ORDINANCE NO. 79-47
AN ORDINANCE OF THE CITY OF GRAPEVINE , TEXAS ,
PROHIBITING THE ISSUANCE OF PERMITS FOR DRIVEWAYS
OR THE CONSTRUCTION OF DRIVEWAYS WITHIN CERTAIN
SPECIFIED LOTS LOCATED IN THE PLOT OF PARK PLACE ,
PHASE III CONTIGUOUS TO PARK BOULEVARD; PROVIDING
A SEVERABILITY CLAUSE , PROVIDING A PENALTY AND
DECLARING AN EMERGENCY.
uma WHEREAS , due to substantial traffic on Park Boulevard it is the
finding of the City Council that the safety of the traveling public
calls for the elimination of driveway construction along the rear of
certain specified lots located in Park Place , Phase III Subdivision
which lots rear lot lines are contiguous to Park Boulevard, and
WHEREAS , all of said lots have access to the public street
system on the front of their lots ;
NOW, THEREFORE , BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF GRAPEVINE , TEXAS :
Section 1. No building permits shall be issued to construct
driveways and curb cuts contiguous to Park Boulevard on the following
described lots :
LOTS 40 ,41,42 and 52 of BLOCK 6
LOT 7 of BLOCK 7
Section 2 . It shall be unlawful to construct a driveway and/or
curb cut on the lots described in Section 1 contiguous to Park Boulevard.
Section 3. Severability. If any section, article , paragraph,
sentence , clause , phrase or word in this ordinance , or application
thereto to any person or circumstances is held invalid or unconstitutional
by a Court of competent jurisdiction, such holding shall not affect the
validity of the remaining portions of the ordinance and the City Council
hereby declares it would have passed such remaining portions of the
ordinance despite such invalidity, which remaining portions shall
remain in full force and effect.
Section 4. Penalty. Any person violating any of the provisions
of this Ordinance shall be deemed guilty of a misdemeanor and subject
to a fine not to exceed Two Hundred Dollars ($200. 00) for each offense
and each and every day any such violation shall exist or continue
shall constitute a separate offense.
Section 5 . Emergency. The fact that no present ordinances of
the City of Grapevine exist which prohibit the issuance of permits for
driveways or the construction of driveways within certain specified
lots located in the plot of Park Place, Phase III , contiguous to
Park Boulevard creates an urgency and an emergency and in the preserva-
tion of the public health, safety and welfare requires that this
Ordinance shall take effect immediately from and after its passage
and the publication of the caption as the law and charter in such
cases provides .
DULY PASSED by the City Council of the City of Grapevine ,
Texas , this 4th day of September , 1979 .
