HomeMy WebLinkAboutORD 1971-026 ORDINANCE NO. 71-26 AN ORDINANCE REQUIRING ALL PE RSONS IN THE BUSINESS OF ENTERTAINING THE GENERAL PUBLIC AND CHARGING ADMISSION FEES TO OBTAIN A PERPZIT TO OFFER SUCH ENTERTAINMENT WITHIN THE CITY; PROVIDING RESTRICTIONS FOR THE ISSUANCE OF SUCH PERMITS; PROVIDING FOR REVOCATION; PROVIDING FOR A SAVINGS CLAUSE; AND PROVIDING FOR AN EME RGENCY. WHEREAS, various gatherings of a large number of persons for the purpose of entertainment have occurred in the area; WHEREAS, the City Council has found that the public health and welfare of the people of Grapevine demands minimum regulations of such entertainment events; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF GRAPEVINE, TEXAS, THAT: SECTION I: PERMIT REQUIRED: All persons in the business of entertaining the general public and charging admission fees shall file an application with the City Secretary for a permit to offer such entertainment. SECTION II FAILURE TO OBTAIN A PERMIT; VIOLATION: Any person allowing, promoting, conducting, or holding such entertainment without first obtaining a permit shall be acting in violation of this Chapter and the same shall constitute a public nuisance and a breach of the peace. Additionally, each person, operating without a permit shall be fined not less than one dollar ($1. 00) nor more than two hundred dollars (200. 00) for each day of operation. SECTION III APPLICATION FOR PERMIT: The application for the permit shall be filed not less than thirty (30) days before the first performance and shall contain the following information: (A) The name of the applicant. (B) The address of the applicant, or the applicant' s agent. (C) The date or dates of the proposed entertainment. (D) The kind or type of entertainment. (E) The place where the entertainment will be held. (F) The total off street or highway parking spaces . (G) The total capacity per capita of the facility where the entertainment will be held. (H) The number of restrooms available within the facili�y where the entertainment wi11 be h�ld. (I) An accurate drawing or plat showing ingress and egress and showing a fire exit plan. (J} The time and hours of the entertainment. SECTION TV RESTRICTIONS: All entertainment must be held in the facility named in the application. . The City Secretary or �he City Council shall have the right to refuse ta grant a permit when the health, safety, and welfare of the citizens of the City are endangered by traffic, inadequate sanitatian facilitiesr or ather health hazards, passib3e violence, illegal narcotics sale or use, immoral conduct, illegal conduct, or any ather similar problem or hazard. � SECTION V REVOCATION: A violation of any pravision of this Chapter or a failure to comply with all infarmation contained in the appl�cation shall be grounds for withdrawing the permit without a refund. SECTION VI It any section, paragraph, subdivision, clause, phase or pravision of this Ordinance shall be invalid or unconstitutional, th.e same shall nat affect the validity of this Ordinance as a whole ar an� part af the pravisions thereaf though �he parts so decided to be invalid or unconstitutional. sECTzoN vzz The health and welfare and preservation of the public health, safety and comfort of the citizens of Grapevine requires �he immediate passage a� �his Ordinance and the same shall �ake effect immedia�ely from and after its passage and it is accordingly so ordained.
