Menbers present were Mayor 6�oods and Councilaen Benedict, Pirkle, Hubez, Dalton and Foust. 090 Attorneys Lonnie McGuire, Jr. , Irmin Steinhorn, and Mr. Browning a�re present with their clients Mr. Ramos and son for the purpose of settling their complaint that Johnnie Ramos �ras held in jail in violation of various Supreme Court rulings. Mr. McGuire was advised that the City Council is not the proper judicial body to settle the complaint and that he should settle the matter through proper chaanels. On this date a public hearing was held for the purpose of considering Rezoning Applications Nos. 67-21, 67-22 and 6�-23. i � 185 MOTION by Councilman Pirkle, seconded by Councilman Dalton to accept the recommendation of the Planning & Zoning Com�ission and rezone Lots 10 thru 15 of Block 1, and Lots 10 thra 15 and 16 thru 20 of Block 2; all of the Lakecrest Aadition to "G" Local Business District as requested on Geozge Uncierwood's Application 67-21 and to pass Ordinance 67-32 enacting the change. Motion carried by a yes vote by Councilmen Benedict, Pirkle, Huber, Dalton and Foust. There weze no noes. ' ' ' i 188 MOTION by Councilman Benedict seconded by Councilman Pirkle to accept the recommendation of the Planning & Zoning Comaission and disapprove the request of Kenneth Griffin's Application 67-22 on �' which h� requested C & D Dovelling District Zoning on his Lots 1 & , 2, Block 103 of the College Heights Addition, and aot pass the iproposed ordinance making the change. Motion carried by a yes vote by Council- men Benedict,Pirkle, Huber, Dalton & Foust. There were no noes. 200 MO?ION by Councilman Dalton, seconded by Councilman Huber to accept the Planning & Zoning Commission Board's recommendation and approve the request of M. K. Ratcliff's Application 67-23 on which he re- quested "G" Local Business Distr�ct Zoning on Lots 12, 13, 14, 15 i & 16, Block 3 of Lakecrest Aadition, and to pass Ordinance 67-33 ; enacting the change. It was then duly moved by Councilman Pirkle and seconded by Councilsan Huber that said Resolution be adopted; and, after due discuasion said MO?ION carzied with a yes vote by Councilaen Benedict, Pirkle, Hnber, Dalton and Foust. A copy of said Resolution, Nuaberad R69-8 is attached hereto and is a part of the minutes of this meeting. 435 A written rssolution callinq for a deletion to Title 9, Chapter 2, Section 3 0� the City Code and a�n addition to Title 9, Chapter 2, Section 3 of the City Code was introduced for the considesa- tion of the City Council and read in full. It was then moved by Councilaan Pixkle and seconded by Councilaan Foust that said . Resolution be adopted; and, after due discassion said MOTION carried with a yes vote by Councilaan B�nadict, Pirkle, Huber, Dalton and Foust. Tl�ere were nc noes. It was then aoved by Cbuncilaan Dalton and seconded by Council�an � Pirkle that said Ordinance be adopted on first reading, and after due discussion said MOTION cazried by a yes vote by Councilmen � Beaedict, PiYkle, Huber, Da►lton and Foust. There pere no noes. Said Ordinance is numbered 6'7-34 for record. Mayor Woods appointed Leon Lewis to the Planning & Zoning Coamission �. and said appointsent was approved by Councilmen Benedict, Pirkle, Huber, Dalton and Fonst. f The City Council approved J. R.
