HomeMy WebLinkAboutItem 03 - CU14-45 & PD14-03 The Gatehouse in GrapevineTO: HONORABLE MAYOR, CITY COUNCIL MEMBERS AND THE PLANNING AND ZONING COMMISSION FROM: BRUNO RUMBELOW, CITY MANAGER SCOTT WILLIAMS, DEVELOPMENT SERVICES DIRECTOR MEETING DATE: JANUARY 20, 2015 SUBJECT: DEVELOPMENT SERVICES TECHNICAL REPORT OF CONDITIONAL USE APPLICATION CU14-45 AND PLANNED DEVELOPMENT OVERLAY PD14-03, THE GATEHOUSE IN GRAPEVINE APPLICANT: John Fegan PROPERTY LOCATION AND SIZE: The subject property is located at 670 Westport Parkway and is platted as Lots 1A, Block 1, The Gatehouse in Grapevine. The property contains 49.49 acres and has approximately 976 feet of frontage along Westport Parkway and 109 feet of frontage along Stone -Myers Parkway. REQUESTED CONDITIONAL USE, AND PLANNED DEVELOPMENT OVERLAY AND COMMENTS: The applicant is requesting a Conditional Use Permit to amend the previously approved site plan of CU12-33 (Ord. 2012-39) and PlannedDevelopment Overlav PD12-06 (Ord. 2012-40) for a nonprofit institution to be utilized as a women's shelter, specifically for the addition of a 1,683 -square foot chapel, a mail kiosk, additional narkinq and a community center deck. Conditional Use Request CU12-33 was approved at the August 21, 2012 meeting to allow for a multi -phase development of a non-profit institution to be utilized as a women's shelter. A Planned Development Overlay was established to include deviation from the building separation requirements and to allow residential uses in the "CC" Community Commercial 0:/ZCUJCUI4-45.4, PD14-03.4 1 January 14, 2015 (9:03AM) District. Zoning Change request Z12-10 approved at the same meeting rezoned the subject site to "CC" Community Commercial District. With this request the applicant proposes to revise the site plan by adding a 1,683 -square foot chapel, a mail kiosk, additional parking and a community center deck. The chapel will be utilized by the facility residents and will be located south of the residential units within the gated portion of the facility. The proposed deck will be located to the rear of the community center. Additional parking is being proposed adjacent to the community center to accommodate the chapel. Required parking for the proposed chapel is 19 -parking spaces; 21 -parking spaces are provided. The new mail kiosk and refuse container are proposed to be located in close proximity to the community center. Five new parking spaces are proposed to be added adjacent to the warehouse/general store. Originally approved as a multi -phase development with six residential structures proposed in the first phase, the development is fully under construction with plans to be able to accommodate 96 families by the spring of 2015. Please see the attached letter. The property is currently zoned "CC" Community Commercial District and is currently under construction for a women's shelter. HISTORY OF TRACT AND SURROUNDING AREA: The Stone property was not zoned when it was a part of unincorporated Tarrant County. When the property was annexed into the City on July 20, 1993, it was automatically zoned "R-20" Single Family. The Stone property since its annexation has remained zoned "R-20" Single Family and has remained undeveloped. Located to the south, the original Pavestone property and other surrounding areas were rezoned in the 1984 City Rezoning from "R-1" Single Family District to "PID" Planned Industrial Development. Z95-15 (Ord. 95-94) rezoned 7.975 acres from "R-20" Single Family District to "PID" Planned Industrial Development District. CU95-30 (Ord. 95-95) was approved to allow outside storage in conjunction with a manufacturing establishment. The only development to occur in the area is the existing Pavestone development. Council approved a revision to the Pavestone site plan at their November 18, 1997 joint public hearing (CU97-57; Ord. 97-124) specifically allowing a reduction in overall square footage of the future production facilities from 72,000 square feet to 55,403 square feet and allowed the addition of a new mixer housed within a 42 -foot high penthouse. The property to the east, formerly a portion of the A.C. Stone tract was rezoned to the "LI" Light Industrial District in November, 1996 (Case No. Z96-22, Ord. No. 96-91). The site was subsequently developed as the Westport Business Park. The property to the west was rezoned from "R-1" Single Family District to "PID" Planned Industrial Development District during the 1984 City Rezoning. Zone Change Z98-19, approved in August, 1998, rezoned a portion of the A.C. Stone Tract from the "R-20", Single Family District to the 0:2CUM14-45.4, PD14-03.4 2 January 14, 2015 (9:03AM) "PID", Planned Industrial Development District for the development of Frank Parra Dodge. The property to the north was rezoned from 1-1" Light Industrial District to "PID" Planned Industrial Development District during the 1984 City Rezoning. Zone Change Z86-15 rezoned the property from "PID" Planned Industrial Development District to "CC" Community Commercial District. At the January 18, 2000 meeting the subject tract and surround area comprising some 90 acres was rezoned from "R-20" Single Family District and "LI" Light Industrial District to "CC" Community Commercial District and "BP" Business Park District for future development. Near the subject property to the northwest Council approved a conditional use permit (CU06-45) at their October 17, 2006 meeting which allowed for a 121,000 square foot freight -forwarding warehouse and outside storage. This project was never developed. A special use permit (SU09-10) was approved by Council at their February 16, 2010 meeting to allow oil/gas well drilling on the site to the east specifically for four natural gas wells. An additional six natural gas wells were approved by the Site Plan Review Committee at their October 6, 2010 meeting establishing a total of 10 wells on the site. At the August 21, 2012 meeting City Council approved zone change request Z12-10 (Ord. 2101-38) to rezone 57.19 acres from "LI" Light Industrial District and "BP" Business Park District to "CC" Community Commercial District on the subject site and the adjacent property to the west. At the same meeting City Council approved conditional use permit CU12-33 (Ord. 2012-39) and planned development overlay PD12-06 (Ord. 2102-40) to allow for a non-profit institution specifically for a women's shelter and to deviate from the building separation requirements and allow residential uses in the "CC" Community Commercial District. SURROUNDING ZONING AND EXISTING LAND USE: NORTH: Dallas/Fort Worth International Airport SOUTH: "BP" Business Park District and "LI" Light Industrial District—Westport Business Park EAST: "LI" Light Industrial District—Westport Business Park and Dallas/Fort Worth International Airport WEST: "CC" Community Commercial District and "PID" Planned Industrial Development District—vacant property, Classic Chevrolet, Grapevine Dodge The subject tract is located within both "Zone A" Zone of Minimal Effect and "Zone B" Middle Zone of Effect as defined on the "Aircraft Sound Exposure: Dallas/Fort Worth Regional Airport Environs" Map. Few activities will be affected by aircraft sounds in "Zone A" except for sound sensitive activities such as auditoriums, churches, schools, hospitals, OlZMCU14-45.4, PD14-03.4 3 January 14, 2015 (9:03AM) and theaters. In "Zone B" the following uses may be considered only if sound treatment is included in building design: multifamily apartments, motels, office buildings, movie theaters, restaurants, and personal and business services. Single family residential and sound sensitive uses such as schools and churches should avoid this zone. The applicant's proposal is an appropriate use in this noise zone. The Master Plan designates the subject property as a Commercial land use. The applicant's request is not in compliance with the Master Plan. The request is to amend the previously approved site plan of CU12-33 (Ord. 2012-39) and PD12-06 (Ord. 2012-40) for a non-profit institution to be utilized as a women's shelter. More specifically the request is for the addition of a 1,683 square foot chapel, a mail kiosk, additional parking, and a deck for the community center with pond grading enhancements. The Gatehouse project began construction in the Fall of 2013. Infrastructure improvements including; grading, drainage, utilities, and paving were completed by the Spring of 2014. Vertical construction of the buildings commenced immediately and is still in progress. It is anticipated that all the buildings included in the original plan will be completed and permitted by Spring 2015. This includes a residential community capable of housing up to 96 families, a community/conference center, two in -neighborhood counseling centers, and a warehouse/storage building. adequacy of parking as determined by requirements of this ordinance for off-street parking facilities; location of ingress and egress points for parking and off-street locating spaces, and protection of public health by surfacing on all parking areas to control dust; effect on the promotion of health and the general welfare; effect on light and air; the effect on the overcrowding of the land; the effect on the concentration of population; the effect on the transportation, water, sewerage, schools, parks and other facilities; and WHEREAS, the City Council of the City of Grapevine, Texas, at a public hearing called by the City Council of the City of Grapevine, Texas, did consider the following factors in making a determination as to whether this requested conditional use permit should be granted or denied; effect on the congestion of the streets, the fire hazards, panics and other dangers possibly present in the securing of safety from same, the effect on the promotion of health and the general welfare, effect on adequate light and air, the effect on the overcrowding of the land, the effect on the concentration of population, the effect on the transportation, water, sewerage, schools, parks and other public facilities; and WHEREAS, all of the requirements of Section 48 of Ordinance No. 82-73 have been satisfied by the submission of evidence at a public hearing; and WHEREAS, the City Council further considered among other things the character of the existing zoning district and its peculiar suitability for particular uses and with the view to conserve the value of buildings and encourage the most appropriate use of land throughout this City; and WHEREAS, the City Council of the City of Grapevine, Texas, does find that there is a public necessity for the granting of this conditional use permit, that the public demands it, that the public interest clearly requires the amendment, that the zoning changes do not unreasonably invade the rights of those who bought or improved property with reference to the classification which existed at the time their original investment was made; and WHEREAS, the City Council of the City of Grapevine, Texas, does find that the conditional use permit lessens the congestion in the streets, helps secure safety from fire, panic and other dangers, prevents the overcrowding of land, avoids undue concentration of population, facilitates the adequate provisions of transportation, water, sewerage, schools, parks and other public requirements; and WHEREAS, the City Council of the City of Grapevine, Texas, has determined that there is a necessity and need for this conditional use permit and has also found and determined that there has been a change in the conditions of the property surrounding and in close proximity to the property requested for a change since this property was originally classified and, therefore, feels that the issuance of this conditional use permit for the particular piece of property is needed, is called for, and is in the best interest of the public at large, the citizens of the City of Grapevine, Texas, and helps promote the general health, safety and welfare of this community. ORD. NO. 2 NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF GRAPEVINE, TEXAS: Section 1. That the City does hereby issue a conditional use permit in accordance with Section 48 of Ordinance No. 82-73, the Comprehensive Zoning Ordinance of the City of Grapevine, Texas, same being also known as Appendix "D" of the City Code, by granting Conditional Use Permit CU 14-45 to amend the previously approved site plan of Ordinance No. 2012-39 (CU12-33)for a non-profit institution to be utilized as a women's shelter, specifically for the addition of 1,683 -square foot chapel, a mail kiosk, additional parking and a community center deck in a district zoned "CC" Community Commercial District Regulations within the following described property: Lot 1A, Block 1, The Gatehouse in Grapevine (670 Westport Parkway) all in accordance with a site plan approved pursuant to Section 47 of Ordinance No. 82-73, attached hereto and made a part hereof as Exhibit "A", and all other conditions, restrictions, and safeguards imposed herein, including but not limited to the following: None. Section 2. That the City Manager is hereby directed to amend the official zoning map of the City of Grapevine, Texas, to reflect the herein conditional use permit. Section 3. That in all other respects the use of the tract or tracts of land herein above described shall be subject to all the applicable regulations contained in said City of Grapevine zoning ordinance and all other applicable and pertinent ordinances of the City of Grapevine, Texas. Section 4. That the zoning regulations and districts as herein established have been made in accordance with the comprehensive plan for the purpose of promoting health, safety, morals and the general welfare of the community. They have been designed with respect to both present conditions and the conditions reasonably anticipated to exist in the foreseeable future; to lessen congestion in the streets; to secure safely from fire, panic, flood and other dangers; provide adequate light and air; to prevent overcrowding of land, to avoid undue concentration of population; facilitate the adequate provisions of transportation, water, sewerage, drainage and surface water, parks and other public requirements, and to make adequate provisions for the normal business, commercial needs and development of the community. They have been made with reasonable consideration, among other things, of the character of the district, and its peculiar suitability for the particular uses and with a view of conserving the value of buildings and encouraging the most appropriate use of land throughout the community. Section 5. That this ordinance shall be cumulative of all other ordinances of the City of Grapevine, Texas, affecting zoning and shall not repeal any of the provisions of said ordinances except in those instances where provisions of those ordinances which are in direct conflict with the provisions of this ordinance. Section 6. That the terms and provisions of this ordinance shall be deemed to be severable and that if the validity of the zoning affecting any portion of the tract or tracts of ORD. NO. 3 land described herein shall be declared to be invalid, the same shall not affect the validity of the zoning of the balance of the tract or tracts of land described herein. Section 7. That any person violating any of the provisions of this ordinance shall be deemed guilty of a misdemeanor and upon conviction thereof shall be fined in a sum not to exceed Two Thousand Dollars ($2,000.00) and a separate offense shall be deemed committed upon each day during or on which a violation occurs or continues. Section 8. That the fact that the present ordinances and regulations of the City of Grapevine, Texas, are inadequate to properly safeguard the health, safety, morals, peace and general welfare of the inhabitants of the City of Grapevine, Texas, creates an emergency for the immediate preservation of the public business, property, health, safety and general welfare of the public which requires that this ordinance shall become effective from and after the date of its final passage, and it is accordingly so ordained. NO. 4 PP i q-6-3 G 476 0S1�5 WHEREAS, an application was made requesting issuance of a planned development overlay by making applications for same with the Planning & Zoning Commission of the City of Grapevine, Texas, as required by State statutes and the zoning ordinance of the City of Grapevine, Texas, and all the legal requirements, conditions and prerequisites having been complied with, the case having come before the City Council of the City of Grapevine, Texas, after all legal notices requirements, conditions and prerequisites having been complied with; and WHEREAS, the City Council of the City of Grapevine, Texas, at a public hearing called by the City Council did consider the following factors in making a determination as to whether this requested planned development overlay should be granted or denied: safety of the motoring public and the pedestrians using the facilities in the area immediately surrounding the site; safety from fire hazards and measures for fire control; protection of adjacent property from flood or water damages, noise producing elements, and glare of the vehicular and stationary lights and effect of such lights on established character of the neighborhood; location, lighting, and types of signs and relation of signs to traffic control and adjacent property; street size and adequacy of width for traffic reasonably expected to be generated by the proposed use around the site and in the immediate neighborhood; adequacy of parking as determined by requirements of this ordinance for off-street parking facilities; location of ingress and egress points for parking and off-street locating spaces, and protection of public health by surfacing on all parking areas to control dust; effect on the promotion of health and the general welfare; effect on light and air; the effect on the overcrowding of the land; the effect on the concentration of population; the effect on the transportation, water, sewerage, schools, parks and other facilities; and WHEREAS, the City Council of the City of Grapevine, Texas, at a public hearing called by the City Council of the City of Grapevine, Texas, did consider the following factors in making a determination as to whether this requested planned development overlay should be granted or denied; effect on the congestion of the streets, the fire hazards, panics and other dangers possibly present in the securing of safety from same, the effect on the promotion of health and the general welfare, effect on adequate light and air, the effect on the overcrowding of the land, the effect on the concentration of population, the effect on the transportation, water, sewerage, schools, parks and other public facilities; and WHEREAS, all of the requirements of Section 41 of Ordinance No. 82-73 have been satisfied by the submission of evidence at a public hearing; and WHEREAS, the City Council further considered among other things the character of the existing zoning district and its peculiar suitability for particular uses and with the view to conserve the value of buildings and encourage the most appropriate use of land throughout this City; and WHEREAS, the City Council of the City of Grapevine, Texas, does find that there is a public necessity for the granting of this planned development overlay, that the public demands it, that the public interest clearly requires the amendment, that the zoning changes do not unreasonably invade the rights of those who bought or improved property with reference to the classification which existed at the time their original investment was made; and WHEREAS, the City Council of the City of Grapevine, Texas, does find that the planned development overlay lessens the congestion in the streets, helps secure safety from fire, panic and other dangers, prevents the overcrowding of land, avoids undue concentration of population, facilitates the adequate provisions of transportation, water, sewerage, schools, parks and other public requirements; and WHEREAS, the City Council of the City of Grapevine, Texas, has determined that there is a necessity and need for this planned development overlay and has also found and determined that there has been a change in the conditions of the property surrounding and in close proximity to the property requested for a change since this property was originally classified and, therefore, feels that the issuance of this planned development overlay for the particular piece of property is needed, is called for, and is in the best interest of the public at large, the citizens of the City of Grapevine, Texas, and helps promote the general health, safety and welfare of this community. ORD. NO. 2 NOW, •* BE IT ORDAINED • OF OF GRAPEVINE, Section 1. That the City does hereby issue a planned development overlay in accordance with Section 41 of Ordinance No. 82-73, the Comprehensive Zoning Ordinance of the City of Grapevine, Texas, same being also known as Appendix "D" of the City Code, by granting Planned Development Overlay PD14-03 to include but not be limited to deviation from allowing residential uses in the district and building separation within the following described property: Lot 1A, Block 1, The Gatehouse in Grapevine (670 Westport Parkway) all in accordance with a site plan approved pursuant to Section 47 of Ordinance No. 82-73, attached hereto and made a part hereof as Exhibit "A", and all other conditions, restrictions, and safeguards imposed herein, including but not limited to the following: None. Section 2. That the City Manager is hereby directed to amend the official zoning map of the City of Grapevine, Texas, to reflect the herein planned development overlay. Section 3. That in all other respects the use of the tract or tracts of land herein above described shall be subject to all the applicable regulations contained in said City of Grapevine zoning ordinance and all other applicable and pertinent ordinances of the City of Grapevine, Texas. Section 4. That the zoning regulations and districts as herein established have been made in accordance with the comprehensive plan for the purpose of promoting health, safety, morals and the general welfare of the community. They have been designed with respect to both present conditions and the conditions reasonably anticipated to exist in the foreseeable future; to lessen congestion in the streets; to secure safely from fire, panic, flood and other dangers; provide adequate light and air; to prevent overcrowding of land, to avoid undue concentration of population; facilitate the adequate provisions of transportation, water, sewerage, drainage and surface water, parks and other public requirements, and to make adequate provisions for the normal business, commercial needs and development of the community. They have been made with reasonable consideration, among other things, of the character of the district, and its peculiar suitability for the particular uses and with a view of conserving the value of buildings and encouraging the most appropriate use of land throughout the community. Section 5. That this ordinance shall be cumulative of all other ordinances of the City of Grapevine, Texas, affecting zoning and shall not repeal any of the provisions of said ordinances except in those instances where provisions of those ordinances which are in direct conflict with the provisions of this ordinance. Section 6. That the terms and provisions of this ordinance shall be deemed to be severable and that if the validity of the zoning affecting any portion of the tract or tracts of land described herein shall be declared to be invalid, the same shall not affect the validity of the zoning of the balance of the tract or tracts of land described herein. That any person violating any of the provisions of this ordinance shall be deemed guilty of a misdemeanor and upon conviction thereof shall be fined in a sum not to exceed Two Thousand Dollars ($2,000.00) and a separate offense shall be deemed committed upon each day during or on which a violation occurs or continues. Section 8. That the fact that the present ordinances and regulations of the City of Grapevine, Texas, are inadequate to properly safeguard the health, safety, morals, peace and general welfare of the inhabitants of the City of Grapevine, Texas, creates an emergency for the immediate preservation of the public business, property, health, safety and general welfare of the public which requires that this ordinance shall become effective from and after the date of its final passage, and it is accordingly so ordained.
