TO "I-1" LIGHT INDUSTRIAL DISTRICT; CORRECTING THE OFFICIAL ZONING MAP; PRESERVING ALL OTHER PORTIONS OF THE ZANING ORDINANCE; PROVIDING A SEVERABILITY CLAUSE; DETERMINING THAT THE PUBLIC INTEREST, MORALS AND GENERAL WELFARE DEMAND A ZONING CHANGE AND AMEND- , MENT HEREIN MADE; AND PROVIDING A PENALTY. �..,,. ��� ��:.:� WHEREAS, applicatio�s were made to amend the Of�icial Zoning Map, City af G��pevine, Texas , by making applications f�r same with the Planning and Zoning Commissian af the City of Grapevine, �Texas, as required by state statutes and the zoning ordinances af the City of �rapevine, Texas, a�d alI �he legal requirements, conditions and pre-requisites havi�g been complied with, the case having came bef�re the City Gouncii of the City of �rapevine, Texas , aftex all legal notices, require- ments, conditians and pre-requisites having been camplied with; and, Wt�iEREAS, the City Council of the City of Grapevine, Texasx at a public hearin� called by the City Cauncil did consider the followir�g factors in making a determination as ta whether these requested changes should be granted or denied; safety af the motoring pub3ic and the pedestrains using the facilities in the area immediately suarrounding the sa.te; safety from fire hazards and measure� for fire control, protection of adjacent property �xom flood or water da.mages , noise producing elements and glare of the vehicular and stationary lights and effect of such lights an established character of the neighborhood, location, lighting and types of si.gns and relation of signs to tzaff�.c control and adjacent property, street size and adequacy of width for traffic reasonably expected to be generated by the proposed use around the site and in the immediate neighbaarhood, adequacy of parking as determiz�ed by requirements af this ardinance for off-street parking facilities, locat�,on of ingress and egress points faz parking and off-staceet loading spaces, and pxotection of public health by surfacing on a12 parking areas to control dust, effect an the promotion of health and the general welfare, effect on 3ight and air, the effect on the ov�r-crowding of the land, the effect on the concen- tration of popu3ation, the effect on the transportation, water, sewerage, schoals, parks and ather public facilities, and, WHEREAS, the City Cauncil af the Ci.ty af Grapevine, Texas, at a public he�.ring called by the City Council o.f the C?.tY af Gzapevine, Texas, did cansider the fa].lowing �actc�rs in making a de�ermination as tca whethex tha.s requested change should be granted or denied; effect on the congesta.on of the streets, the fire haxards, panics and other dangezs possa.bly present in the securing of safety from same, the effect an the� promotion of health and the gerzeral welfaxe, effect on adequate light and air, the effect on the over-crowding af the la.nd, the effect c�n the concentaration on papulation, the effect on the transportation; water, sewerage, schools, parks and other public facilities; aad, WHERBAS, the City Council fur�her considered amc►ng other things the character of the distxict and its pecuZiar suitability far particular uses and �+rith the view to canserve the value of buildings, encourage t�ae mast appropriate use of land throughout this city; and, WHEREAS, the City Counczl of the City of Grapevine, 2exas, does find that there is a public necessity for the zoning change, that the public demands it, that the public interest clear2y requires the a�end- �ent, that the zoning changes do not unreasonably invade the rights of those who bought or �mproved prope�ty wi.th reference to the classificatian which existed at the time their �riginal investment �as made; and, WHERF.A.S, the City Cauncil of the City of Grapevine, Texas, does find that the change ir� zoning lessens the congestian in the streets, helps secure saf�ety from fire, panic and other dangers ; promotes health and the geneXaZ welfare; pxavides adequate light and air; prever�ts the over-crowding of land; avoids undue concentratican af populatian ; r`acilitates the adequate pxovisions o�' tra;�spartation, water, sewerage, schools, pa.rks and other public requixements; and, WHEREAS, the City Cauncil of the City of Grapevine, Texas, has determined that thexe is a necessity and need for this change in zoning and has also fcaund and determi.n ed that there has been a change in the conditions af the praperty surzounding az�d in close proximity to the propexty requested for a change since tha.s paroperty was originally elassified and therefore feels that a change in zoning cla�sification for the particular piece af property is needed, is called for , and is in the best interest of the public at large, the citizens of the City af Grapevine, Texas, and helps pramote the general health, safety anci welfare of this community; NflWf THEREFORE., BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF GRAPEVINE, TEXAS: SECTION 1 . That Ordinance No. 70-10, a Zoning Ordinance of the City of Grapevine, Texas , passed on April 7, 197p, be, and the same is amended and changed in that the use of the following described property, to-wit: TRACT (A) : All that certain lot, tract, or parcel of land �,x,,,, lying and being situated in Tarrant County, Texas, and beinq described as follows: Being a part of the Henry Suggs Survey, Abstract No. 1415, the James Gibson Survey, Abstract No. 586, and the James Gibson Survey, Abstract No. 58'7, and also being a part of Tract 1 , a 96.548 acre tract, and Tract 2, a 195.659 acre tract, as described in deed filed March 27, 1969, and recorded in Volume 4701 , Page 1g2 and 193, of the Deed Records of Tarrant County, Texas and being more particularly described by metes and bounds as follows: BEGINNING at a point in the present Northwest line of State Highway 121 , a 100 foot right-of-way, said point being South 44 degrees 12 minutes West 305.70 feet from the Southeast corner of said 195.659 acre traCt; THENCE South 44 degrees 12 minutes West 1845.50 feet along said present Northwest line of State Hiqhway 121 to a fence corner, being t1�e South corner of said 96.548 acre tract; THENCE North 88 degrees �2 minutes 02 seconds West 1367.51 feet along the Southwest side of said pro to the present center line of the un dedicated County Road, having a right-of-way of 40 feet more or less, for a corner; THENCE North 30 degrees 32 minutes East along said centerline a distance of 380 feet, more or less, to the West corner of a previously described 131 .348 acre tract of land for a corner; THENCE South 30 deqrees 04 minutes 58 seconds East 2874.96 feet to the POINT OF BEGINNING. which is presently zoned "R-1�� under Ordinance ���::;.� No. 70-7.0, is changed to "C-2�' Community Business District. The City Manager is hereby directed to correct the official zoning map of the City of Grapevine, Texas , to reflect the herein change in zoning. SECTION 3. That in all other respects the use of the tract or tracts of land herein above described shall be subject to all the applicable regulati.ons cnntained in said City of Grapevine zoning ordinancp and all other ap�licable and ; pertinent ordinances of the City o.f_ Grapevine, Texas . SECTION 4. That the zoning regulations and districts as herein established have been made in accordance with the comprehensive plant for the purpose of promoting health , safety, morals and the general welfare of the community. They have been designed, with respect to both present conditions and the conditions reasonably antici�ated to exist in the foreseeable future, to lessen congestion in the streets; to secure safety from fire, panic, flood and other dangers; provide adequate light and air ; to prevent over-crowding of land, to avoid undue concentration of population; facilitate the adequate provisions of trans- poztation, water , sewerage, drainage and surface water , parks and other public requirements , and to make adequate provisions for the normal business, commercial needs and development of the community. They have been made with reasanable consideration, among other things of the character of the district, and its pecul.iar suitability for the pa.rticular uses and with a view of conserving the value of buildings and encouraging the most appropriate use of land throughout the community. SECTION 5. This ordinance shall be cumulative of all other ordinances of the City of Grapevine, Texas, affecting zoning and shall not repeal any of the provisions of said ordinances except in those instances where provisions of those ordinances which are in direct conflict with the provisions of this ordinance. SECTION 6. That the terms and provisions of this ordinance shall be deemed to be severable and that if the validity of the zoning affecting any portion of the tract or tracts of land described herein shall be declared to be invalid, the same shall not affect the validity of the zoning of the balance of the tract or tracts of land described herein. SECTION 7. That any person , firm or corporation violating any of the terms and provisions of this ordinance shall be subject to the same penalties provided for in Ordinance No. 70-10, Zoning Ordinance of the City of Grape�ine, Texas.
