ORDINANCE NO. 79-49
AN ORDINANCE CLOSING, ABANDONING , AND VACATING A
PORTION OF BROOKSIDE DRIVE IN THE CITY OF GRAPEVINE ,
TEXAS , AS HEREINAFTER DESCRIBED; PROVIDING A SEVERABILITY
CLAUSE; AND DECLARING AN EMERGENCY.
WHEREAS , the owner of property abutting a portion of Brookside
Drive in the City of Grapevine , Texas has requested the right-of-way
of a portion of Brookside Drive , as hereinafter described, be closed,
abandoned and vacated; and
WHEREAS , the right-of-way of said street as hereinafter described
is not now needed for public street and will not be needed in the
future for a public street; and
WHEREAS , the closing, abandoning and vacating the right-of-way
of said street will relieve the City of Grapevine , Texas , from the
cost and expense of maintaining said property;
NOW, THEREFORE , BE IT ORDAINED BY THE CITY COUNCIL OF
THE CITY OF GRAPEVINE , TEXAS;
Section 1. That the portion of right-of-way of Brookside
Drive, more particularly described as follows :
Property Description for a parcel of land dedicated as Street Right
of Way in the T. Mahan Survey, Abstract No. 1050 , in Grapevine ,
Tarrant County, Texas , being only that part of the Brookside Drive
Right-Of-Way that exceeds 50 ' at the intersection with Park Blvd. and
described as follows :
Beginning at a point in the East Right-Of-Way line of Park Blvd. which
is the intersection of the North Right-Of-Way line of Brookside Drive
and the Northwest corner of said part.
Thence S89016 'E 311. 0 ' to a point in the West boundry of Lot 37 ,
Block 1, Brookside Addition.
Thence S01018 'W 10. 0 ' along said boundry to an iron rod for corner
in the Brookside Dr 50 ' Right-Of-Way.
Thence N89016 'W 315 . 0 ' to an iron rod set for corner.
Thence N00036 'E 10. 0 ' along the projected East Right-Of-Way line
of Park Blvd. to the point of beginning.
Therefore leaving a continuous 50 ' Right-Of-Way for Brookside Drive ,
improved with a 31 ' street , from Park Blvd. to Northwest Highway.
and the same is hereby closed, abandoned and vacated for public use ,
and the same is hereby closed, abandoned and vacated insofar as all
public right , title and interest in and to said described portion of
said Right-Of-Way is concerned.
Section 2. That the Mayor, be, and is hereby authorized to
execute a Quit-Claim Deed to convey the heretofore described property
to the owner of the property abutting said ROW, who officially
declared by affidavit that he is the rightful fee owner of the
right-of-way vacated and abandoned by this ordinance.
Section 3 . That the terms and provisions of this ordinance
shall be deemed to be severable and that if the validity of any
section, subsection, word, sentence or phrase shall be held to be
invalid, it shall not affect the remaining part of this. ordinance.

Section 4. The fact that the said portion of right-of-way
of Brookside Drive is no longer needed by the public for public
usage or traveling and would create a hardship or burden upon
the City of Grapevine to keep open and maintain such street
creates an urgency and an emergency for the immediate preservation
of the public health, safety and general welfare which requires
that this ordinance shall take effect immediately from and after
its passage and it is accordingly so ordained.
PASSED AND APPROVED BY THE CITY COUNCIL OF THE CITY OF GRAPEVINE ,
TEXAS , THIS THE 4th day of September , 1979 .
