ORDINANCE NO. 79-46
AN ORDINANCE OF THE CITY OF GRAPEVINE , TEXAS ,
REGULATING THE SPEED OF VEHICLES WITHIN THE
CITY; SPECIFYING THE REASONABLE AND PRUDENT
SPEED FOR PUBLIC STREETS AND ALLEYS WITHIN
THE CITY; AUTHORIZING THE ERECTION OF TRAFFIC
REGULATION SIGNS ; REPEALING CONFLICTING
ORDINANCES ; PROVIDING FOR A PENALTY OF FINE
NOT TO EXCEED TWO HUNDRED ($200. 00) DOLLARS
FOR EACH OFFENSE; PROVIDING A SEVERABILITY
CLAUSE; AND DECLARING AN EMERGENCY.
NOW, THEREFORE , BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF GRAPEVINE , TEXAS :
Section 1. Speed Limits on Certain Public Streets .
Upon the basis of an engineering and traffic investigation here-
tofore made as authorized by the provisions of Section 169 , V.T .C . S . ,
6701d, Uniform Act Regulating Traffic on Highways , the following
prima facie speed limits hereafter indicated for vehicles are hereby
determined and declared to be reasonable and safe; and such speed
limits are hereby fixed at the rate of speed indicated for vehicles
traveling upon the named public streets and highways , or parts thereof,
of the City, said speed limit to be in force and effect unless other-
wise limited as prescribed by the provisions of this ordinance. The
streets and highways hereby regulated, and the maximum prima facie
speed limits thereof, are as follows :
Streets and Location Speed Limit
Beginning at the Intersection of Mustang 20 M.P .H.
Drive and Timberline Drive and ending 170' School Days
East of Creekwood Drive West with signs 7 :00-9 :00 A.M.
posted at beginning for Southbound traffic 2 :00-4: 00 P .M.
and at the end for North and Westbound traffic.
Section 2 .
That the City Manager or his agent , is hereby authorized to
have speed limit signs erected, constructed and placed at such
points along said highways , streets , or alleys or portions thereof
under construction, maintenance or repair so that travelers will
be reasonably notified of said speed.
Section 3 .
That all ordinances or any parts thereof in conflict with the
terms of this ordinance shall be and hereby are deemed repealed and of
no force or effect provided, however, that the ordinances under which
the cases currently filed and pending in the Municipal Court of the
City of Grapevine, Texas , shall be deemed repealed only when all such
cases filed and pending under such ordinance or ordinances have been
disposed of by a final conviction or a finding not guilty of nolo
contendere, or dismissal .
Section 4.
Any person, firm or corporation violating any of the provisions
of this ordinance shall be deemed guilty of a misdemeanor, and upon
conviction in the Municipal Court , shall be fined in an amount not
to exceed the sum of Two Hundred Dollars ($200. 00) for each offense.
Section 5.
If any section, paragraph, subdivision, clause , phrase or
provisions of this ordinance shall be judged invalid or unconstitutional
the same shall not affect the validity of this ordinance as a whole or
any portion thereof other than that portion so decided to be invalid or
unconstitutional.
Section 6 .
The fact that the traffic regulations of the City of Grapevine do
not adequately regulate the traffic within the City creates an urgency
and an emergency and the preservation of the public health, safety and
welfare requires that this ordinance shall take effect immediately from
and after its passage and the publication of the caption of said
ordinance as the law and the City Charter in such cases provides .
DULY PASSED by the City Council of the City of Grapevine, Texas ,
on this the 4th day of September , 1979 .
