HomeMy WebLinkAboutORD 1974-027 . . � ORDINANCE NO. 7"�-2.7 AN ORDINANCE PROHIBITING THE MOVING OF ANY HOUSE, BUILDING OR STRUCTURE FROM ONE LOCATION WITHIN OR WITHOUT THE CITY OF GRAPEVINE TO A LOCATION WITHIN THE CITY OF GRAPEVINE WITHOUT FIRST OBTAINiNG A " PERMIT THEREFOR FROM THE CITY COUNCIL OF THE CITY � � OF GRAPEVINE; PROVIDiNG FOR AN APPLICATION TO BE MADE TO THE BUILDING INSPECTOR OF THE CITY OF GRAPEVINE FOR A PERMIT TO MOVE A BUILDING WITHIN THE CORPORATE LIMIT'S;� OF THE CITY OF GRAPEVINE ; PROVIDING FOR A PUBLIC HEARING BEFORE THE CITY COUNCIL OF THE CITY OF GRAPEVINE; PROVIDING FOR PUBLIC NOTICE OF SUCH PUBLIC HEARiNG BEFORE THE CITY COUNCIL; PROVIDING FOR A PERMIT TO MOVE A HOUSE, BUILDING OR STRU CTURE TO BE ISSUED BY THE CITY COUNCiL UPON SUCH CONDITIONS, REQUIREMENTS OR RESTRICTIONS AS THE CITY COUNCIL � � � SHALL DETERMINE; PROVIDING FOR A PENALTY FOR A � � VIOLATION OF THE ORDINANCE OF A FINE OF NOT LESS � THAN QNE DOLLAR ($l, 00) NOR MORE THAN TWO HUNDRED DOLLARS ($200. 00); PROVIDING FOR THE REPEt�L OF CONFLICTING ORDINANCES; PROVIDING A SAVINGS CLAUSE; AND DECLARING A N EMERGENCY. ,�....�, � �, . i � � BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF � . � GRAPEVINE, TEXAS: SECTION l. The foliowing words and phrases when used in this ordinance ' shall have the meanings respectively ascribed to them by this section; � CITY shall mean the City of Grapevine, Texas, �, BUILDING INSPECT�R shall mean the building inspector of the City of G rapevine. PERSON shall mean a human being, his heirs, execut ors, administrators or assigns, and also includes a firm, partnership, association or corporation, it or their successors or assigns, or the agent of any of the aforesaid, STREET OR PUBLIC STREET shall include any street, alley, avenue, lane, boulevard, drive, public place or highway commonly used for the purpos� of travel within the corporate limits of the City. SECTION 2. A. It shall be unlawful for any persvn m move or relocate any ,�. � old or used house, any old or used building or structure, or any assem'r�Ied �.._;. portion of such house, building or structure from a location within or without the City to another location, lot or tract of land in the City without first obtaining a permit therefore from the City Council Qf the City of Grapevine, B. Any person, firm or corporation desiring to move or relocate any old or used house, building or structure from a location within or without the City to another location, lot or tract of land in the City shall file an appiication with the Buiiding Inspector requesting that he be permitted to move or relocate a particular house, building or structure upon a lot or tract of land in the City of Grapevine, Upon the filing of the �gplicat�on, the applicant shall pay the Building �� G to hel Inspector the sum of �1/„v�y �v/l�l/ts �� 9�° � � p pay the cost of processing the application to the City Council and the cost of � maili.ng notices required by this ordinance, . C. The application shall contain the following information; l, Name, address and telephone number of applicant. 2. Description and size of the hous e, building or structure to be moved, together with a picture thereof, � 3, Legal description of the lot and the local address upon which the house, building or structure is to be moved or relocated �, � on if a permit is granted by the City Council. , 4. A drawing or plot plan showing the dimensions cf the lot or tract of land upon which the house, building or structure is to be moved or relocated, and the location of existing buildings or structures upon Lhe lot, if any, together with the location of existing buildings or structures upon adjoining lots, D, Upon the filing of the application, the Building Inspector shall investigate the application by inspecting the house, building or structure, to be �' moved or relocated upon the lot or tract of land and the lot or tract of land upon which the house, building or structure is to be located. He shali then advise the City Council a s to whether the hot.s e, building or structure meets the requirements of the Building Code, and other applicable ordinances of the City of Grapevine, �. � , and whether or not the lot and house, building or structure, if aiiowed �o be � moved onto the designated lot or tract of land, wouid meet all of the requirements of�the Building Code and other applicable ordinances of the City of Grapevine, E, After receiving the application and report of the Building Inspector, the City Council shall set a date for a public hearing on the application. Public notice of the public hearing shall be sent to owners of real property lying within two hundred feet (200') of the lot or tract of land upon which the house, building or structure is to be located, such notice to be given, not less than ten (10) days before the date set for hearing, to all such owners who have rendered their property for city taxes or as the ownership appears on the last approved City Tax ""�� Rolls. Such notice may be served by depositing the same, properly addressed and postage prepaid, in the United States Post Office. � F. After such public hearing, the City Council shall either grant or deny the request taking into consideration the location and size of the lot a upon which the house, building or structure is to be located, the size and construction of the house, building or structure to be moved., the population density in the area, the locatzon and use of buildings, structures and land in the area; provided, that no request shall be granted if the City Council shall find: _ l. That the house, building or structure to be moved does not � rrieet all of the requirements of all applicable ordinances of the City of Grapevine. 2. That the lot or t�act of land with the house, building or structure thereon would not meet all of the requirements of the applicable ordinances o� the City of Grapevine, � 3, That the house, building or structure to be moved ha s deteriorated more than fifty per cent (50�) of its original value by virtue of fire or by virtue � of age or normal wear and tear or other elements, 4, Tha� the moving of such house, building or structure upon the lot or tract of land would cause injury to persons or property or damage to the streets or other public improvements. G. If the City Council shall grant the request to move such house, building or structure, the City Council by resolution shall cause a special permit to be issued authorizing the moving of such house, building or structure upon the lot or tract of land under such conditions, requirements or restrictions as the City Council si�all determine. � �, The Bu�lding Insp�ctor shall ;�ot �ssae a Certifica�e of n�ca�anc;� ,� for the use of such house, building or structure until it complies with alI require- ments of ail applicable ordinances of the City of Grapevine. SECTION 3, The United States Government, the State of Texa s, the County of Tarrant, the City of Grapevine, the Grapevine Independent School Di.strict or any governmental agency of the federal, state, county or municipal government, are hereby exempted from complying with the provisions of Section 2 of this ordinance; provided however that each governmental agency desiring to move a building shall first notify the City of Grapevine Building Inspector in writing of such pr��posed move and secure the approva� of the City of Grapevine Buildi,ng �"� Inspector of such proposed relocation of such building. SECTION 4. Any person violating or failing to comply with any pro�rision � of this orclinance shall be fined upon conviction not less than One Dollar nor more than Two Hundred Dollars, and each day any violation or non-compliance continues shall constitute a separate offense, SECTION 5, This ordinance repeals those provisions, and only those provisions, of all ordinances and sections of the City Code of Grapevine, Texas, in conflict with the provisions hereof. r ' SECTION 6, It is hereby declared to be the intention of the City Council of the City of Grapevine, Texas, that the sections, paragraphs, sentences, clauses and phrases of this ordinance are severable and if any phrase, clause, sentence, paragraph or section hereof should be declared unconstitutional, such unconstitu- � , tionality or invalidity shall not affect any of the remaining phrases, clauses, sentences, �., �. paragraphs o.r sections of this ordinance, since the same would have been enacted by the City Council without the incorporation in this ordinance of any such unconstitutional or invalid phrase, clause, sentence, paragraph or section, SECTION 7. The fact that the City Cod.e of Grapevine, Texas, and other ordinances ancl r�gulations of the City of Grapevine, Texas, are inadequate to control the moving of houses and other buiidings and structures within the corporate limits of the City of Grapevine, Texas, creates an emergency for the immediate preservation of the public business, property, health, safety, and general welfare of the public which requires that this ordinance shall become effective from and after the date of its passage as provided by the Charter of the City of Grapevine, ,�._� .
