HomeMy WebLinkAboutORD 1973-037 ORDINANCE NO. 73-37 AN ORDINANCE AMENDING TITLE 4, CHAPTER 11, SECTION 1 OF THE CITY CODE OF GRAPEVINE, TEXAS BE DELETING THE PRESENT DEFINITION OF BILLI,ARD HALL AND BY' ADDING ANOTHER DEFINITION OF BILLIARD HALL; PROVIDING A SEVERABILITY CLAUSE; AND DECLARING AN EMERGENCY. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF GRAPEVINE, TEXAS: SECTION 1. Title 4, Chapter 11, Section 1 of the City Code of Grapevine, Texas, is hereby amended by deleting only the present definition of "Billiard Hall" and adding only the following definition: "Billiard Hall shall mean and include any building, room, place or establishment of any nature or kind whatsoever and by whatever name called, where billiard tables or any type of three or more coin-operated machines used primarily for purposes of amusement or entertainment are operated for profit whether the same be operated in connection with any other lawful business or not, save and except religious, charitable or educational organizations authorized to operate in that capacity under the laws of the State of Texas. This definition shall specifically �xclude coin operated machines commonly known as "jukeboxes" if said machine amuses and entertains by playing recordings of music only and does not have any other amusi�g or entertaining feature." SECTION 2. It is hereby declared to be the intention of the City Council of the City of Grapevine that the sections, paragraphs, sentences, clauses and phrases of this ordinance are severable and any phrase, clause, sentence, paragraph or section hereof should be declared unconstitutional, �- : such unconstitutionality or invalidity shall not affect any of the remaining a phrases, clauses, sentences, paragraph or sections of this ordinance, since ,�,,..� the same would have been enacted by the City Council without the incorporation in this ordinance of any unconstitutional or invalid phrase, clause, sentence, paragraph or section. SECTION 3. The fact that the present ordinances and regulations of the City of Grapevine are inadequate to control the operation of billiard halls within the corporate limits of the City of Grapevine, creates an emergency for � the immediate preservation of the public business, property, health, safety and � general welfare of the public which requires that this ordinance shall become effective from and after the date of its passage as provided by the Charter of the City of Grapevine, and it is accordingly so ordained.
