RESOLUTION NO. 87-38
A RESOLUTION AWARDING A CONSTRUCTION BID ON A
PUBLIC WORKS CONTRACT AT DOVE PARK TO LAND
CONSTRUCTORS, INC. TO CONSTRUCT TWO (2 )
POST-TENSIONED CONCRETE LIGHTED TENNIS
� COURTS, ONE (1) POST-TENSIONED CONCRETE
LIGHTED BASKETBALL COURT, SAND LIGHTED
VOLLEYBALL COURT, SIDEWALKS, IRRIGATION AND
� LANDSCAPING AND A GROUP SHELTER IN THE AMOUNT
OF �227,788.00 AFTER A HEARING CONDUCTED
PURSUANT TO AND IN ACCORDANCE WITH TEX. REV.
CIV. STAT. ANN. ART. 2368a.3
WHEREAS, the City published notice to accept construction
bids for a public works project to-wit Dove Park Improvement
Construction Contract for two (2 ) post-tensioned concrete
lighted tennis courts, one (1) post-tensioned lighted concrete
basketball court, one (1) sand lighted volleyball court,
sidewalks, irrigation and landscaping and an alternative bid
consisting of a group shelter and its concrete foundation; and
WHEREAS, the low bidder was Souter Paving Co. ( "Souter" )
and the second low bidder on the primary project, plus the
alternate, was Land Constructors, Inc. ( "Land" ) ; and
WHEREAS, the combined bid from Souter was �225,967 .00,
and the combined bid from Land was $227, 788.00; and
WHEREAS, the City Staff and the City' s independent
professional consulting firm are recommending that the bid be
�'�'" awarded to Land and not the low bidder, Souter, on the basis
that Land is the lowest responsible bidder in that Souter is
less experienced in this type of work, i .e. , post-tensioned
concrete park and athletic facilities, and Land has a proven
track record in the construction of concrete work in parks and
recreation projects; and
WHEREAS, pursuant to and in accordance with Tex. Rev.
Civ. Stat. Ann. Art. 2368a.3, notice was given to Souter
informing it of the City Staff ' s recommendation and that an
opportunity to appear before the City Council at a regular
meeting of September 15, 1987 at 7: 30 p.m. at the Grapevine
City Council Chamber was afforded to Souter to present evidence
concerning the bidder ' s responsibility; and
WHEREAS, the City Council did consider all evidence
submitted and did conclude that the subject bid should be
awarded to Land as the lowest responsible bidder.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF GRAPEVINE, TEXAS:
Section 1 . That all matters stated in the preamble are
found to be true and correct and are incorporated into the body

Section 2 . That the City Council does hereby find and
� declare that Land Constructors, Inc. with a combined bid of
�227,788.00 is the lowest responsible bidder for the Dove Park
Improvement Construction Contract, and the Contract for said
project is hereby awarded to Land Constructors, Inc.
Section 3 . That this resolution shall take effect from
and after its passage.
