A RESOLUTION OF THE CITY OF GRAPEVINE,
TEXAS, AUTHORIZING THE CITY MANAGER AND
CHIEF OF POLICE TO EXECUTE AN AGREEMENT WITH
CRIMINAL DISTRICT ATTORNEY OF TARRANT
COUNTY, TEXAS REGARDING FORFEITURES OF
PROPERTY AND PROVIDING AN EFFECTIVE DATE
WHEREAS, the City Manager and Chief of Police recommend the
City Council of the City of Grapevine, Texas, authorize by
� resolution that the City of Grapevine execute agreements with the
Office of the Criminal District Attorney for Tarrant County
regarding forfeitures of property pursuant to Chapter 59 of the
Texas Code of Criminal Procedures; and
WHEREAS, Chapter 59 of the Texas Code of Criminal Procedure
enacted in 1989 provides for the forfeiture to the State of Texas
and its agencies and political subdivisions of certain property of
any nature, including real, personal, tangible, or intangible, that
is either used or intended to be used in the commission of certain
felonies enumerated in Art. 59 .01 of the Texas Code of Criminal
Procedure or its proceeds or acquired with proceeds gained from the
commission of certain felonies enumerated in Art. 59 .01 of the
Texas Code of Criminal Procedure; and
WHEREAS, the Office of the Criminal District Attorney of
Tarrant County, Texas (hereinafter called District Attorney) has a
duty to represent the State of Texas regarding forfeitures of
property pursuant to Chapter 59 of the Texas Code of Criminal
Procedure; and
�� � WHEREAS, the Grapevine Police Department, an agency or
political subdivision of the State of Texas, has certain duties to
the citizens of the State of Texas to provide law enforcement
�' protection and services; and
WHEREAS, the Criminal District Attorney of Tarrant County,
Texas and the Police Department of the City of Grapevine wish to
join together in the enforcement of Chapter 59 of the Texas Code of
Criminal Procedure in Tarrant County.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF GRAPEVINE, TEXAS:
Section 1 . That the City Manager and Chief of Police are
hereby authorized to execute an agreement with the Office of the
Criminal District Attorney of Tarrant County, Texas, regarding
forfeiture of property pursuant to Chapter 59 of the Texas Code of
Criminal Procedure.
Section 2 . That this resolution shall take effect from and
after the date of its passage.
PASSED AND APPROVED BY THE CITY COUNCIL OF THE CITY OF
GRAPEVINE, TEXAS on this the 7th day of November , 1989 .
