A RESOLUTION OF THE CITY COUNCIL OF THE CITY
, OF GRAPEVINE APPROVING, RATIFYING, AND
AFFIRMING A CONTRACT WITH J.L. MYERS COMPANY
IN THE AMOUNT OF �5 ,875 .65 FOR THE REPAIR OF
A TAIT RAW WATER INTAKE PUMP; AUTHORIZING
PAYMENT FOR THE REPAIR WORK IN THE AMOUNT OF
$5 ,875 .65; FINDING AND CONCLUDING THE TAKING
y� ^ OF COMPETITIVE BIDS WAS UNNECESSARY BECAUSE
THE EXPENDITURE IS FOR A PROCUREMENT
NECESSARY TO PRESERVE AND PROTECT THE PUBLIC
�� HEALTH AND SAFETY OF THE CITY' S RESIDENTS;
AND PROVIDING AN EFFECTIVE DATE.
WHEREAS, on April 4, 1988, the City Manager authorized
repair work to be performed by J.L. Myers Company in the
estimated amount of $5 ,000 to $6,000 for the repair of the
City ' s Tait raw water intake pump; and
WHEREAS, the estimate submitted by J.L. Myers Company was
the lowest estimate of two quotes received by the City, the
other estimate being in the amount of $7 , 300 from Layne-�9estern
Company, Inc. ; and
WHEREAS, immediate performance of the repair work without
delay was necessary to enable the City to adequately provide
water within the community; and
WHEREAS, the City Council finds and concludes that
pursuant to Section 252 .022 (a) (2 ) of the Texas Local Government
Code, compliance with the competitive bidding process was
unnecessary because the expenditure was for a procurement
necessary to preserve and protect the public health and safety
of the City' s residents; and

- WHEREAS, the City Council concludes and determines that
the contract with J.L. Myers Company for the repair of the Tait
raw water intake pump should be approved and ratified and that
payment to J.L. Myers Company in the amount of $5 ,875 .65 for
the repair work should be authorized .
li NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
; CITY OF GRAPEVINE, TEXAS:
; Section l . That all of the above premises are found to
� be true and correct and are incorporated into the body of this

resolution as if copied in their entirety.
Section 2 . The contract between the City of Grapevine
II and J.L. Myers Company in the � amount of $5 ,875 .65 for the
repair of the Tait raw water intake pump is hereby approved,
�'i ratified and affirmed.

Section 3 . The City Manager, or his designated
representative, is hereby authorized to pay the sum of
$5 ,875 .65 to J.L. Myers Company for the repair of the Tait raw
� water intake pump.
� Section 4 . That this resolution shall take effect
� '���� immediately upon its passage and approval .
