A RESOLUTION OF THE CITY OF GRAPEVINE, TEXAS FINDING
THT A PUBLIC NEED AND NECESSITY EXISTS FOR THE CITY
TO ACQUIRE A TEMPORARY DRAINAGE EASEMENT AS
HEREINAFTER DESCRIBED; RATIFYING AND CONFIRMING AN
OFFER MADE TO ACQUIRE THE DRAINAGE EASEMENT;
AUTHORIZING THE CITY ATTORNEY TO INITIATE CONDEM-
NATION PROCEEDINGS; PROVIDING AN EFFECTNE DATE.
� WHEREAS, the City of Grapevine, Texas (the "City"), as a Home Rule
City, has the power and authority to appropriate private property for public
r�:.K purposes whenever the City Council shall deem it necessary pursuant to Tex.
Rev. Civ. Stat. Ann. art. 1175(15) (Vernon 1963); and
WHEREAS, the City Council has determined and found that a public need
and necessity exists for the City to acquire a temporary drainage easement as
described in Exhibit "A," which Exhibit is attached hereto and incorporated
herein for all purposes;
WHEREAS, the City has, by letter dated December 26, 1984, and as
authorized by the City Council, made a written offer to Mr. Ellsworth D. Sallee,
owner of the land on and across which the temporary drainage easement will be
situated, to purchase said easement for $6,800.00; and
WHEREAS, said offer to purchase was not accepted by Mr. Sallee by
January 14, 1985, being the final date on which the offer to purchase was open,
with such failure to accept constituting a rejection of the offer; and
WHEREAS, the City Council desires to confirm and ratify the offer to
purchase the temporary drainage easement made to Mr. Sallee.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF GRAPEVINE, TEXAS:
Section 1. That the above and foregoing preamble is incorporated
�,.,� herein as if copied herein in its entirety.
Section 2. That a public need and necessity exists for the City to
acquire a temporary drainage easement on and across land owned by Mr.
Ellsworth D. Sallee located in the Northeast quadrant of Glade Road and Euless
- Grapevine Road and more particularly described in the attached Exhibit "A.,'
Section 3. That the City Council hereby confirms and ratifies the
written offer made to Mr. Sallee on December 26, 1984, which offer was open
until January 14, 1984, and which offer was rejected by Mr. Sallee by his failure
to respond to said offer on or before January 14, 1985.
Section 4. That the City Attorney is authorized and directed to initiate
condemnation proceedings to acquire the temporary drainage easement as
described in Exhibit "A."
PASSED AND APPROVED by the City Council of the City of Grapevine,
Texas on this the 16 th day of April, 1985.
