HomeMy WebLinkAboutORD 1973-052 ORDINANCE NO, 7�_52 AN ORDINANCE EXPANDING THE PARTICIPATI4N IN THE TEXAS MUNICIPAL RETIREMENT SYSTEM BY THE CITY OF GRAPEVINE, TEXAS; AND AMENDING TITLE I, CHAPTER I3 (JF THE CITY CODE OF THE CITY tJF GRAPEVINE � AC�ORDINGLY; PRQVIDING FOR PARTICIPATICJN IN THE SUPPLEMENTAL BENEFITS FUND OF THE TEXAS MUNICIPAL RETIREMENT SYSTEM BY ALL DEPARTMENTS OF THE CITY GOVERNMENT WHICH PARTICIPATE IN THE TEXAS MUNICIPAL RETIREMENT SY'STEM; FROVIDING FC3R PAYMENT OF THE CITY`S CONTRIBUTIQNS QN ACCCIUNT OF SUCH PARTICIPATION; PROVIDING FQR INCREASED MUNICIFAL C4NTRIBUTIONS TO THE CURRENT SERVICE ANNUITY� RESERVE AT RETIRElVIENT OF THE EMPLOYEES C7F THE CITY OF GRAPEVINE, TEXAS; AND PR4VIDING FC3R AND GRANTING "ANTECEDENT SERVICE CREDIT" AND "SFECIAL � PRI(3R SERVICE CREDIT" AT THE RATES HEREIN SPECIFIED, TO QUALIFYING EMPLOYEES OF THE CITY OF GRAPEVINE, TEXA S. WHEREAS, the Constitution of the State of Texas was amended on November 7, 1944, by the addition of Section 51-f, Article III, wha.ch authorized the Legislature ta establish a state-wide retirement and disability pension system for ci�y employees; and WHEREAS, Chapter 7S, Acts SOth Legislature (1947) as amended, established the Texas Municipal Retirement System, and authorizes the governing body of each city or town to elect, at its option to have one or more of the city depa rtments pa rticipate in such System; a nd WHEREAS, the governing body of the City of Grapevine, Texas, finds that it wiil be in the public interest for the city to expand its employee's participation in the Texas Municipal Retirement -� Sys�em as hereinafter pravided, and to amend Title l, Chapter 13 of the City Code accordingly; and WHEREAS, the governing boc�' of Ghe City of Grapevine, Texas, has heretofore elected to have the employees of designated department� of the city government participate in the Texas Municipal Retirement System (such departments being hereinbefore calied "participating departmen�s"); and WHEREAS, Chapter 312, Ac�Cs Regular Session, 56xh Legislature provides for esCablishment in said System of a Supplemental Benefits Fund to provide for additional disability benefits for service connected disabilities; and WHEREAS, �he governing body of �he Ci.ty of Grapevine, Texa�, finds that it will be in the public interest to provide for participation of employees of such departments i.n said Supplemental Benefits Fund; �, . NOW, THEREFORE, ABOVE FREMISES CONSIDERED: �"°`'.' gE IT ORDATNED BY THE CITY COUNCIL QF THE CITY QF GRAPEVINE, TEXAS: SECTION l. That Title l, Chapter 13 of the City Code of zhe Ca.ty of Grapevine is hereby amended as follows; ""1-I3-1, That, on beha lf of the Ci.ty of G rapevine, Texa s, the City Council hereby exercises its option and elects to have the city and all of the employees of all depar�ments now existing or hereafter established excep�Cing the Fi.re Depa rtment pa rticipate in the Texa s Municipal Retirement System as provided in �hapCer 75, Acts of the S4th Legislature, as amended, (Article b243h of Vernon's Civil Statutes of Texas); and all of the benefits and �.,.li obligations of such System are hereby accepted as to such employees, "The CiCy Manager is hereby direc�ed to notify the Board of Trustees of the Texas Municipal Retircment System that the City of Grapevine, Texas, has expanded i�s participation and have the employees of the above departments participate in said System. " SECTION 2. That the following new sections a re added to Title I, Chapter I3 of the City Code of the City of Grapevine, Texas: "1-13-S. The Ci.ty of G rapevine, Texa s, by its City Council hereby elects to have the e;nployees of all participating departments of said city (as �bove _ defined) participate in and be covered by the Supplemental Benefi�s Fund of the Texas Municipal Retirement System, as provided by Chapter 3i2, Ac�s Regular �:,,.,� Sessian, S6th Legislature; and alI the benefits and obligations of participation in said Fund are hereby accepted by the City as to such employees. "1-3-6. The City Manager is hereby directed to notify the Board of Trustees of the Texas Municipal Retirement System that the City of Grapevine, Texas, has elected to participate and have the employees of the above mentioned departments participate in the Supplemental Benefits Fund of said System. "1-3-7. Each person who becomes an employee of any participating department on or after the effective date of participation of such department in said Fund shall as a condition of his employment be covered into the Supplemental Benefits Fund of s�d System, The City of Grapevine, Texas, may in the future refuse to add new departments or new employees to said Fund, but shall never discontinue as to any members who are covered into the Fund. "1-3-8. The City Secretary is her�by directed to remit monthly to the Board of Trustees of the Texas Municipal Retirement System at its office in Austin, Texas, as the City's contributions to the Supplemental Benefits Fund of the Texa s Municipal Retirement System, such percentage of ea rnings of the �., ., above mentioned employees said City as may be fixed by the Board of Trustees of the Texa s Municipal Retirement System, provided that the rate of conteribution to said Fund shall not exceed one-half of one percentum (1 J2%) of the earnings of the employees of said City who are covered under said Fund; and such official shall make for the City such reports as the Board of Trustees of the Texas Municipal Retirement System may prescribe, "1-3-9. That effective January 1, 1974, for each month of current service thereafter rendered by each of its employees who are members of the Texas Municipal Retirement System, the City will contribute to the current service annuity reserve of each such member at the time of his retirement, a sum that is 200� "�' ' of such member's accumulated deposits for such month of employment; and said sum shall be contributed from the City's account in the Municipality Current �"°� Service Accumulation Fund, "1-3-10. Each person who is an employee of the City of Grapevine on the 31st day of December, 1973 , and who is at that date a member of the Texas Municipal Retirement System shall be allowed, and, upon the terms and conditions pres�ribed by Sec, XVI of Article 6243h, Vernon's Texas Civil Statutes, as amended by Chapter 371, Acts Regular Session, 6].st Legisiature, is hereby granted, effective on the date last above mentioned, "antecedent service credit" (as that term is defined in said Act) calculated on the basis of one hundred per cen� (I40�) of each current service deposit actually made by such person with the �� Texas Municipai ReCirement System during each month of current service � Ty performed for this eity prior to the 3lst day of December, 1973. "Each person who is an employee of the City of Grapevine on the 31st day of December, 1973, and who at said date is a member of the Texas Municipal Retirement Sy�tem and who holds in �aid System an effective pra.or service certificate granted by reason of service performed for this City prior to its participation in said System, shall be allowed and is hereby granted {upon the terms and conditions pres�ribed by Sec. �V of Article 6243h, Vernon's Texas Civil Statu�es as amended by Chapter 371, Acts of the Regular Session, blst Legislature) a "Special Prior Service Credi.t't in an amount equivalent �o the accumuiation at interest, as provided in said Act, of a series of monthly payments of five per cent (5 j) of the member's '�verage prior service compensation" for the .�... � number of months of prior service certified to in such member`s prior service certificate. The special prior service credit herein provided for shall be in addition to the prior service credit heretofore allowed such member. "Any person who was employed by the City of Grapevine prior to December 3I, 3.973, whose membership in Texas Municipal Retirement System by reason of such service has not terminated, and who on said date is absent from service in the employment of the city, shall be entitled to antecedent service credi� and to special prior service credit in the amaunt (if any} he would have been allowed under the above paragraphs had he been in active service on said date, provided such person , ��r� again becomes an employee of the City before termination of his said membership in Texas Municipal Retirement System and within five years from the 31st day of ,�,.,�, December, 1973, and provided such person thereupon continues as an employee of a participating department of the City of Grapevine for a period of five �5} consecutive yea rs.
