HomeMy WebLinkAboutRES 1981-023 RESOLUTION NO. 81-23 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF GRAPEVINE, TEXAS, SETTING THE TERMS OF AN AGREEMENT BETWEEN THE CITIES OF COPPELL AND GRAPEVINE FOR MUTUAL ASSISTANCE IN THE PROVISION OF �„,,,� UTILITY SERVICES TO A DEFINED AREA WHEREAS, it has been found that a portion of the cor- "'�" porate limits between the Cities of Coppell and Grapevine lies along the Dallas and Tarrant County boundary line, and no physical delineation exists along such portion of said corporate limits; and, WHEREAS, it has been found that the natural gravity flow of sewage collection service within such surrounding area is eastward into the City of Coppell; and, WHEREAS, it has been found that a sanitary sewer collection line of sufficient capacity to serve a portion of the City of Grapevine presently exists within the City of Coppell within approximately 600 feet of said corporate limit; and, WHEREAS, it has been found that the adequate provision of sanitary sewage collection service tc such area by the City of Grapevine would not be economically feasible at this time based on the need generated by the amount of devel- opment within such area; and, �-x WHEREAS, it has been found that the City of Grapevine has water distribution facilities existing within the immed- iate area with sufficient capacity to serve a portion of the �°'� City of Coppell; and, WHEREAS, it has been found that the City of Coppell has neither water distribution or water storage facilities within approximately 7, 200 feet of said corporate limits; and, WHEREAS, it has been found that the adequate provision of water distribution service to such area by the City of Coppell would not be economically feasible at this time based on the need generated by the amount of development within such area; and, WHEREAS, it has been found that development has been pro- posed for the immediate future within such area, said develop- ments lying within both the Cities of Coppell and Grapevine; and, WHEREAS, it has been found that it would be to the mutual benefit of both Cities to agree to mutual assistance in the provision of utility services to such area. ��� NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF GRAPEVINE, TEXAS: �� Section 1. It is agreed that the City of Coppell will provide, or will cause or allow to be provided, sanitary sew- age collection service to that area of approximately 723 acres within the City of Grapevine as indicated on Exhibit "A" , attached and made a part hereto. Said service initially com- prising approximately 500 acres. The City of Grapevine will pay initially $400. 00 per acre pro-rata tie-in charges for this initial service area. It is agreed and understood that any pro-rata fees collected by the City of Coppell for sewer service in Grapevine will be credited to the initial payment by the City of Grapevine. Both the City of Grapevine and the City of Coppell recognize that the possibilities of par- allel sewage collection facilities might be necessary as the drainage basin approaches full development and will make �..,, every effort to accommodate these excess flows with each City responsible for its proportionate share of the capital expenditure based upon the percentage of each City' s contri- bution to total flow, should it become necessary at some ""�`' f uture date. Section 2. It is agreed that the City of Grapevine will provide, or will cause or allow to be provided, water distri- bution service to that area of approximately 73 acres within the City of Coppell as indicated on Exhibit "A" , attached and made a part hereto. It is further mutually agreed to and understood that the City of Coppell fully intends to extend its water distribution system to this area within the next 10 years. The City of Grapevine will maintain service to this area in the City of Coppell, but will make no long-term commitments for capital improvements to maintain this service permanently. Section 3. It is agreed that the Cities will develop a method for the exchange of information necessary for adequate accounting and billing of water and sanitary sewer services for the respective areas, such method to be acceptable and agreeable to the City Councils of both Cities. Section 4. It is agreed that the Cities will provide for � an emergency interconnect between the water distribution systems of the Cities, such interconnect to be provided at some later date in a time, place, and manner acceptable and agreeable to both Cities. Section 5. It is agreed that the Cities by passage of the resolution agree to enter into a contract encompassing all of the provisions of this resolution relating to the furnishing of sanitary sewer collection service by the City of Coppell and the furnishing of water service by the City of Grapevine; which contract shall encompass all necessary terms relating to length of service, payment of consideration, pro-rata and direct cus- tomer billing charges, and all pertinent details. The contract shall be executed prior to either party making any substantial capital expenditure in reliance on this outline of agreement. Section 6. This agreement shall become effective as of the date of its passage, except that it shall not become effec- tive unless and until the passage of a Resolution by the City Council of the City of Coppell, Texas, agreeing to the identi- cal terms of this Resolution.
