HomeMy WebLinkAboutRES 1983-050 RESOLUTION NO. 83-50 RESOLUTION APPROVING AN EXCEPTION TO THE MORA- TORIUM RESOLUTION OI' THE CITY OF GRAPEVINE, TEXAS, SAME BEING RESOLUTION NO. 83-34 WHEREAS, the City Council passed Resolution No. 83-34 on the 6th day � of September, 1983 and amended same by the passage of Resolution No. 83-40 on September 20, 1.983 (Moratorium Resolutions), which resolutions imposed a moratorium on the issuance of Building Permits and the processing of new zoning cases in certain defined areas of the City for a stated period of time to permit � and allow consideration of the adoption of a Zoning Map for the entire City pursuant to Ordinance No. 82-73 and the Grapevine Comprehensive Master Plan, 1974-1994, Update 1980; and WHEREAS, the Moratorium Resolutions authorize the granting of Ex- ceptions after Public Notice, a Public Hearing, and upor. the City Council making certain findings. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF GRAPEVINE, TEXAS: Section 1. The City Council does hereby find that all notice and procedural requirements required by the Moratorium Resolutions have been duly complied with, including the holding of a Public Hearing, relative to the application filed by Lanny M. Tate of 402 B.E.N.W. Highway, Grapevine, Texas, which application (Subject Application) was heard by the City Council on the 20th day of December, 1983. Section 2. The City Council further finds, based upon evidence presented to it, that deferral of action as to desired building permits as hereinafter enumerated for the duration of the moratorium, as imposed by the �" Moratorium Resolutions, would impose an extraordinary hardship on the applicant. '� Section 3. The City Council makes the following findings of fact: A) Subject Property was zoned R-2 (Duplex) by the passage of 7rdinance No. 79-27; B) A final plat conforming to R-1 Single-Family Detached standards was approved in three phases on June 5, 1979 (phase 1), February 19, 1980 (phase 2) and February 16, 1982 (phase 3) as the Parra Linda Addition, a Single-Family subdivision; C) Since the initial approval of phase 1 in 1979, 182 permits for Sin�le-Family Detached structures have been issued in the Parra Linda Subdivison; D) The Moratorium Resolution applies to the Parra Linda Estates due to the property being zoned R-2 Duplex, which is medium density zoning, and the Ailaster Plans Future Land Use Map Reflecting Low Density Zoning; E) The owner has filed an application to re-zone Subject Property R-7-5 (which is low density zoning) under Zoning Ordinance No. "� ' , 82-73, same being Case No. Z84-Ol which zoning case will be heard by the Planning and Zoning Commission and City Council on January 17, 19�3; �,� F) Applicant has filed a request to have the moratorium lifted as to the balance of the undeveloped lots in the Parra Linda Subdivision to enable him to obtain Building Permits for Single-Family Detached dwellings in accordance with R.-1 requirements on the following lots: Lots 1-11, Block 9 Lots 1-6, Block 8 This request is to lift the moratorium only and solely for the purpose of obtaining Building Permits for Single-Family Detached dwellings as noted above. Section 4. Based on the above, the City Council does hereby grant Laa-uzy M.
