE CITY CODE OF THE CITY OF GRAPEVINE, TEXA,.S, REVISING WASTEWATER RATES AND THE EFFECTIVE DATE TO BE RETRO-ACTIVE TO OCTOBER 20, 1977; PROVIDING A SEVERABILITY CLAUSE; PROVIDING A PENALTY; AND DECL.ARING AN EMERGENCY. The next order of business was for the City Council to consider the recommendation of the Planning & Zoning Commission concerning the preliminary and final plat of Laguna Vista Addition, Phase II. Mr. Joe Lipscomb, Building Inspector advised that the Planning & Zoning Commission recommended approval of the plat by a unanimous '� vote. - After a short discussion, Councilman Dalton made a motion to accept the recommendation of the Planning & Zoning Commission and approve the final plat of Laguna Vista, Phase II as presented. The motion was seconded by Councilman Gideon and prevailed by the following vote: Ayes: Tate, Dalton, Gideon, Florence, Oliver and Pirkle Nays: None Absent: Councilman Dunn Mayor Tate then declared a recess at 8:30 P.M. � � � � � The Council reconvened in the Council Chambers at 9:05 P.M. � with all members present except Councilman Dunn. � � The next order of business was for the City Council �to � consider an ordinance controlling land use and construction � € in the flood plain area. � � The City Attorney explained the contents of the proposed ; ordinance and the City Secretary read the caption. The City Cauncil recanvened in the Council Chambers with all members present except Cauncilman Dunn. Mayar Tate advised that the Council had discussed applications ' relative to the position of City Manager but that a decision would not be made until all Councilmen were in attendance. He stated that the matter would be discu�sed again on December 20th. No �ormal action was taken.
