HomeMy WebLinkAboutORD 1974-043 ORDINANCE NO. 74-43 AN ORDINANCE AMENDING THE CITY CODE OF THE CITY OF GRAPEVINE, TARRANT COUNTY, TEXAS, BY AMENDING CHAPTER 4, SECTION 15-7, ENTITLED �x. , "MIXED BEVERAGE PERMIT HOLDER", TO PERMIT � THE SELLING OR SERVING OF ALCOHOLIC BEVERAGES BY THE HOLDER OF A MIXED BEVERAGE PERMIT ONLY IN A RESTAURANT, CAFE, CAFETERIA OR EATING ESTABLISHMENT OR ON THE PREMISES OF AN INDIVIDUAL OR ENTITY WHOSE PRINCIPAL BUSINESS IS TRANSPORTING O F THE GENERAL PUBLIC AND IS OPERATING PURSUANT TO A CERTIFICATE OF PUBLIC CONVENIENCE AND NECESSITY ISSUED BY A FEDERAL OR STATE REGULATORY BODY; PROVIDING A PENALTY; PROVIDING A SEVERABILITY ��� CLAUSE; AND DECLARING AN EMERGENCY. � NOW, THEREFORE, BE IT ORDAINED BY THE GITY COUNCIL OF THE CITY OF GRAPEVINE, TEXAS; SECTION 1. That Chapter 4, Section 15-7, entitled "Mixed Beverage Permit Holder, of the City Code of the City of Grapevine, Tarrant County, Texas, be amended to read as follows: "4-15-7: MIXED BEVERAGE PERMIT HOLDER: No individual or entity shall sell or serve alcoholic beverages for on premises consumption as holder of a mixed beverage permit ' except in a restaurant, cafe, cafeteria or eating establishment or on the premises of an individual or entity whose principal business is transporting of the general public and is operating f pursuant to a certificate of public convenience and necessity � issued by a Federal or State Regulatory body. � "Restaurant, cafe, cafeteria or eating establishment is herein defined as a business whose gross sales from food on an annual basis represent at least fifty percent (50�) of its total sales. "The party or entity operating the business shall, on an annual basis, file with the City Secretary an affidavit showing gross receipts and sales of the business. The affidavit shall contain a breakdown between the gross sales of food and the gross sales of alcoholic beverages. Any person convicted of a violation of any Section of this Code shall be fined in a sum not to exceed Two Hundred Dollars ($200. 00) for any one offense. �,.;, SECTION 3. Whenever any word in any Section of this City Code importing � the plural number is used, in describing or referring to any matters, parties, or � persons, any single matter, party, or person shall be deemed to be included, although distributive words may not have been used. When any subject matter, party or person is referred to by words importing the singular number only, or the masculir� gender, several matters, parties, or persons and females as well as males and bodies corporate shall be deemed to be included; provided, that thses rules of construction shall not be applied to any section which contains any e�ress provision e�cluding such construction or where the subject matter or content may be repugnant thereto. SECTION 4. The fact that the present ordinances and regulations of �"" the City of Grapevine are inadequate to properly safeguard the health, safety, � peace and praperty of the inhabitants of the City of Grapevine, creates an imperative public necessity and emergency and requires that this ordinance shall take effect immediately from and after the da�te of its passage as an emergency measure.
