Tate Mayor ; Ooil Dalton Councilman Tommy Eidson Councilman Phil Parker Councilman Thelma Conine Councilwoman C. D. Pittard Councilman Millard Dilg Councilman constituting a quorum, and Ted Ware Chairman Harlen Joyce Member Joe Kennedy Member Don Stiles Member Jerry Jordan Member constituting a quorum, with Corbett Emery absent, and Mayor Tate called the meeting to order. TI-ie Invocation was given by Ted Ware, ;'t Mayor Tate opened the public hearing on zoning application [Z-73-31 � , Harris E. French requesting a zoning change �rom "R-1" to "SP" Specific Use Permit District - commercial and business uses/with the sale of alcoholic beverages for off- premise consumption on Tract 1-E, Joel L. Hallum Survey [2615 Dove Loop Road North]. Harris E. French spoke on behalf of the zoning application. He stated he planned to sell picnic and fisf-iing supplies along with beer. A letter from Steve Windsor , City Building Official , was brought to the attention o� the Commission and Council , which stated the following: October 23, 1973 T0 : MAYOR, CITY COUNCIL, ANO PLANNING � ZONING COMMISSION FRDM: STEVE WINDSOR, BUIL�ING OFFICIAL SUBJECT: ZONING APP�ICATION [Z-73-31 � , Harris E. French requesting Speci�ic Use Permit District - commercial and business uses/with the sale o� alcoholic beverages for off- premise consumption . at 2615 Dove Loop Road. � s ' This is to certiPy that an inspection was made of the building � located at 2615 Dove Loop Road. The electrical system was found to require reworking in order to meet the city code, and as of this date, no permit has been issued for this rework. � 5 Steve Windsor � Building O�ficial � =�0�k �. Mr. French stated he was aware of the prob.l�m, but did not want to correct it until he received the Specific Use Permit District zoning, since he was not the owner of tl-ie property. � � � With no further discussion on zoning application [Z-73-31 ) , Mayor Tate closed the public hearing. i Mayor Tate opened the public hearing on zoning application [Z-73-14], Love-Henry � Associates requesting a zoning change �rom "Fi-1" to "PD" Planned Development District on a tract of land in the Thomas Mahan Survey, Abstract No. 1050, [West Northwest Highway Business at Park Blvd. ] . Mayor Tate stated the City Council and Planning � Zoning Commission has held a previous public hearing on this zoning application, and are going to great lengths in trying to find tl-ie facts of this application and make a decision which is fair to all parties. He stated he understands it is an import- ant decision to a lot of people. He stated a great deal o� information has been heard, and asked that the presentations for and against the zoning application be well organized, with brief summaries of the information already presented, and hopefully, that there will be additional information presented. Councilman Eidson stated he had publicly and officially dis- quali�ied himself �rom participating in zoning application [Z-73-14) , due to prior involvement in the property. He asked Mayor Tate for permission to leave ti-�e Council Chambers during this zoning application. Mayor Tate granted Councilman Eidson's request. A1 Taf elski , planning consultant, spoke on behal�' of the zoning application. He gave a slide presentation of the proposed planned development. He brief ed the Council and Commission on the original site plan for the tract, and a revised site � plan with the comments from the adjacent property owners taken �'` � � into consideration. ; Mr. Taf elski stated he has shi�ted tl-ie majority of the commercial structures toward the corner of Park Blvd. and W . Northwest High- way Business. He stated tl-�ere would be a [10) foot I-�igh earth and masonary screening f ence along the East property line. He ' stated that Inwood Road would not become a through street due to townhouses would line the Eastern section of the tract. Mr. Ta�elski stated the Northern [20] acres of the tract would consist o� [314) apartment units, [43] townhouses, witl-i a total density o� [18. 44] units per acre. He stated th� tract would be developed in three phases as �ollows : PHASE I : 98 - apartment units - to begin within [36] months 13 - townhouses oP zoning approval . 175 - parking spaces IPHASE II : 10� apartment units - to begin within [12� months �i 12 - townhouses a�ter start of Phase I. 174 - parking spaces PHASE III : 112 - apartment units - to begin within [12) months 18 - townl-iouses a�ter start of Phase II. 169 - parking spaces Mr. Taf elski stated the shopping center would begin as soon as the market warrants its construction. He stated the cost o� tt-ie residential section would be eight million dollars and tl-ie shop- ping center three and one-half million dollars. Andrew Vogel , attorney, representing a group of persons opposing the zoning application, spoke on their bel-�a1P. Mayor Tate stated Mr. Vogel had stated in a previous conversation that other Council members should disqualify themselves. Mayor Tate asked Mr. Vogel to allow those Council members to participate in tl-ie public hearing, and at the time the Council considers the zoning application for adoption, he could state reasons as to why ott-ier Council members should disquali�y themselves. Mr. Vogel agreed to Mayor Tate's request. I 1 �1 � � Mr. Vogel stated he represents [100% ] of the people in the Manor Oaks Addition with the excep tion of Councilman Phil Parker and Orville Brown. He stated he has filed a protest , petition signed by the owners o� more than [20%] of the land area witl-iin [200] �eet of the area in zoning question. Mr. Vogel introduced Floyd Oeacon to make a presentation. Mr. Deacon brief ed the Council and Commission on their major objections to tl-ie zoning application. He stated the proposed development would devalue the property of Manor Oaks Addition. � He stated previous city master plans have shown this area to � be residential , not multi-�amily and commercial. Mr. Deacon presented Council and Commission members with a written statement concerning the practice o� buying land with the intention o� having it rezoned for exorbitant pro�it. � Mr. Vogel introduced Tom McAf erty to make a presentation. Mr. McA�erty gave a slide presentation of the area in question, the Manor Oaks Addition and residential subdivisions in Dallas built along major thoroughf ares. Mr. Vogel summarized his clients objections to the zoning application as follows : 1 . Public interest is not best served by changing current residential zoning 2. The developer's proposed planned development package is not su�ficiently developed 3. Environmental and pollution considerations 4. Land values in the Manor Oaks Subdivision will be depressed 5. The thirty-six acre tract in question is highly suitable to residential development and the developer would not be financially restricted by residential development With no f urther discussion on zoning application [Z-73-14) , Mayor Tate closed the public hearing. - There being no f urtl-ier business, Mayor Tate adjourned the meeting. Pittard Councilman Millard Dilg Councilman constituting a quorum, and Floy Ezell City Manager Jim Hancock Assistant City Manager and [Acting City Secretary) Mayor Tate called the meeting to order. Bob Nichols, City Engineer, brie�ed the Council on obtaining additional water supply from the Dallas/Fort Worth Airport. Councilman Dalton moved to authorize the City Manager and City Engineer to proceed in negotiating with the Dallas/Fort Worth Airport �or additional water supply. Councilwoman Conine seconded the motion. The motion prevailed by the follouving vote : Ayes : Tate, Dalton, Eidson, Parker , Conine, Pittard, Dilg Noes : None There being no �urther business, Mayor Tate adjourned the meeting.
