ORDINANCE NO. 78-44
AN ORDINANCE FINDING THAT A SMALL IRREGULAR
STRIP OF PROPERTY OWNED BY THE CITY IN FEE
TITLE IS NOT NEEDED FOR CITX PURPOSES; PRO-
VIDING FOR THE FINDING THAT DUE TO ITS IR-
REGULAR SHAPE TI-iE1T IT WOULD SERVE NO USEFUL
PURPOSE TO ADVERTISE THE PROFERTY FOR SALE;
PROVIDING FOR THE ACCEPTANCE OF A BID FOR THE
PURCHASE OF THE PROPEKTY; PROVIDING A SEVEP,-
��� ABILITY CLAUSE AND DECLARING AN EMERGENCY.

WHEKEAS, the City is the nwner in fee title of the Property
,�,�,,,�, described in Exhibit .='A" , and
WHEREAS, the ��vner of the adjacent property inadvertently
canstructed a building on and across said described property; and
- �Vf-�EREAS, the City Co��ncil has concluded, based on the
- recommendations of the City Administration , that the sma11 ,
irregular strip of land is not needed for public purposes ; and
� WHEREAS , the Cour�cil has concluded that due to the size,
shape and location of the strip of land that it would be of no
- va.lue to request bids on an advertised basis .
_= NOtV, THEREFORE, BE IT ORDAINED BY THE CITY CGUNCIL OF THE
� CITY OF GRAPEVINE, TEXAS:
Section 1. That the Council does hereby find that the
Y Froperty described in Exhibit "A" based on the recommendation
of the City :'�dministration is not needed for public purposes.
Section 2. That the Council does hereby f_ind that due to
the size , shape and location of the subject tract of land that
"""� it would be of no value to advertise for bids .
;,,�,, Section 3. That the Council does hereby accept the bid of
Kimbell, Inc. in the amount of $1260.00
as reasonable and reflective on the fair market value of the
subject praperty and does her.eby agree to convey subject property
to Kimbell, Inc.
Section 4. That the Mayor is hereby authori.zed to execute
a deed approved by the Ci.ty Attorney conveying the City�s right ,
title and interest to Kimbell, Inc.
Section S. That the terms and provisions of this ordinance
shall be deemed ta be severable and that if the validity of any
section , subsection, word, sentence or phrase shall be held ta
be invalid, it shall ncz affect the remaining part of this ordinance.
Section 6. The fact that said property is no longer needed
by the City of Grapevine and would create a hardship and burden
upan the City of Gr_apevine to maintain such property creates an
�trgency and an emergency for the immediate preservation of the
public health, safety and general weltare whlch require� that this
ordinance shall take effect immediately f rom and after its passage
and it is accordingly so ordained.
