AN ORDINANCE AMENDING TITLE 9, CHAPTER 3 OF THE
CITY CODE OF GRAPEVINE, TEXAS, BY REGULATING THE
SPEED OF VEHICLES ON CONTROL 346-01 � 353-03

PROVISIONS OF THE CITY CODE OF GRAPEVINE, TEXAS;
PROVIDING FOR SIGNS; PROVIDING FOR A PENALTY;
PROVIDING FOR A SAVINGS CLAUSE; AND DECLARING AN
EMERGENCY.
BE IT ORDAINED BY THE CITY COUNCIL OF 'IH E CITY �F
GRAPEVINE, TEXAS;
SECTION 1. That Title 9, Chapter 3 of the City Code of Grapevine,
Te�as, be, and the same is hereby amended by adding the following paragraph:

"Speed breater than FIFTY-FIVE �s) miles per hour

on designated streets not rea sonable and prudent. "
Upon the basis of an engineering and traffic investigation submitted to
the City Council, the City Council hereby finds and determines that a maximum
prima facie s,peed limit heretofore set for a public street, roadway or highway
set forth below in the City of Grapevine, Texas, is not reasonable or prudent
under the conditions found to exist in the City of Grapevine, Texas, at said
location, therefore, the City Council hereby finds, determines and declares that
� when no special hazard exists that requires a lower speed for compliance with the
provisions of this ordinance and�or the laws of the State of Texas, no person

shall operate or drive any vehicle on the public streets, roadways or highways
set forth below in the City of Grapevine, Texas, at a greater speed than
F IF TY-F I VE ( s� ) miles per hour, unless otherwise provided by this
ordinance or subsequent ordinance; and any speed in excess of - ��FTY=FIVE
( s5 ) miles per hour, unless otlaerwise provided by this ordinance or subsequent
ordinance, shall be prima facie evidence that the speed is not reasonable or
prudent and is unlawful.

SECTION 2. This ordinance repeals those provisions, and only those

provisions, of all ordir� nces and sections of the City Code of Grapevine, Texas,
in conflict with the provisions hereof, but shall in no way repeal an5r provisions
of any ordinance or section of the City Code of Grapevine, Texas, establishing
a "School Zone" in an area covered by this ordinance.
SECTION 3. The City Manager is hereby directed to cause appropriate
signs to be posted at reasonable intez-�-als to apprise the public of the speed
limit and give them notice thereof.
,�� SECTION 4. Any person ��iolating or failing to comply with any provisions
;,,,�,� of this ordinance shall be fined upon con�riction not less than One Dollar
(�l. 00) nor more than Two Hundred Dollars (�200. 00).
SECTION 5, It is hereby declared to be the intention of the City Council
of the City of Grapevine, Texas, that the sections, para�raphs, sentences,
clauses and phrases of this ordinance az-e severable and if any phrase, clause,
sentence, paragraph or section hereof should bP c3eclared unc�nstit��r;nnal, such
unconstitutionality or invalidity shall not affect any of the remaining phrases,
clauses, sentences, paragraphs or sections of this ordinance, since the same
would have been enacted by the City Council without the incorporation in this
`"`" ordinance of any such unconstitutional or invalid phrase, clause, sentence;

SECTION 6. The fact that..that the City Code of Grapevine, Texas,
and other ordinances and regulations of the City of Grapevine, Texas, are
inadequate to control the speed of vehicles within the corporate limits of the
City of Grapevine, Te�as, creates an emergency for the immediate preservation
� ,�s ��ublic business, property, health, safety, and general welfare of the
; ��blic which requires that this ordinance shall become effective from and after
�e date of its passage as provided by the Charter of the City of Grapevine,
Te�as, and it is accordingly so ordained.
