HomeMy WebLinkAboutRES 1986-014 CITY OF GFi,APEVINE, TEXAS RESOLUTION NO. 86-14 A RESULUTION DETERMINING THE NECESSITY OF FcE�UIIi.ING FEE SIMPLE TITLE TO THE HEFEINAFTEt�?, DESCRIBED LAND, AND AtiTH- ORI'LING ITS CONDEMNATION AND/OR APPROPRIA'I'ION TU BE USED IN CONNECTION WITH THE WIDENING, EXTENDING AND IMPROVING OF COLLEGE AND BALL STREETS, CITY STKEETS IN THE CITY OF GRAPEVINE, TEXAS. BE IT RESOLVED by the City Council of Grapevine, Texas: ��_ Section 1. That it is hereby determined that the public necessity requires the widening, extending and improving of public streets in the City oi' Grapevine, Texas. Said project to be hereinafter knawn as the "Ball anci College `' Streets Wiciening and Extension", and that the City oi Grapevine shaula acquire fee simple title to the larid necessary for said project. Section 2. That the hereinafter describeci property is hereby determined to be necessary for the widening, extension and improvement of Ball and College Streets. That for the purpose of acquiring title to said property, the city engineer, or such employee as he may designate is hereby authorizea and directed to offer the sum of Fifty-Seven Thousand Eight Hundreci Doilars ($57,800) for the hereinafter described property as payment for the owner's property appropriated and full ciamages allawable by law, which amount � represents the cash market value. Section 3. That the City of Grapevine, Texas determines to appropriate fee simple title to said property for the purpose of widening, extenaing anci improving Ball and College Streets under the laws of eminent domain and the general laws of the State of Texas. Section 4. 'That the owners or parties claiming an interest in said property and the Iegal description thereof, are as follows: Uwner, Estate ot Mary Louise Chastant. � The property is described as shown on the Exhibit "A" attached hereto. ' Section 5. If the City's officiai offer to purchase the land �`"`" hereinabove described is refused, which sam of money is oifered by the Lity of . Grapeviiie, Texas, as compensation for the takirig of the subject iand from saici owners under the laws of eminent domain, this amount of money the Gity Council of Grapevine, Texas, deems to be fair market value and just ar�d adequate compensation due to the hereinabove referenceci owners. If the owr�ers do not accept the offer oi fair market vaiue as evidencea in this Kesolution, the City Attorney is authorizeci ana requested to file the necessary suits and to take the necessary action f'or the prompt acquisition of saia property in compli€�nce with the condemnation laws oi the State of 'I'exas. Seetion 6. In the event it is oeterminec; that adc�itionai persons other than those namec� herein have an interest in saici property, then the City Attorney is authorized and directed to join said parties as defer�ciants in said condemnation suit. Section i. That this resolution shall take effect immediateiy �nd upon its passage.
