CITY OF GRAPEVINE, TEXAS
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
GRAPEVINE AUTHORIZING THE SETTLEMENT OF CERTAIN
LITIGATION; AUTHORIZING THE PAYMENT OF $19,000.00;

DECLARING THE EMERGENCY
,��� WHEREAS, the City of Grapevine, Texas is involved in a civil suit styled
No. 48-83600-84 Amber Pipeline Company, Plaintiff vs. The City of Grapevine,
Apac-Texas, Inc. and Wright Construction Company, Defendants In the District
Court of Tarrant County, Texas 48th Judicial District; and
WHEREAS, the City Council is desirous of settling all the disputes and
claims that may exist between the parties; and
WHEREAS, the City Council of the City of Grapevine deems the settling
of all claims as contained in the lawsuit above styled to best serve the public
interest; and
WHEREAS, to continue litigation of the claims and causes of action as set
forth by the parties to the above styled suit will jeopardize the street
improvement project:
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of
Grapevine:
Section 1. That the City Manager is hereby empowered to settle all
claims and causes of action that either party may have in the suit styled above.
`� f; Section 2. That the sum of $19,000.00 is hereby approved for the
payment to Amber Pipeline Company in consideration of the execution of the
�:,,.,, Settlement Agreement between the parties and in consideration for the costs of
relocation of Amber Pipeline Company's lines under Timberline Drive and the
abandonment of any and all easements that Amber Pipeline Company may have
over, under and through Timberline Drive.
Section 3. In order to safeguard the health, safety, morals, peace and
general welfare of the inhabitants of the City of Grapevine, Texas, and for the
immediate preservation of public business, property, health, safety, and general
welfare of the public this Resolution shall become effective from and after the
date of its passage and it is accordingly so resolved.
