Hancock Ass � t. City Manager � Shirley Armstrong City Secretary John Boyle City Attorney Mayor Tate called the meeting to order. i The invocation was delivered by Mayor Pro Tem Dalton. Mayor Tate announced that the Public Hearing regarding Zoning Application Z76-24 submitted by Lanny Tate had been cancelled. The first order of business was for the City Council and Planning and Zoning Commission to hold a public hearing for the purpose of rezoning a tract of land out of the T. Mahan � Survey, Grapevine, Tarrant County, Texas from "R-3" Multi- family Dwelling District to "C-2" Community Business District. Mayor Tate then introduced the applicant, Hugh M. W�ite to make his presentation. Mr. Waite explained that he was a home builder and residential developer in the Euless and Bedford area. Mr. Waite then provided Council members with a map and proposed site plan of the property in question. He explained that the most northerly portion of the property was declared Commercial when the City adopted the official zoning map, but added that exact boundaries were vague and that the City Attorney had recommended the en- tire tract be considered in the zoning application to clarify � city records. Mr. Waite explained that the site plan was � drawn only to show possible usages of the property. � � � Mayor Tate stated that questions were in order from the �' Planning & Zoning Commission. Member Joe Kennedy asked if � � Mr. Waite could be more specific regarding the type.business that would be built. Mr. Waite explained that definite plans � could not be made until the zoning situat ion was corrected, �' but added that tentative discussions had been conducted re- garding a retail food business on a portion of the property. � � Member Cato Jones asked the applicant if he owned the property. Mr. Waite e�lained that he was under contract to purchase the property contingent upon the outcome of the zoning hearing. Mayor Tate then stated that questions were in order from the Council. There were no questions. � Mayor Tate then stated that questions would be entertained from the audience. Dr. Minnie Lee Lancaster and Mr. Jesse Woods, both property owners within 200 feet, stated that they had no objections to the z oning request. � �` The City Secretary commented that she had not received any correspondence from surrounding property owners regarding the zoning case, but added that Mr. Mel Hobratsch had telephoned to state that he had no objections to the re- quested zoning. There being no further discussion, Member Harlen Joyce made a motion to close the Commission�s portion of the Public Hearing. The motion was seconded by Member Cato Jones and � prevailed by the following vote: Ayes: Ware, Jones, Davis, Joyce and Kennedy Nays: None Absent: Crabtree Councilman Pirkle then made a motion to close the Council 's portion of the Public Hearing. The motion was seconded by Counci�man Florence and prevailed by the following vote: Ayes: Tate, Gideon, Florence, Oliver, Dalton, Dunn & Pirkle � Nays: None � Mayor Tate then acknowledged that the Council would recess � to the Conference Room to discuss pending litigation �. � pursuant to Article 6252-17, Section 2(e) , Texas Civil Statutes. He explained that the Planning & Zoning Commission would remain in session in the Council Chambers to consider further agenda items. The City Council reconvened in the Council Chambers at 8:40 P.M. with all members present. The first order of business was for Mr. Jim Driskell to make a report to the City Council concerning the recent traffic survey. Mr. Driskell stated that the Traffic Engineering Plan as prepared by his firm was made available to the City through the Office of Traffic Safety. He explained that the survey dealt with all aspects of traffic engineering based on a manual called Uniform Traffic Control Devises . He added that studies were made regarding traffic volumes, traffic control devices, (signs, pavement markings and traffic signals) traffic circulation, accidents, school safety, and traffic ordinances. Mr. Driskell then pointed out some major recommendations includ- ing improvements at the intersection of Main and Northwest Highway, striping along Main Street, signal timing pattern along Main Street and updating of signs. The City Manager stated that the Council was in disagreement with recommendations regarding the elimination of some four- way stop signs . Mr. Driskell commented that any recommenda- �,`' tion that his firm made as based on criteria prescribed in the MANUAL ON UNIF'ORM TRAFFIC CONTROL DEVICES for the S�ate of Texas . He explained that three factors were involved in � determining the necessity of a four-way stop; those being, traffic volume, number of accidents, and whether or not a traffic level had been reached which required traffic signals. __ � Mayor Tate commented that that seemed to be proper rational in regard to installing a four way stop, but not in removing a four way stop. He stated that the element of human nature should also be considered and added that if a four way stop is suddenly r�moved, then the accident rate would increase rather rapidly. There was little other discussion. Members of the Council thanked Mr. Driskell for being in attendance and complimented Mr. Driskell �s firm for an excellent survey. The next order of business was for the City Council to consider a resolution establishing the official population of the City � of Grapevine. The City Manager stated that the guidelines to determine the population were those used by the North Central Texas Council of Governments in their census report book of 1970. He then reported that the estimated population of Grapevine is presently 11,474. Councilman Dalton made a motion that the resolution be adopted to designate the City of Grapevine�s population as 11,474 as of January 1, 1977. � The motion was seconded by Councilman Pirkle and prevailed by the following vote: Ayes: Tate, Gideon,Florence, Oliver, Dalton, Pirkle & Dunn Nays: None � RESOLUTION NO. 77-4 A RESOLUTION MAKING OFFICIAL FINDING AND DETERMINATION AS TO THE POPUL,ATION AND NUMBER OF INHABITANTS OF AND WITHIN THE CITY OF GRAPEVINE, TEXAS, AS OF JANUARY 1, 1977. The next order �of business was for the City Council to consider an amendment to the traffic sign ordinance. The City Secretary read the caption of the ordinance and reported that the only � change stated in the body of the ordinance was the addition of a stop sign on the northeast corner of Kimball Road at its intersection with Dove Road. Councilman Oliver made a motion to adopt the proposed ordinance. The motion was seconded by Councilman Gideon and prevailed by the following vote: Ayes: Tate, Gideon,Florence, Oliver, Dalton, Pirkle & Dunn Nays: None ORDINANCE NO. '77-4 AN ORDINANCE AMENDING TITLE 9, CHAPTER 2, SECTION 2 OR THE CITY CADE OF THE CITY OF GRA.PEVINE, TEXAS, BY ADDING STOP SIGNS AT CERTAIN LCX',�TIONS DESCRIBED HEREIN; PRO- VIDING A SEVERABILITY CLAUSE; PROVIDING A PENRLTY; AND DECLARING AN EMERGENCY. The next order of business was for the City Council to consider a proposed amendment to Ordinance Number 72-40, which adopted the 1971 Code of Rules and Regulations of the Da11as�Fort Worth Airport .Board. City Attorney John Boyle explained that � two ordinances would need to be considered in regard to the � proposed amendments. The City Secretary read the caption of proposed Ordinance #77-2. The City Attorney then explained that the ordinance set out speed limits within Fort Worth Airport, and deleting others that are no longer in effect. Councilman Pirkle made a motion that the ordinance be adopted. �; The motion was seconded by Councilman Oliver and prevailed by � the following vote: � Ayes: Tate, Gideon, Florence, Oliver, Dalton, Pirkle & Dunn Nays: None ORDINANCE NO. �7-2 An Ordinance by the City Council of the City of GraE�evine, Texas, approving Resolution No. 76-1?7 of the Dallas-Fort Worth Regional Airport � � 8oard, which amends Resolution No. 71-172 (knovrn and adopted as The Code i � of Rules and Regulations of the Dqllas-Fort Worth Regional Airport Board), pro- � viding for the amendment of Chapter Two of the Code, Section 2 thereof, entitled � "Traffic Control Insfallations"; adopting and setting new vehicular speed limits on certain specified streets and service roads within the boundaries of t{�e Dallas- G Fort Worth Regional Airport, which said speed limits were and are hereby based upon an engineering and traffic investigation as required by state law; providing for the operation of the code only within the bounds of the Dallas-Fort Worth Regional Airport; providing for the retention of the sovereign and proprietary authority of the City of Grapevine; providing a Penalty, a Severability and Savings Clause, and declaring an emergency. A breach of the terms of this Ordinance � ' r . � will subject the violator to the infliction of a penalty by a fine not to exceed ' � �� . The City Attorney then explained that the proposed ordinance was an amendment to the existing rules and regula- tions of the Dallas�Rort Worth Airpo�t Board that had pro- visions relative to charitable solicitations. He added that charitable solicitation was the subject of pending litigation concerning the Hare Krishna vs. D�RW Airport, City of Grapevine, and others. He explained that the thrust of the plaintiff�s suit in the case was that the rules and regulations of the airport board were too general and not specific enough. He further commented that the resolution adopted by the Airport Board and used as an exhibit in our proposed ordinance, set out that if a group qualified as a charitable organization, then they would be allowed to apply for a permit. He also explained that the time, location, manner and number of persons involved was specifically stated. The City Attorney stated that this would not represent a conflict of the City of Grapevine's authority or governmental ability. He pointed out that it would govern those who, in addition to soliciting funds within the City of Grapevine, desired to specifically solicit funds at D�RW Airport within the City of Grapevine would, in addition, have to follow the terms of the rules and regulations of D�RW Airport. The City Attorney then stated that it was h�.s recommendation that the Council approve the proposed ordinance. There was little discussion. Councilman Dunn made a motion � to adopt the proposed ordinance. The next order of business was for the City Council to consider the recommendation of the Planning & Zoning Commission regarding Zoning Application Z76-23. The Assistant City Manager, Jim Hancock reported that the Planning & Zoning Commission unanimous- ly recommended approval of the requested zoning. The City Secretary read the caption of the proposed ordinance. Council- man Pirkle made a motion to accept the recommendation of the � Planning & Zoning Commission and grant the zoning request as stated in the proposed ordinance. The motion was seconded by Councilman Florence and prevailed by the following vote: Ayes: Tate, Gideon, Florence, Oliver, Dalton, Dunn & Pirkle Nays: None ORDINANCE NO. 7'7-5 AN ORDINANCE AMENDING ORDINANCE NO. 70-10, THE COMPREHEN- SIVE ZONING ORDINANCE OF THE CITY OF GRAPEVINE, TEXAS, SAME BEING ALSO KNOWN AS TITLE 10 OF THE CITY CADE OF GRAPEVINE, TEXAS GRANTING A ZANING CHANGE ON A TRACT OF LAND DESCRIBED AS BEING A LOT, TRACT OR PARCEL OF L„l�ND LYING AND BEING SITUATED IN TARRANT COUNTY, TEXAS, BEING A PART OR THE T.
