[Z-73-35) , Billy Underwood requesting a "Revised Planned Development" on a tract o� land in the Joel Hallum Survey. [Dove Road at Dove Loop Road) . B. [Z-73-36) , Billy Underwood requesting an extension o� a Specific Use Permit - Concrete Batch Plant, on a tract o� land in the Esther Moore Survey. [Located on E. Northwest Highway; South of Wickes ' Lumber Company) [Ordinance No . 72-39, adopted December 5, 1972, granted the Specific Use Permit for a period of one-year, at which time an extension may be requested] . C. An ordinance regulating and governing the operation of a massage establishment and/or the per�orming of massage services within the Corporate Limits of the City of Grapevine, Texas; providing definitions ; providing for such uses to be permitted only on property zoned within the City Code of Grapevine, Texas, Title 10, Chapter 12, same being the "SP" Specific Use Permit District; providing a penalty; providing a severability clause; and declaring an emergency. Pittard Councilman P1 . #3 Thelma Conine Councilwoman P1 . #5 Millard Dilg Councilman P1. #6 constituting a quorum, with Phil Parker, Councilman Pl. #4, absent, and Ted Ware Chairman Harlen Joyce Member Joe Kennedy Member Corbett Emery Member constituting a quorum , with Don Stiles and Jerry Jordan , absent, and Mayor Tate called the meeting to order. The Invocation was given by Joe Kennedy. Mayor Tate opened the public hearing on zoning application [Z-73-35] , Billy Underwood requesting a zoning change on a tract of land in the Joel Hallum Survey, Abstract No . 722, from "PD" P�lanned Development District to [Revised) "PD" Planned Development District. Billy Underwood, Jr. , spoke on behalf of the zoning application. He stated the changes in the revised "PD" are as follows: [1 � higher density - [�rom [18-19] to [26. 5) units p er acre [2] street layout - [f'rom a straight to a curving street] [3] zoning district lines - [extended the Southern line of the "R-3" Multi-Family District into tFie "C-2" Community Business District) He stated under the original "PD" , it would not be financially feasible to build the apartment complex. He stated the revised "PD" needed to be considered before January 1 , 1974, whereas the present financial plans could be pursued. With no further discussion on zoning application [Z-73-35) , Councilman Pittard moved to close the public hearing. Council- man Dilg seconded the motion. The motion prevailed by the � following vote: Ayes : Tate, Dalton, Eidson, Pittard, Conine, Dilg Noes : None Absent: Parker Mayor Tate opened the public hearing on zoning application [Z-73-36] , Billy Underwood requesting an extension of a "SP" Specific Use Permit - concrete batch plant, on a tract of � 154 ��II � � land in the Ester Moore Survey. [Loop 382 at Hudgins St. ) � Chuck Messer spoke on behalf of the zoning application. � He stated the operation would only continue �or an additional � year, due to its location and the price of land making it � �inancially unfeasible. He stated ti-iey would like to obtain ano ther tract o� land in the Grapevine area in which to ! relocate. � Steve Windsor , City Building O��icial , stated a complaint ! had been filed regarding the condition o� the frame house , on the tract. Mr. Messer stated the "SP" zoning did not include the house, but would be glad to clean the area. With no �urther discussion on zoning application [Z-73-36� , i Councilman Eidson moved to close the public hearing. Council- ' man Dalton seconded the motion. The motion prevailed by the following vote: Ayes : Tate , Dalton, Eidson, Pittard, Conine, Dilg Noes: None , Absent: Parker ' I � � Mayor Tate opened the public hearing on a proposed ordinance i� amending Title 10, Chapter 12 0� the City Code, by providing I �or the operation of massage establishments and/or tf-ie per- ' forming of massage services to be permitted only on property zoned "SP" Speci�ic Use Permit District. The City Attorney brie�ed the City Council and Planning � Zoning Commission on the proposed ordinance. General discussion was held. Christie Gates spoke regarding the proposed ordinance. With no f urther discussion on the proposed ordinance, Council- � man Dalton moved to close the public hearing. Councilman Eidson seconded the motion. The Council considered zoning application [Z-73-35) , Billy Underwood requesting a zoning change on a tract o� land in the Joel Hallum Survey, Abstract No. 722, from "PO" Planned `° Development District to [Revised] "PD" Planned Development District. [Dove Road at Dove Loop Road) Mayor Tate stated the Planning � Zoning Commission recommended to deny the zoning application, due to the proposed density being to high for the area. Discussion was held regarding the proposed density of the multi-�amily area. Councilman Pittard moved not to accept the Planning � Zoning Commission's recommendation to deny the zoning application and adopt an ordinance granting the zoning change on an emergency basis. Councilman Dilg seconded the motion. The motion prevailed by the following vote: Ayes : Tate, Dalton, Eidson, Pittarc,i, Conine, Dilg Noes : None Absent: Parker ORDINANCE N0. 73-61 AN ORDINANCE AMENDING OROINANCE N0 . 70-10, A ZONING ORDINANCE OF THE CITY OF GRAPEVINE, TEXAS , GRANTING A ZONING CHANGE ON A TRACT OF LANO IN THE JOEL HALLUM SURVEY , ABSTRACT N0 . 722, IN THE CITY OF GRAPEVINE, TEXAS , AND MORE FULLY OESCRIBED HEREIN; ORDERING A CHAN3E IN THE USE OF SAID PRO- PERTY FROM "PD" TO "PD" PLANNED DEVELOPMENT DIS- � TRICT [REVISED] ; CORRECTING THE OFFICIAL ZONING MAP ; PRESERVING ALL OTHER PORTIONS OF THE ZONING OROINA NCE; PROVIDING A SEVERABILITY CLAUSE; DETERMINING THAT THE PUBLIC INTEREST, MORALS AND GENERAL WELFARE DEMAND A ZONING CHANGE AND AMENDMENT HEREIN MADE; PROVIDING A PENALTY ; AND DECLARING AN EMERGENCY. 156 I There being no f urther bu�ine�s , Mayor Tate adjourned the i meeting.
