HomeMy WebLinkAboutORD 1980-033 CITY OF GRAPEVINE ORDINANCE NO. 80-33 AN ORDINANCE PROHIBITING THE WATERING OF LAWNS EXCEPT DURING SPECIFIED TIMES; PROVIDING A SEVERABILITY CLAUSE; PRO- VIDING A PENALTY; AND DECLARING AN EMERGENCY. �,�. e ' WHEREAS , the City of Grapevine is the owner and operator of ;� a water works system pursuant to Article 1175 , 1110 and 1111, ;�, Tex. Rev. Civ. Stat. and other relevant State statutes , and WHEREAS , the said statutes authorize and empower the City to operate said system in such a manner as is in the best interests of the citizens and the community and in a manner that protects the health, life and property of the citizens, and � WHEREAS , the City is now experiencing at peak times a shortage of water in its available storage tanks as a result of the recent substantial expansion of residential development with an attendant population increase, coupled with high consumption of water in the hot summer months , and WHEREAS, the City Council believes that the availability of water for personal domestic consumption is its primary goal as the owner of a public water system, and WHEREAS, as a result of the aforedescribed shortage, the Council, based on the findings and recommendations of the City Administration, finds it necessary to impose certain sanctions and penalties at times on the watering of residential lawns ; "'!'� NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE � CITY OF GRAPEVINE, TEXAS : i ��w Section l. That it shall be unlawful for any person, firm partnership, corporation or entity of any type to use, or allow to be used, the treated water purchased from the City of Grapevine to water grass and lawns except as follows : A) No watering shall be permitted from 12 :00 Noon to 12 :00 Midnight. B) Addresses ending in an even number shall be allowed to water between 12 :00 Midnight and 12 :00 Noon on even days (even being defined as 0 , 2 , 4 , 6 , 8, 10 , 12 , 14, 16 , 18 , 20 , 22 , 24 , 26 , 28 , 30) . C) Addresses ending in an odd number shall be allowed to water between 12 :00 Midnight and 12 :00 Noon on odd days (odd being defined as l, 3, 5 , 7 , 9 , 11, 13, 15, 17 , 19 , 21, 23, 25, 27, 29) . D) Addresses with new lawns shall be issued, at the descretion of the City Staff, a permit allowing lawns to be watered on a daily basis, for a period of thirty days . �� Section 2 . Notice of this ordinance shall be given by pub- lishing a copy of same in The Grapevine Sun one time. � Section 3 . Penalty. Any person violating any of the provisions of this ordinance shall be deemed guilty of a misdemeanor, and upon conviction t�ereof, shall be fined $1 .00 to $200 .00 ; each day such violation continues shall constitute a separate and distinct offense . In case of any willful violation of any of the terms and provisions of this ordinance, The City, in addition to imposing the penalties above provided, may institute any appropriate action or proceeding in any court having proper jurisdiction, to restrain, correct or abate such violations ; and the definition of any violation of the terms of this chapter as a misdemeanor, shall not preclude the City � from invoking the civil remedies given it by the laws of the State, but sameshalZ be cumulative and subject to prosecution as herein- above prescribed for such violations . Section 4 . Severability. If any section, sentence, phrase, word, paragraph, or provision of this ordinance or the application of that sectio�, sentence, phrase, word, paragrah, or provision to any person, situation or circumstances is for any reason adjudged invalid, the adjudication shall not affect any other section, sen- tence, phrase, word, paragraph or provision of this ordinance or the application of any other section, sentence, phrase, word, paragraph, or provision to any other person, situation, or circum- stances , nor shall such adjudication affect any other section, sentence, phrase, word, paragraph or provision of the Grapevine City Code. The City Council declares that it would have adopted the valid portions and applications of this ordinance without the invalid part and to this end the provisions of this ordinance are declared to be severable. Section 5 . Emergency Clause. The fact that the present ordinances and regulations of the City of Grapevine, Texas, are inadequate to properly safeguard the health, safety, morals, peace, and general welfare of the inhabitants of the City of Grapevine, Texas , creates an emergency for the immediate preservation of public business, pro- �,,, perty, health, safety, and general welfare of the public which requires that this ordinance shall become effective from and after '� the date of its passage and it is accordingly so ordained. � PASSED AND APPROVED THIS THE 17th DAY OF June 1980 .
