AN ORDINANCE AMENDING ORDINANCE N0. 70-10, THE COMPHENSIVE
� ZONING ORDINANCE OF THE CITY OF GRAPEVINE, TEXAS , SAME
� BEING ALSO KNOWN AS TITLE 10 OF THE CITY CODE OF GRAPEVINE,
TEXAS , GRANTING A ZONING CHANGE ON A TR.ACT OF LAND
DESCRIBED AS: BEING 41. 24 ACRES OF LAND OUT OF THE HENRY
SUGGS SURVEY, ABSTRA.CT N0. 1415, AND THE A. W. ANDERSON
SURVEY, ABSTRACT N0. 699, IN THE CITY OF GRAPEVINE, TARRANT
COUNTY, TEXAS , MORE FULLY AND COMPLETELY DESCRIBED IN THE
BODY OF THIS ORDINANCE; ORDERING A CHANGE IN THE USE OF
SAID PROPERTY TO "I-1" LIGHT INDUSTRIAL USE DISTRICT;
CORRECTING THE OFFICIAL ZONING MAP; PRESERVING ALL OTHER
PORTIONS OF THE ZONING ORDINANCE; PROVIDING A SEVERABILITY

CLAUSE; DETERMINING THAT THE PUBLIC INTEREST, MORALS , AND
`"�"' GENERAL WELFARE DEMAND A ZONING CHANGE AND AMENDMENT HEREIN
MADE; PROVIDING A PENALTY; AND DECLARING AN EMERGENCY.

WfiEREAS, applications were made to amend the
Official Zoning Map, City of Grapevine, Texas , by making
applications for same with the Planning and 7oning
Commission of the City of Grapevine, Texas, as required
by state statutes and the zoning ordinances of the City
,, of Grapevine, Texas, and all the legal requirements,
conditions and pre-requisites having been complied with,
the case having come betore the City Council of the City
�, of Grapevine, ,Texas, af.ter all legal notices, require-
ments, conditions and pre-requisites having been complied
�, with; and,
WHEREAS, the City Council of the City of
Grapevine, Texas, at a public hearing called by the
City Council did consider the follo�ving factors i.n
making a determination as to tivhether these requested
changes should be granted or denied; safety of the
motoring public and the pedestrains using the facilities
in the area immediately surrounding the site; safety
from fire hazards and me�sures for fire control, protection
of adjacent property from flood or r,ater damages, noise
producing elements and glare of the vehicular and
stationary lights and effect of such lights on established
charaeter of the neighborhood, location, lighting and
types of signs and relation of signs to traffic control
_ and adjacent property, street size and adequacy of width
for traffic reasonably expected to be generated by the
proposed use around the site and in the immedi�>. : e
neighborhood, adequacy of parking as determin��. by
requirements of this ordinance for off-street parking
�"' facilities, location of ingress and egress points for
parking and off-street loading spaces, and protection
`� a of public health by surfacing on all parking areas to
control du st, effect on the promotion of health and the
general. welfare, effect on light and air, the effect on
the over-cro�vding of the land, the effect on the conc�n-
tration of population, the effect on the transportation,
cvater, sewerage, schools , parks and other public facilities ;
and,

Grapevine, Texas , at a public hc�r�»a called by the
City Council of the City of Grap,�vi.:;e, Texas , did consider
the follo�ving factors iri making a ce�ermination as to
���hether this requested change shoulc: be granted or denied;
effect on the congestion of the s�xe�ts, the fire hazards ,
panics and other dangers possibly pr. esent in the securing
of safety from same, the effect on the promotion of heal�h
and the general welfare, effect on �cequate light and air,
the effect on the over-cro�vding of ��e land, the e1�ect
on the concentration on population , the effect on �he
transportation ; ��:ater, sewerage, =c;�aols, parks and oiher
� public facilities ; and,
�'""" t�lI-iEREAS, the City Council iurther considercd
among other things the character of the district and its
peculiar suitability for particular uses and with the
view to conserve the value of buildings, encourage the
most appropriate use of land throughout this city; and,
GR�ERF_AS, the City Council of the City of
Grapevine, Texas , does find that there is a public
necessity for the zoning change, that the public demands
it, that the public interest clearly requires the amend--
. ment, that the zoning changes do not unreasonably invade
the rights of those who bought or improved property with
reference to the classification �vhich existed at the tzme
�
their original investment was made; and,
�
taHEREAS, the City Council of the City of
Grapevine, Texas , does find that the change in zoning
lessens the congestion in the streets, he.lps secure
safety from fire, panic and other dangers ; promotes
health and the general welfare; provides adequate light
. and air; prevents the over-cxot��ding of land; avoids
undue concentration of population; facilitates the
adequate provisions of transportation, water, sewerage,
schools, parks and other public requirements; and,
VJF-I�REAS, the City Council of the City of
Grapevine, Texas , has determined that there is a necessity
and need for this change in zoning and has also found
and determin ed that there has been a change in the
conditions of the property surrounding and in close
proximity to the property requested for a change since
this property was originally classified and therefore
feels that a change in zoning classification for the
, particular piece of property is needed, is called for,
and is in the best interest of the public at large, the
�� citizens of the City of Grapevine, Texas, and helps
pronote the general health, safety and welfare of this ,
�. community;
NOW, THEREFORE,

� BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF GRAPEVINE,
TEXAS':
SECTION l. That the City of Grapevine Ordinance No. 70-10,
being the Comprehensive Zoning Ordinance of the City of
Grapevine, Texas, same being also knwon as Title 10 of the
City Code of the City of Grapevine, Texas, be, and the same
is hereby amended and changed in that the use of the following
described property, to-wit:
"�� Being a tract or parce� of �.and out of the HENRY SUGGS
SURVEY, A-1415, and the I�. W. ANDERSON SURVEY, A-699, and
�,,, being more particularly described by metes and bounds as .
follows:
BEGINNING at an iron pin in the West line of the said
Suggs Survey, 1445 varas South of a stone at its Northwest
corner, the same being the most Northerly Northwest corner of
a certain 177. 21 acre tract of land as recarded in Volume 421 ,
page 242 , Deed Records of Tarrant County, Texas;
THENCE North 89° 59 ' East along the centEr line of County
Road #3044 , a distance of 863.44 feet ta a nail for corner in
the Northwesterly right-of-way line of Sta�te Highway #121;
. THENCE South 41° 32 ' � West alor�g a fence and the North-
westerly line of the said highwdy, 1790 feet to the South
line of the said Anderson Survey for corner, the same being
a common line with a tract of land in the name of the United
States of America; .
THENCE North 89° 40' West, 1320 feet to a fence, the same
� being on� a common line with a tract af land in the name of the
United States of America;

THENCE North 00� 22' West, 772 feet to a concrete marker
and North 45° 08 ' East 935.Q1 feet to a concrete marker at
� the Northeast corner of a 30 acre tract of land as recorded in
Volume 2246 , page 508 , Deed Recc�rds of Tarrant County, Texas;
THENCE South 00° 21' East, along the Ea�t line of said
: 30 acre tract, along a fence, 13.68 . 87 feet to an iron pipe
� for corner in the center line of an abandoned road;
THENCE Northeasterly along the center line of said aban-
doned road and along the Northwesterl.y lir�e of said 177 . 21 acre
tract, North 46° 53 ' East, 223. 39 feet; North`43� 53 ` East,
388 .87 feet; North 52° �3 ` East, 2UG. 25 feet; North 48° 16 '
East, 185. 2 feet; and North 32o IO ' East, 449. 74 feet to the
POIN� OF BEGIivi`ING, and containing 41 . 24 acres� more or less.
which is presently zoned "R-1" Single Family Use District
under Ordinance No. 70-10 is changed to "I-1" Light Industrial
Use District.

SECTION 2. The City M��nager is hereby dir�cted to correct
the official zonin� map of the City of Grapevine, Texas ,
to reflect the herein ch��nge in �oning.
SECTION 3. That in all other respects the use of the tract
or tracts of land herein above described shall be subject
to all the applicable regulations c�ntaine� in sai.d City of
Grapev�ne zoning ordinance and all other a�Pl_ic��ble and
�,,,x,� pertinent ordinances of the City of Grapevine, Texas .

SECTION 4. That the zoning regulations and districts as
herein established have been made in accordance with t-he
comprehensive plant for the purpose of promoting health ,
� safety, mor.als and the general welfare of the community.
They have been designed, with respect to both present
conditions and the conditi.ons reasonably anticipated to
exist in the foreseeable future, to lessen congestion in
the streets; to secure safety from fire, panic, flood and
. other dangers; provide .adequate light and air ; to prevent
over-crowdi_ng of land, to avoid undue concentration of
. population ; facilitate the ade�u�.te provisions of trans-
�` portation , water , sewerage, drainaoe and surface water ,
parks and other public requirements , and to make adequate
provisions for the normal business, commercial needs and
development of the community. They have been made with
reasonable consideration , among other things of the
character of the district, and its peculiar suitability
for the particular uses and with a view of conserving
the value of buildings and encouraging the most appropriate
use of land throughout the community.

SECTION 5. This ordinance shall be cumulative of all
�,,,,,, other ordinances of the City of Grapevine, Texas, affecting
zoning and shall not repeal any of the provisions of said
ordinances except in those instances where provisions of
those ordinances �vhich are in direct conflict with the
provisions of this ordinance.
SECTION 6. That the terms and provisions of this
ordinance shall be deemed to be severable and that if
the validity of the zoning affecting any portion of the
tract -or tracts of land described herein shall be declared
to be invalid, the same shall riot affect the validity of
the zoning of the balance of the tract or tracts of land
described herein.
SECTION 7. That any person , firm or corporation violating
any of the terms and provisions of this ordinance shall be
subject to the sa.me penaities provided for in Ordinance
No.. 70-10, Zoning Ordin�nce of the City of Grapevine, Texas .
SECTION 8. The fact that the l�resent zoning ordinance and
�"'^ . regulations of the City of Gr�pe'�Tine, Texas, are inadequate
� to properly safeguard the health, safety, morals, peace and
�' general welfare of the inhabi�ants ot the City oi Grapevine,
Texas, creates an emergency for the immediate preservation of
the public business, property, health, safety ana general
welfare of the public which requires that this ordinance shall
become effective from and after the date of its =inal passage,
and it accordingly so ordained.
