EMERGENCI'.
BE IT ORDAINED BY THE CITY COUNCIL OF 'I�-i E CITY OF
GRAPEVINE, TEXAS:
SECTION 1. That Title 9, Chapter 3 of the Cit�r Code of Grapevine,
Te�as, be, and the same is hereby amended b5- adding the following paragraph:
, "Speed greater than forty-five (4� miles ner hour

on designated streets not reasonable and prudent, "
Upon the basis of an engineering and traffic investigation submitted to
the City Council, the City Council hereby finds and determines that a maximum
prima facie speed limit heretofore set for a public street, roadway or highway
set forth below in the City of G rapevine, Texa s, is not rea sonable or prudent
under the conditions found to exist in the City of Grapevine, Texas, at said
location, therefore, the City Council hereby finds, determines and declares that
- when no special hazard exists that requires a lower speed for compliance with the
provisions of this ordinance andJor the laws of the State of Texas, no person
shall operate or drive any vehicle on the public streets, roadways or highways
set forth below in the City of Grapevine, Texas, at a greater speed than
"�' forty-�ive ( 4s ) miles per hour, unless otherwise provided by this
ordinance or subsequent ordinance, and any speed in excess of forty-five
( 4s ) miles per hour, unless otherwise provided by this ordinance or subsequent
ordinance, shall be prima facie evidence that the speed is not reasonable or
prudent and is unlawful,

� SECTION 2, This ordinance repeals those provisions, and only those
_-. - � provisions, of all ordir�a nces and sections of the City Code of Grapevine, Texas,
in conflict with the provisions h�reof, but shall in no wa5r repeal any provisions
of any ordinance or section of the City Code of Grapevine, Texas, establishing
a "School Zone" in an area covered b5T this ordinance.
SECTION 3. The City Manager is hereby directed to cause appropriate
signs to be posted at reasonable intervals to apprise the public of the speed
limit and give them notice thereof.

SECTION 4. Any person violating or failing to comply with any provisions
of this ordinance shall be fined upon conviction not less than Qne Dollar
"�`"" (�1. 00) nor more than Two Hundred Dollars (�200. 00),
SECTION S, It is hereby declared to be the intention of the City Council
of the City of Grapevine, Texas, that the sections, paragraph�, sentences,
clauses and phrases of this ordinance are severable and if any phrase, clause,
sentence, paragraph or section hereof should bP cleclared unc�nstit��r;r,nal, such
unconstitutionality or invalidity shall not affect any of the remaining phrases,
clauses, sentences, paragraphs or sections of this ordinance, since the same
would have been enacted by the City Council without the incorporation in this
ordinance of any such unconstitutional or invalid phrase, clause, sentence;
paragraph or section.

SECTION 6. The fact that.that the City Code of Grapevine, Texas,
and other ordinances and regulations of•the City of Grapevine, Texas, are
inadequate to control the speed of vehicles within the corporate limits of the
City of Grapevine, Texas, creates an emergency for the immediate presenTati�n
of the public business, property, health, safety, and general welfare of the
public which requires that this ordinance shall be.come effective frorn and after
the date of its passage as provided by the Charter of the City of Grapevine,
Texas, and it is accordingly so ordained,
