SEP-Z fi�0 5 3 4 � � '� ..� t�;p ; ,�-,� ORDINANCE N0. 80-48 AN ORDINANCE ABANDONING A UTILITY EASEMENT IN THE CITY OF GRAPEVINE, TEXAS, AS HEREIN- AFTER DESCRIBED; PROVIDING A SEVERABILITY CLAUSE; AND DECLARING AN EMERGENCY WHEREAS , the owner of the underlying fee title property �" upon which a utility easement crosses in the City of Grape- vine, Texas, have requested the easement as hereinafter des- cribed, be abandoned and vacated; and � WHEREAS, the subject easement hereinafter described is not now needed for public use and will not be needed in the future for a public use; and WHEREAS , the closing, abandoning and vacating the easement will relieve the City of Grapevine, Texas , from the cost and expense of maintaining said property; and � WHEREAS, all existing utility lines in said easement have been relocated. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF GRAPEVINE, TEXAS; SECTION 1. That the easement more particularly described as follows : Permanent easement to be abandoned comprises a (10) foot wide strip of land, the easement being more particularly described as follows: ����, , BEGINNING at an iron pin in the southeast corner o Lot 3, Block l, Creekwood Estates , � THENCE, S. 58° 00' 00" E. a distance of 10 feet to a point, THENCE, N. 31° 00 ' 00" W. a distance of 70 feet to a point, THENCE, N. 31° 00 ' 00" W. a distance of 270 feet to a point, THENCE, S. 31° 00' 00" E. a distance of 270 feet to the point of beginning; said permanent easement to be abandoned being ten (10) feet in width, and 270 feet in length, more or less , measured along the center line of said easement, that being the abandoned easement runs diagonally across Lots 1, 2 , and 3 , of Block 3, as shown on the Final Plat of Creekwood Estates , Volume 388-111, Page 11, Tarrant County Deed Records , Tarrant County, Texas; and the same is hereby abandoned and vacated for public use, and the same is hereby abandoned and vacated insofar as � all public right, title and interest in and to said described portion of said easement is concerned. SECTION 2. That the terms and provisions of this ordinance � shall be deemed to be severable and that if the validity of any section, subsection, word, sentence or phrase shall be held to be invalid, it shall not affect the remaining part of this ordi- nance. SECTION 3. The fact that said easement is no longer needed by the public for utility purposes would create a hardship or vo� ?OQ3Pac� 11&3 burden upon the City of Grapevine, Texas, to keep open and main tain such easement, creates an urgency and an emergency for the immediate preservation of the public health, safety and general welfare which requires that this ordinance shall take effect immediately from and after its passage and it is accordingly so ordained.
