An ordinance amending Chapter 10 of the City Code of Grapevine, Texas pertaining to Wreckers by amending Section 4-10-2 to provide for the Chief of Police to inspect the equipment and by amending Section 4-10-4 pertaining to �.. Insurance Requirements; providing a sevarability clause, providing a penalty and declaring an emergency. �. ., BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF GRAPEVINE, TEXAS. . Section I. That Chapter 10, Section 4-10-2 (A) is hereby amended ta read as follows: "4-10-2, Approval List, " (�►) Afterapplication is made, the Chief of Police shall inspect the equipment of the company making the application and shall classify that equipment according to the stnndards and specifications as set out herein. The Chief of Police shall notify all appl icants complying with the provisions of this Chapter that their name has been placed on the approval list. Applicants not complying wifih provisior�s of this Chapter shall be notified in writing stating the reason for the rejection of fihe application. The Chief of Police shall have the right to inspect the equipment �' of all companies providing wrecker service under the provisions of this Chapter. Said inspection shal I be made at any and al) reasonable hours and places. The Chief of Police, after inspection, may authorize the removal of a company's name fram the lisi- for failure to operate and maintain its equipment in an efficient and good manner. Section 2. That Secfiion 4-10-4 is hereby amended to read as follows: "4-10-4 lnsurance", All wrecker companies shall carry sfiandard liability insurance in limits of not less than the following sums: (a) For damage arising out of bodily injury or to death of one person in any one • :� - accident, $�k�0,000.04. (b) For damage arising out of bodily injury to or death of two (2) or more persons in '� ° any one accident, $300,000.00. (c) For injury to or destruction of property in any one accident, $25 000,00. (d) Al) wrecker companies who have starage yards shall carry sufficient insurance to cover theft of vandalism from said yard in an amount satisfactory to the City Manager. Section 3. Savings and SeXerability Clause. If any section, article, paragraph, sentence, clause, phrase or word in this ordinance, or application thereto to any person or circumstances is held invalid or uncor�stitutional by a Court of competent �.,:,.. jurisciiction such holding sholl not affect the val idity of the remaining portions of the ordinance; and the City Council hereby declares it would have passed such remaining �,�, portions of the ordinance despite such invalidity, which remaining portions shall remain in full force and effect. Section 4. Penalty. Any person violating any of the provisions of this ordinance shal) be deemed guilty of a misdemeanar and upon conviction thereof shall be fined in a sum not to exceed two hundred dollars ($200.00) and a separate offense shall be � deemed committed upon each day during or on which a violation occurs or continues after the notice period provided herein has expired. The Court shall order removat and abatement of the nuisance. �" '- Section 5. Emergency. The fact that no present ordinances of the City of Grapevine regulating Wreckers, by amending Section 4-10-2 to provide for the Chief `�`''p of Police, to inspect the equipment and by amending Section 4-10-4 perfiaining to Insurance R�quirements , creates an urgency and an emergency and in the preservation of the publiG health, safety and welfare requires that this ordinance shall take effect immediately from and after its passage and the publ icafiion of the caption as the law and charter in such cases provides.
