HomeMy WebLinkAboutORD 1975-037 ORDINANCE NO. 75-37 ORDINANCE APPROVING CERTAIN RATE SCHEDULES FILED BY TEXAS POWER AND LIGHT COMPANY IN THE CITY OF GRAPE- VINE, TEXAS, PROVIDING CONDITIONS UNDER WHICH SUCH RATE SCHEDULES MAY BE CHANGED, MODIFIED, AMENDED OR WITHDRAWN; PROVIDING FOR AUTOMATIC ALTERATION IN RATES AND REFUNDS TO CUSTOMERS UNDER CERTAIN CIRCUM- �;..;.. STANCES; PROVIDING FOR THE EFFECTIVE DATE. ' BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF GRAPEVINE, TEXAS: � Section l. That Texas Power and Light Company, having filed on the 4th day of June, 1975, its Rate Book No. A-75-7 containing a set of electric Rate Schedules and the Service Regulations re- ferred to therein, with the City of Grapevine, the same are hereby approved as Schedules of Rates and Service Regulations under which said Company is authorized to collect charges from its customers for the sale of electric power and energy within the corporate limits of the City until such time as said Rate Schedules and Service Regulations may be changed, modified, amended or with- drawn, with the approval of the City Council. Said Company agrees to continue the Gross Receipts Tax it pays to the City of Grapevine «��.a� at three per cent (3%) of gross revenue derived from residential, commercial, industrial, government and municipal business in com- pliance with the laws of the State of Texas, the Home Rule Charter for the City of Grapevine, Texas, and all ordinances of the City of Grapevine. Section 2. The filing of the Rate Schedules and Service Regu- lations, and the approval of same by the City Council, in the manner herein provided, shall constitute notice to the consumers of electri- city, within the City, of the availability and application of such ,�,�, Rate Schedules and Service Regulations. �.� Section 3. Other than increasing the rate schedules and con- tinuing the 3/ gross receipt tax this ordinance shall not affect the terms of any rate ordinance, franchise provision or regulatory right of the City of Grapevine relative to Texas Power & Light Company. , $ection 4. The City of Grapevine and Texas Power and Light Company recognize that there are various studies of this proposed rate schedule presently under way in other class "A" cities served by T.P. & L., such as in Waco and Irving. The City inapproving this schedule of ratesdoes so on the following basis and conditions as follows: '�� p A) If Texas Power 8� Light Company voluntarily or as a result of a court ���" order places into effect a schedule of rates that is lower than the schedule of rates herein approved in any of its class "A" cities, said lower schedule of rates shall automatically ipso facto, without any additional action on the part of the City or without any application by TPB�L go into effect immediately. Said Texas Power & Light Company shall likewise refund all of its Grapevine customers the revenue collected from each customer in excess of the lower rates subsequently placed in effect pursuant to this paragraph. Section 5.
