EMERGENCY. `" " BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF GRAPEVINE, TEXAS. Section 1-Definitions: A. Rire Lane�an area duly marked and as approved by the Fire Chief for the City of Grapevine located on private property. B. F'ire Chief-Chief of the Grapevine Fire Department . C. Vehicle-means every device in, upon, or by which any person or property is or may be transported or drawn upon a high- way, except devices moved by human power or used exclusively up- on stationary rails or tracks . Section 2. The Fire Chief is hereby authorized and directed to designate fire lines on private property at any time when in his judge- ment a f ire lane is needed on and across private property to permit and allow safe and adequate circulation of Fire Depart- ment equipment in order to provide fire protection to the sub- � ject property. ��� Section 3. The Fire Chief shall notify the owner of property that a fire lane has been designated and the location of same . Section 4. If the Fire Chief 's designation of a fire lane precedes or is simultaneous with construction or development of subject prope rty, including new construction, remodeling and repairing, the owner�s compliance with this Ordinance shall be a condition precedent to the obtaining of a Certificate of Occupancy. Section 5. Upon the designation of the location and size of the f ire lane by the Fire Chief, the owner of the property shall mark the same in accordance with the following: (A) Owner of subject property shall be responsible for the marking and maintenance of fire lane . (B) Fire lanes shall be designated by continuous lines at ��° least four (4) inches in width on each side of fire lane starting at the street entrance and continuing to the exit. Such lines ;,��, shall be bright red in color. The words "No Parking" and "Fire Lane" shall be painted in white letters alternatively every fifteen (15 ' ) feet over the red lines . The words "Fire Lane" shall be painted at the entrance to fire lanes with lettering in white and at least eighteen (18) inches in height. (C) Fire lane adjacent to curbs , buildings and fences shall have the entire curb painted bright red or in such a manner as the Fire Chief shall direct. (D) The Fire Chief may require , when necessary, that "Fire Lane" and "No Parking" signs be erected on buildings , posts or fences . Section 6. (A) It shall be unlawful to park, stand or stop a vehicle other than a vehicle operated by the Grapevine Fire Department, � - Police Department or other governmental vehicle needed to assist in Rire Prevention Activities in a designated fire lane. r�.� (B) It shall be unlawful for the owner of property to permit or allow a vehicle, other than an authorized emergency vehicle, to be left parked, stopped or standing in a designated fire lane. (C) The owner of the premises shall have the right to re- move an illegally parked vehicle pursuant to Tex.Rev.Civ.Stat. Ann.Art.6701g-1. (D) The City shall have the right to remove any vehicle illegally parked in a fire lane and to assess any costs for re- moval against the owner of the vehicle. Section 7. Severability-If any section, article ,paragraph, sentence, clause , phrase or word in this ordinance , or application thereto to any person or circumstances is held invalid or unconstitu- tional by a Court of competent jurisdiction such holding shall not affect the validity of the remaining portions of the ordinance; and the City Council hereby declares it would have passed such remaining portions of the ordinance despite such invalidity, which remaining portions shall remain in full force �'""`h and effect. �r Section $. Penalty-Any person violating any of the provisions of this ordinance shall be deemed guilty of a misdemeanor and upon conviction thereof shall be fined in a sum not to exceed two hundred dollars ($200:00) and a separate offense shall be deemed committed upon each day during or on which a violation occurs or continues after the notice period provided herein has expired. The Court shall order removal and abatement of the nuisance . Section 9. Emergency-The fact that no present ordinances of the City of Grapevine providing for the establishment of fire lanes exist, creates an urgency and an emergency and in the preservation of the public health, safety and welfare requires that this ordi- nance shall take effect immediately f rom and after its passage and the publication of the caption as the law and charter in such cases provides .
