The Invocation was given by Councilman Dalton. Councilman Eizison moved to approve the minutes of the previous meeting as presented by the City Secretary. Councilman Dalton seconded the motion. The motion prevailed by the following vote: � Ayes: Tate, Dalton, Eidson, Parker, Conine, Pittard Noes: None � The resignation of Millard J. Dilg from the Parks and Recreation Commission, effective May 9, 1973, contingent upon his election to the City Council, was considered. � Mayor Tate stated Mr. Dilg was elected to the Council, according to the election returns. Councilman Eidson moved to accept the resignation of Millard Dilg from the Parks and Recreation Commission, effective May 9, 1973. Councilman Parker seconded the motion. The motion prevailed by the following vote: Ayes: Tate, Dalton, Eidson , Parker, Conine, Pittard Noes: None The City Manager presented the election returns of the May 12, 1973, Council Place 6 runoff election as follows: Millard J. Dilg. . 189 Lee Thompson. . . . . 170 Council members verified the results by examining the election returns, as stated in Resolution 73-10. Councilman Eidson moved to certify the election results and declare the count correct as submitted. Councilman Parker seconded the motion. He stated the emergency clause dispenses with � i the reading and passage of ordinances at two Council meetings, enabling the ordinances to become effective after first reading and passage. Ordinance 73-20 was introduced for consideration on an emergency basis. The City Manager briefed the Council on the zoning change requests of Ordinances: 73-20, 73-21 , and 73-22, due to all requests being contiguous and being requested by the same person. Councilman Eidson asked if the streets and fire lanes could be corrected when building permits are requested. The City Attorney stated a plat would be required prior to any building permits being issued, and at that time, the Council could obtain any necessary right-of-way, easements, and/or street alignment. The Assistant City Manager read the caption of Ordinance 73-20. Councilman Parker moved to accept the Plannimg and Zoning Commission's recommendation and adopt Ordinance 73-20 on an emergency basis. Councilman Eidson seconded the motion. The City Manager stated it establishes minimum ; right-of-way for streets of residential, multi-family, � commercial, retail, and industrial districts, which is ! the same guiSelines the city is following in the campre= hensive plan. It requires at the time of zoning, streets ! and easements be included as required, before building � permits will be issued. � The City Attorney stated the ordinance will apply to all � prope�tty in the city, whereby when anyone applies for a � building permit or certificate of occupancy, their property must conform to this ordinance' s requirements and to the thoroughfare plar. before such will be issued. He stated the Council will have to adopt a thoroughfare plan, desig- nating the minimum right-of-way from the centerline to the front property line, and whether the streets are minor, secondary, or major. The city can also require right-of- ' way for drainage, water, sewerage, and utilities as the City Manager �iball determine to be reasonable and necessary to facilitate adequate provisions for water, sewerage, drainage, and utilities, as a part of prdinance 73-24. The City Attorney stated Ordinance 73-24 cannot be utilized until a thoroughfare plan is adopted by the Council, but due to state statute, an ordinance like Ordinance 73-24 m�5t be adopted prior to the thorough�are plan. Councilman Eidson asked what affect this ordinance will have on a non-dedicated subdivision. The City Atto�ney stated when the owner of the subdivision applies for building permits, a plat can be required giving the proper stree�t right-of-way and easements. He stated in the case of an individual who has purchased a lot, the city will have to ask that individual to dedicate the street and give the necessary easements on their lot. Mayor Tate asked the City Manager to make a study on the subdivisions that are under the above stated classification. The City Manager read the caption. He stated that areas in the city requiring street � lights, as recommended by the police department, were � installed if no objections were made by the adjacent � residents. � r � Councilman Dilg asked if a party in the audience could � � address the Council.
