HomeMy WebLinkAboutORD 1979-030 ORDINANCE NO. 79-30 AN ORDINANCE AMENDING "THE CODE OF ORDINANCES, CITY OF GRAPEVINE, TEXAS, " BY AMENDING CHAPTER 18 , ART. 1, SECTION 18-19 (C) BY CHANGING THE MANDATORY RETIREMENT AGE FROM SIXTY-FIVE (65) TO SEVENTY (70) IN ORDER TO COMPLY WITH 29 USC 621 AGE DISCRIMINATION IN EMPLOYMENT ACT OF 1967 ; AND DECLARING AN EMERGENCY. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF GRAPEVINE, TEXAS : 46.0 Section 1 . That Chapter 18, Art . 1 , Section 18-19 (C) of the Code of Ordinances , City of Grapevine, Texas , is hereby amended to read as follows : "Chapter 18, Art . 1, Sec . 18-19 (C) Retirement Age: All employees of the city will be automatically retired from service upon attaining the age of seventy (70) years , with the exception, that on request from an employee, two (2) one-year extensions may be granted for one (1) year at a time under the following conditions : (1) An individual request from the employee for a one (1) year extension, submitted through and approved by the department head, personnel office, city manager, and city council . It is mandatory that each required official must approve in the affirmative or the application will be rejected and the employee automatically placed on retirement. (2) Each application must be accompanied by a state- -4, ment of physical fitness from a medical doctor and the physician used must have prior approval by the city manager . The examination will be at the expense of the employee making the re- quest . The city manager, at his option, may request additional physical examinations at six (6) month intervals but in all instances an employee must have an annual examination. (3) If after obtaining the age of sixty-seven (67) years , an employee needs additional calendar quarters to improve his social security retire- ment , he may, with the approval of the depart- ment head, personnel office, and city manager , work to and through the ensuing December thirty- first of the year in which the age of sixty- seven (67) years is reached. Section 2 . Emergency. The fact that the present ordinances of the City of Grapevine do not comply with 29 U. S . C . 621, Age Discrimination in Employment Act of 1967 , creates an urgency and an emergency and in the preservation of the public health, safety and welfare requires that this ordinance shall take effect immediately from and after its passage and the publication of the caption as the law and charter in such cases provides .
