A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
GRAPEVINE, TEXAS,AUTHORIZING AND RATIFYING THE
EMERGENCY EXPENDITURE OF FUNDS FOR THE RAW
WATER PUMP #2 REPAIR, AUTHORIZING THE CITY
MANAGER TO EXECUTE SAID CONTRACT AND
DOCUMENTS; AND PROVIDING AN EFFECTIVE DATE
WHEREAS, the City of Grapevine, Texas, pursuant to the authority granted by
Texas Government Code, Chapter 252, Section 252.022 (a) (4) desires to obtain the
services from Pierce Pump Company for the emergency repair of the Water Plant Raw
Water Pump # 2; and
WHEREAS, the cost of the services performed by Pierce Pump Company is
$15,115.02.
NOW,THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
GRAPEVINE, TEXAS:
Section 1. That all of the above premises are found to be true and correct and
are incorporated into the body of this resolution as if copied in their entirety.
Section 2. That the City Council authorizes and ratifies the emergency use of
funds for repair of Raw Water Pump # 2 to Pierce Pump Company in the total amount of
$15,115.02.
Section 3. That the City Manager, or his designee, is authorized to take all steps
necessary to obtain the services of Pierce Pump for the repair of the Raw Water Pump.
Section 4. That if any section, article, paragraph, sentence, clause, phrase or
word in this resolution, or application thereof to any persons or circumstances is held
invalid or unconstitutional by a Court of competent jurisdiction, such holding shall not affect
the validity of the remaining portions of this resolution; and the City Council hereby
declares it would have passed such remaining portions of the resolution despite such
invalidity, which remaining portions shall remain in full force and effect.
Section 5. That this resolution shall take effect from and after the date of its
passage.
PASSED AND APPROVED BY THE CITY COUNCIL OF THE CITY OF
GRAPEVINE, TEXAS on this the 18th day of October, 2011.
