HomeMy WebLinkAboutORD 1977-061 ORDINANCE NO. 77-61 AN ORDINANCE DIRECTING PUBLICATION OF NOTICE TO BIDDERS FOR THE CITY OF GRAPEVINE, AND DECLA�ING AN EMERGFNCY THE STATE OF TEXAS � COUNTY OF TARRANT X CITY OF GRAPEVINE X WHEREAS, the City Council previously passed Or.dinance No. 77-57 which Ordinance directed publication of notice to bidders seeking bids for the construction of a permanent public improvement and public wor.l�, to-wit: the renovation and completion of a building presently owned by the City for use by the Po)ice Department, the I ibrary and as a community room which bids were to be received until D.ecember 5, 1977, and; WHEREAS, it has been determined that it is in the best interest of $ the City and its citizens to extend the time to receive the bids from December 5, 1977 at 2:00 p.m. until December 13, 1977 afi 2:00 p.m. �.. WHEREAS, the Ctiy Council finds that a permanent public improvemAnt and public work, to-wit: the renovation and completion of a building present y owned by the City for use by the Police Department, the libray and asa community room, is urgently needed by the City of Grapevine and that it is necessary to advertise for bids. THEREFORE, BE IT ORDAINFD BY THE CITY COUNCIL OF THE CITY OF GRAPEVINE, TEXAS: I. That attached hereto and marked "Exhibit A" is a form of the "Notice to Bidders, " the form and subsfiance of which are hereby adopted and approved. 2. That the Cifiy Secretary shall cause said Notice to Bidders to be published in substantially the form attached herefio, in a newspaper of genera} c�rc�lafion p�b!l;h�d in the C�ty of Grapevin�, Texas, once a week for each of fiwo consecutive weeks, the date of the first publ ication thereof to be at least fourteen (14) days prior to the time set for receiving bids as shown in said Notice to Bidders. 3. The City Council does hereby find that this Ordinance and the nature of the project in question relate to the immediate preservation of the publ ic peace, �, ; health and public welfare pursuant to Section 3.i) of the City Charter and the requirement of reading an ordinance on two (2) of severol days is hereby dispensed with in accordance with this finding, and that the meeting at which this ordinance was passed was open to the pub)ic, and fihe publ ic notice of fihe time, place, and purpose of said meeting was given as required by Article 6252.-17, V.T.C.S., as amended. . EXHIBIT "A" �, ''NOTICE TO BIDDERS (Adverfiisement} Sealed propasais, in duplicate, addressed ta 3�ne City of Grapevine, Texas for the construction of the Grapevine Police and Library Facility, 707 Wesfi Dallas Drive, Grapevine, Texas, in�accordance with the Drawings and Specifications prepared by the Architects, Hatfield - Halcomb, Inc. and as adopted by the City of Grapevine, will be received until December 13, 1977 at 2 PM at the �fice of the City Manager, City Hpll, City of Grapevine, Texas. Each proposal shall be clearly marked on the outside of the sea{ed envelope as "Proposal - Grapevine Policeand Library Facility." All proposals received after the 2:00 PM closing time will be returned unopened. DRAWINGS AND SPECIFICATIONS along with instructions to bidders and proposal forms, rr�y be examined wit out charge at the office of the Architect, Hatfield - Halcomb, Inc., 8f0 Carillon Tower West, (3601 Preston Road, Dallas, Texas, or - the City Manager's Office, City of Grapevine, Texas. Two (2) complete sets of drawings and specificafions may be procured fr�m the Archi�ect upon fi4�e deposit of separate checks of $50.00 per set as guarantee for the safe return of the >, Bid Documents in good condition. No refunds will be made for Bidding Documents returned later than five (5) days after the bids are received. Additional complete sets of documents may be obtained by Bidders, suppfiers and sub-contractors upon deposit in the amount of $50.00 (refundabfe) per set made payqble to Hatfield - Halcomb, Inc. Partial sets of drawings and specifications will not be available. Each bid must be accompanied by a cashier's check or acceptable Bidder's Bond payable without recourse to the City of Grapevine, Texas in an amount of not less than five percent (5°l0) of the total bid plus alternates as submitted. Bids received without bid bond or cashier's check will not be considered. The successful bidderwill be pdid his contract price, in whole or in part, in Cerfiificates of Gblic�atian issued by the City. The City Councii has made provisions for the successful bidder to sell and assign such Certificates of Obligation upon receipt from the City, to First Southwest Company, Dallas, Texas and to receive in cash the par value thereof. Each bidder is required in his bid form to elect whether he will accept such Certificates af Obligation in payment of all or a part of the contract price, or �' assign such Certificates of Obligation in accordance with the arrangements specified herein. �. The City will make ir�stallment deliveries of the Certificates of Obligution � every thirty (30) days based upon the work actually performed to that date under the contract less any amounts for retainage. The successful bidder must furnish an acce�tabte P�rformance and Payment Bond from an approved Surefiy Company in accordance with Article 5160, Vernon's Annotated Texas Civil Statues. The City of Grapevine, Texas reserves the right to reject any or all bids 4nd fio waive defects in bids. ' No bidder may withdraw his bid within 30 days after the actual date of the opening thereof.
