A PORTION OF BROOK CREST LANE IN THE CITY OF
GRAPEVINE, TEXAS, AS KEREINAFTER DESCRIBED;
AND DECLARING AN II�RGENCY.

WF�,REAS, the o�mers of property abutting a portion of Brook
Crest Lane in the City of Grapevine, Texas, have requested the right-
of-way of a portion of Brook Crest Lane, as hereinafter described,
be closed, abandoned and vacated; and
WHEREAS, the right-of-way of sa�_d street as hereinafter
described is not now need.ed for public street and wi11 not be needed
ir� the future for a public street; and
v1I.�"�Fi�;AS, the closing, abandoning and vacating the right-of-way
of said street �ti*ill relieve the City of Grapevine, Texas, from the
cost and eXpense of maintaining said property;
NOG�� THEREFORE� BE IT ORDAINED BY THE CI�Y COUNCIL OF THE CITY
OF GRAPEVIN�', TEXAS:

SECTION l. That the portion of right-of-way of Brook Crest
"���` Lane, more particularly described as follows:
CON�IENCL�TG at the S. E. corner of Lot 16,
Block 10, Sectio� 4, Grapevine Lake
Estatew Addition to the City of Grape�rine,
Tarrant County, Texas, as recorded in
Volurle 388-W, page 17, D.R.T.C.T.;
THENCE South 0° 50' Ea�t 50 feet;
TI�NC� South 8g° 24' West, 499•5 feet to
the Td. W. corner of Lot 7, B1ock 12, of
said Additior,;
THENCE South 0° 50' East along the West
line of Lot 7 and Lot 11, a distance oi
285 feet to the S. W. corner of said
Lot 11, also the PL�CE OF BEGITI�TING of
tn.e tract being described;
THENCE North �9° 2�+' East a distance
of 325 feet to a point for a corner
in tne West line of t'_ze G. K. Reed Tract;
THENCE South 0� 50' East along the West

be, and the same is hereby closed, abandoned and vacated for public
use, and the sarne is hereby closed, abandoned and vacated insofar as
a11 public right, title and interest in and to said described portion
of said right-of-way is concerned, subject:to and contingent upon the
owner of abutting property re�oving and relocating any eaisting City
of Grapevine utilities into a city easemEnt to the satisfaction and
approval of the City Manager of the City of Grapevine.

SECTION 2. That the Mayor, be, and is hereby autnorized o
execute a Ouit-Clain Deed to convey the hEr�tofore described property
to tne ovrners of the proroerty abutting said rignt-of-way, who have
�� officially declared by affidavit that they each are the rightful fee
oz�mers of the right-of-wa.y vacated and abandoned by this ordinance
and that they know of no other parties who own property abutting
said right-of-kTay.
SECTION 3• That the terms and provisions of this ordinance
sha11 '�e deemed to ue severable and that if the validity of any
section, subsection, word, sentence or phrase shall be held to be
invalid, it shall not affect the rer�aining part of t�iis ordinance.
SECTIOT? �-+. The fact tha� the said portion of right-of-tiray
of Brook Crest Lane is no longer needed by the public for public
usage or traveling and would create a hardship or burden upon th�
City of Grapevine to keep open and maintain such street creates an
urgency and an emergency for the immediate preservation of the
public health, safety and. general welfare which reauires that this
ordinance sha11 take effect irnmediately from and af'ter its passage
and it is accordingly so ordained.
