HomeMy WebLinkAboutORD 1978-064 ORDINANCE N0. 78-64 AN ORDINANCE CLOSING, ABANDONING AND VACATING A PORTION OF ECKLEY STREET IN THE CITY OF GRAPEVINE, TEXAS , AS HEREINF.FTER DESCRIBED; PROVIDING A SEVERABILITY CLAUSE; AND DECLAR- ING AN EMERGENCY. WHEREAS , the owners of property abutting a portion of � Eckley Street in the City of Grapevine, Texas , have requested the right-of-way of a portion of Eckley Street , as hereinafter described, be closed, abandoned and vacated; and WHEREAS , the right-of-way of said street as hereinafter described is not now needed for public street and will not be needed in the future for a public street ; and WHEREAS , the closing, abandoning and vacating the right- of-way of said street will relieve the City of Grapevine, Texas , from the cost and expense of maintaining said property; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF GRAPEVINE, TEXAS : Section l. That the portion of right-of-way of Eckley Street , more particularly described as follows : BEING a tract of land out of the E . Moore Survey, Tarrant County, Texas and being more particularly described as follows : � BEGINNING at an iron pin 50 feet East and 200 feet South of the Southeast corner of Lot Eight (8) , Block Eight (8) , D. E . Box Addition to Grapevine, Tarrant County, Texas , said Beginning point �` ' being 3186. 94 feet West and 1238 . 06 feet South of the Northeast corner of said E. Moore Survey; THENCE West 50. 0 feet to an iron pin; THENCE South 453 . 5 feet to an iron pin; THENCE North 80 degrees 14 minutes West along the North right-of-way line of SL & SW Railroad a distance of 50 . 72 feet to an iron pin; THENCE North 445 feet to the point of beginning and containing approximately 0. 515 acres EXCEPT the east 20 feet of the above described parcel being retained as a permanent utility easement for existing 8" City water line and future public utilities , and the same is hereby closed, abandoned and vacated for public use, and the same is hereby closed, abandoned and vacated inso�ar as al1 public right, title and interest in and to said descr�bed portion of said right-of-way is concerned except the east 20 feet of the above described parcel being retained as a permanent utility easement for existing 8" water line and future public utilities . *�-c= Section 2. That the Mayor , be, and is hereby authorized to execute a Quit-Claim Deed to convey the heretofore described property to First Presbyterian Church, whose Trustees have offi- �.� cially declared by affidavit that they each are the rightful fee owners of the right-of-way vacated and abandoned by this oridnance . Section 3 . That the terms and provisions of this ordi- nance shall be deemed to be severable and that if the validity of any section, subsection, word, sentence or phrase shall be held to be invalid, it shall not affect the remaining part of this ordinance. Section 4. The fact that the said portion of right-of-way of Eckley Street is no longer needed by the public for public usage or traveling and would create a hardship or burden upon the City of Grapevine to keep open and maintain such street creates an urgency and an emergency for the immediate preservation of the public health, safety and general welfare which requires that this ordinance shall take effect immediately from and after its passage and it is ac- cordingly so ordained. �� PASSED AND APPROVED BY THE CITY COUNCIL OF THE CITY OF GRAPEVINE , TEXAS , this the �3 day of ���,.,�� , 19 8 . �,� d%� M r ATTEST: City ecr r APPROVED AS TO FORM: � City Attorney � . ��..;..� �
