WHEREAS, Section 167 and 169 of Article XIX, R.C.S. 6701d, Uniform Act Ttegulating Traffic on Highways, provides that whenever the + governing body of the City shall determine upon the basis of an engi- neering and traffic investi.gation that any prima facie speed therein set forth is greater or less than is reasonable or safe under the con- ditions found to exist at any intersection or other place or upon any part of a street or highway within the City, taking into consideration the width and condition of the pavement and other circumstances on such portion of said street or highway, as well as the usual traffic thereon, said governing body may determine and declare a reasonable and safe prima facie speed limit thereat or thereon by the passage of an ordinance, which shall be effective when appropriate signs giving notice thereof �re erected at sueh intersections ar oth�r place d� par� of the stir�et or highway, now therefore, ,�:.a BE IT ORDAINED by the City Council of the C�Lty of �;,� Grapevine , Texas: SECTION 1. The following prima facie speed limits hereafter indicated for vehicles are hereby determined and declared to be reasonable and safe; and such speed limits are hereby fixed at the rate of speed in- � dicated for vehicles traveling upon the named streets and highways , or parts thereof, described aa fallows: ' Control 364-01 , State Highway 121 Tarrant County � ° Fram Station 1197+00 (2242 feet southwest of the intersection of proposed State Highway 121 with Temporary Route) northeast� 0.700 mile to Station - " 1234+00 (1458 feet northeast of the intersection of proposed State Highway 121 with Temporary Route) at 40 or 50 or 60 miles per hour as determined by Resident Engineer in charge of construction,� depending on the conditions of the . job under construction. , „�,,� rr«;:.� r-3 , - y '. '.. � a CONSTRUCTION SPEED ZONE ORDIt�tANCE � » SECTION 2. The City Council of the City of Grapevine declares and fixes the above maximum speed limits and the Diskrict Engineer ;: is hereby authorized to proceed with the erection of the appropriate signs. SECTION :3. It is hereby declared that the construction project on State Highway No. 121 has necessitated the enactment of this ordinance for the safety o£ those traversing State Highway No. 121 in the City of Grapevine Therefore, the above regulations shall be in effect after the passage of.this ordinance and the erection of the proper signs; and, this shall remain in effect until the completion and acceptance of the said construction project by the Highway District Engineer or until such time as the construction project has progressed to a stage whereby, in the opinion of the Highway District Engineer, traffic may saiely travel the construction project, or portions thereof, at the rate of speed posted prior to the construction. The Highway District Engineer will have the authority to replace the construction speed zone signs with speed zone signs reestab- lishing the speed zoning prior to construction and the placement of such � signs shall be evidence of thc� governing speed zone or zones. The completion and/or acceptance of the said construction project by the Highway Distriet Engineer shall cancel the provisions of this ordinance and the Highway D�.s- � ,w trict Engineer shall be authorized to remove all such signs used in compl�.= ;. - ance with regulations set forth in this ordinance. SECTION 4. Any ordinance or any part thereof in direct conflict with this ` �'""" ordinance is hereby superseded and the part of the ordinance in conflict " herewith shall be null and void so long as this ordinance is in effect. How- ever, any ordinance or part of an ordinance superseded by this ordinance shall autamatically be reinstated in force upon the date of completion and/or acceptance of the said construction project, when this ordinance is no longer in effect. SECTION S. Any person violating any of the provisions of this ordinance shall be deemed guilty of a misdemeanor and upon conviction thereof shall be fined in any sum not more than two hundred dollars ($200) . SECTION 6. If any part of this ordinance be declared unconstitutionaT or � otherwise void by a court of competent jurisdiction, such decision shall in _ no way affect the validity of any of the remaining parts of this ordinance „ unless the part held unconstitutional or void is inseparable from, and indi- spensable to, the operation of the remaining parts. THE YEAR 1971 TO BE ASSESSED ON ALL TAXABLE PROPERTY WITHIN THE LIMITS OF THE CITY OF GRA.PEVINE, TEXAS: AND PROVIDING PENALTIES AND INTEREST FOR DELINQUENT TA?CES, AND PROVIDING FOR THE INTRA AND INTER-DEPARTNIENT AND FUND TRANSFERS, AND PROVIDING FOR THE INVESTNIENT OF IDLE FUNDS: WHEREAS, notice of a public hearing on the Budget for the City of Grapevine, Texas for the fiscal year 1971-72 was heretofore published at least five days in advance of said hearing, and 4JHEREAS, a public hearing was duly held and all interested persons were given an opportunity to be heard for or against any item therein, NOW, T�iEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF GRAPEVINE, TEXAS: SECTION l . __ That a tax is hereby levied upon all taxable property in the City of Grapevine, Texas for the year , 1971 , at the rate of $1 .35 per One Hundred Dollars ($100.00) valuation. , SECTION 2. That there shall be and. there is hereby levied the following taxes on each one hundred ($100.00) dollars valuation on all taxable property within the City af Grapevine , Texas , to be assessed and collected by the Tax Assessor and Collector for the year 1971, and said taxes are to be assessed and collected for the purpose hereinafter stipulated, to-wit : (a� For the General Fund levied on the $100.00 valuation .69 1/2% (b) For the Interest and Sinking Fund levied on the $100.00 valuation .30 1/2� TOTAL LEVY 100 % � . . 5 r SECTION 3. That the City Manager be and is hereby authorized to make intra and inter department fund transfers during the fiscal year as becomes necessary in order to avoid over expenditures of a particular account. SECTION 4. That the City Manager is authorized to invest any funds not needed for current use, whether operating funds or bond funds in United States Treasury Bills , Certificates of Deposit, Savings Accounts, and/or Time Deposit Open Account in Official City Depositories. Interest accrued from such investments may be deposited to the General Fund. � SECTION 5. Taxes levied by this ordinance shall be due and payable on October 1, 1971 , and shall become delinquent on the first day of February 1972, if unpaid; upon taxes becoming delinquent, a penalty of 10% of such delinquent taxes shall accrue on the first day of February. Interest upon delinquent taxes and penaTties shall accrue at the rate of 6% per annum commencing from the date of delinquency. The City of Grapevine is here- by authorized to adopt any and all legal remedies provided by the Revised Civil Statutes of the State of Texas and the Grapevine City Charter as provided in Article 9, Section 9.25 for the purpose of collecting delinquent taxes. SECTION 6. The fact that the fiscal year begins on October l, 1971 , re- • quires that this ordinance be effective upon its passage and adoption .to preserve the public peace, pro;perty, health and safety, and the rules requiring ordinances be read and passed on two separate dates is hereby suspended and this ordinance shall be in full force and effect from and after its passage and adoption.
