ACTS OF THE 1993 TEXAS LEGISLATURE, THE BOARD OF ZONING ADJUSTMENT MEETING AGENDA WAS PREPARED AND POSTED ON THIS THE 6TH DAY OF JANUARY, 1995 AT 5:00 P.M. j-�� �) �4� COMMUNITY DEV 'LOPMENT DIRECTOR STATE OF TEXAS COUNTY OF TARRANT CITY OF GRAPEVINE The Board of Zoning Adjustment for the City of Grapevine, Texas met on Monday evening, January 9, 1995, at 6:00 P.M. in the Council Chambers, Room #205, 307 West Dallas Road, Grapevine, Texas, with the following members present to wit: Charles Giffin Chairman Chris Coy Vice - Chairman Carl Hecht Member Jeff Wood 1 st Alternate Jill Davis 2nd Alternate with members Meyer and Howell absent, constituting a quorum. Also present was Councilman Gill Traverse and the following City Staff: Marcy Ratcliff Planner Teresa Wallace Planning Secretary CALL TO ORDER Chairman Charles Giffin called the meeting to order at 6:00 P.M. NEW BUSINESS BZA94 -47 - WILLIAM FEELY The first item for the Board of Zoning Adjustment to consider was BZA94 -47 submitted by William Feely who is requesting a variance for 425 Caviness Drive, Lot 6, Block 2, Banyan Place. The request is to Grapevine Comprehensive Zoning Ordinance 82 -73, Section 16.G.1., "R -5.0" Zero Lot Line District regulations which requires a twenty five (25) foot front yard setback. The request is to allow a one (1) foot encroachment into the required twenty five (25) foot setback to allow a twenty Four (24) foot front yard setback as shown on the plot plan. E BZA Minutes 1/9/95 Marcy Ratcliff, City Planner, explained Mr. & Mrs. Feely had been informed there was a building line encroachment on the closing survey when they recently bought their home. She explained the house had been built prior to the building line setback inspections requirement by the city and was not the fault of the owner. Also, she told the Board the subdivision was originally platted as townhouse development and was later replatted as zero lot line. With no other guests to speak, Carl Hecht moved to close the public hearing. Jill Davis seconded the motion which prevailed by the following vote: Ayes: Giffin, Coy, Hecht, Wood and Davis Nays: None Absent: Howell and Meyer Carl Hecht moved there was a special condition for the request and that being the encroachment was not the fault of the applicant. Jill Davis seconded the motion which prevailed by the following vote: Ayes: Giffin, Coy, Hecht, Wood and Davis Nays: None Absent: Howell and Meyer Carl Hecht moved to approve the variance to the Grapevine Comprehensive Zoning Ordinance 82 -73 for Lot 6, Block 2, Banyan Place and addressed as 425 Caviness Drive to allow a one (1) foot encroachment into the required twenty five (25) foot front yard setback to allow a twenty four (24) foot front yard setback as shown on the plot plan. Jill Davis seconded the motion which prevailed by the following vote: Ayes: Giffin, Coy, Hecht, Wood and Davis Nays: None Absent: Howell and Meyer Next for the Board of Adjustment to consider was BZA94 -43 submitted by Terry Rautio who is requesting a variance for 2908 Creekwood Drive, Lot 44, Block 1, Creekwood Estates Addition. The request is to Grapevine Comprehensive Zoning Ordinance 82 -73, Section 15.G.1., "R -7.5" Single Family District which requires a thirty (30) foot front yard setback as shown on the plot plan. 2 BZA Minutes 1/9/95 Marcy Ratcliff, City Planner, told the Board Mr. & Mrs. Rautio were informed there was an encroachment at the time of closing on their property. She explained the house had been built prior to the building line setback inspections requirement by the city and was not the fault of the owner. Carl Hecht, with a second by Jill Davis, moved to close the public hearing. The motion prevailed by the following vote: Ayes: Giffin, Coy, Hecht, Wood and Davis Nays: None Absent: Howell and Meyer Carl Hecht, with a second by Chris Coy, moved that a special condition did exist and that being the house was built prior to the building line setback requirement and was not the fault of the owner. The motion prevailed as follows: Ayes: Giffin, Coy, Hecht, Wood and Davis Nays: None Absent: Howell and Meyer Carl Hecht, with a second by Jill Davis, moved to approve the variance request to the Grapevine Comprehensive Zoning Ordinance 82 -73 for Lot 44, Block 1, Creekwood Estates addressed as 2908 Creekwood Drive to allow a one (1) foot encroachment into the required thirty (30) foot front yard setback to allow a twenty nine (29) foot front yard setback as shown on the plot plan. The motion prevailed by the following vote: Ayes: Giffin, Coy, Hecht, Wood and Davis Nays: None Absent: Howell and Meyer Next for the Board of Adjustment to consider was BZA94 -45 submitted by James Hewlett of IntegraService who is requesting a variance for 1901 South Main Street, Lot 1, Block 3, Metroplace Addition. The request is to Grapevine Comprehensive Zoning Ordinance 82 -73, Section 25.17.1., "CC" Community Commercial District which requires a maximum density not to exceed 0.40 floor area ratio (total building area divided by total lot area). The maximum density floor area ratio allowed is 48,894 square feet. 3 BZA Minutes 1/9/95 Marcy Ratcliff, Planner, explained to the Board the applicant met all the other density requirements of the Community Commercial District and still was unable to meet the floor area ratio requirement. The applicant is providing more open space /landscaped area than the allowable minimum. The applicant is providing 44.8 percent less total building coverage than the allowable maximum. The applicant is also providing 2 percent less total impervious area than the allowable maximum. She also told the Board the proposed hotel meets the 50 foot height maximum. James Hewlett, The IntegraService Group, 11300 North Central Expressway, Suite 400, Dallas, Texas was sworn in to respond to questions relative to the request. The Board of Zoning Adjustment discussed the current requirements of the Zoning Ordinance. Gil Traverse, Councilman, told the Board the City Council would be in favor of the request. Jill Davis, with a second by Chris Coy, moved to close the public hearing. The motion prevailed by the following vote: Ayes: Giffin, Coy, Hecht, Wood and Davis Nays: None Absent: Howell and Meyer Jill Davis moved there was a special condition in that the applicant met all the other requirements of the "CC" Community Commercial and was still unable to the meet the floor area ratio requirement. Chris Coy seconded the motion which prevailed by the following vote: Ayes: Giffin, Coy, Hecht, Wood and Davis Nays: None Absent: Howell and Meyer Jill Davis moved to approve the variance to increase to the maximum density floor area ratio by 0.06 which is a total of 56,205 square feet to allow a maximum density of 0.46 floor area ratio to allow a total increase of 7,211 square feet as shown on the site plan. Chris Coy seconded the motion which prevailed by the following vote: Ayes: Giffin, Coy, Hecht, Wood and Davis Nays: None Absent: Howell and Meyer C1 BZA Minutes 1/9/95 BZA94 -46 - WILLIE LIVINGSTON Next for the Board of Adjustment to consider was BZA94 -46 submitted by Willie Livingston who is requesting a variance for 322 East College Street, Lot 2, Block 22, Original Town of Grapevine. The request is to Grapevine Comprehensive Zoning Ordinance 82 -73, Section 58.B., Parking and Loading Area Development Standards which requires all off - street parking and driveways to be paved to a minimum standard equivalent to four (4) inch concrete slab with six (6) inches by ten (10) inches gauge mesh or two (2) inch hot mix asphaltic concrete over six (6) inch crushed rock base. Marcy Ratcliff, City Planner, explained the applicant is requesting to preserve the existing driveway and parking area as developed. The applicant is concerned that paving the driveway and parking area would not maintain the existing semi -rural character of the historically significant house within the College Street Historical Overlay District. Mrs. Wanda Livingston, 4103 Greenway Court, Colleyviile, Texas, was sworn in to speak to the request. Mrs. Livingston told the Board the property was built by Boone Lipscomb in 1934 and was originally a small farm at the edge of town. The gravel drive exists between the house and the barn. She said they propose to restore the barn at a later time. She asked the Board's consideration of her requests to allow the property to remain as originally developed with the gravel drives and unpaved parking to maintain the character of the house as built in 1934. Marcy Ratcliff told the Board that Council had approved the Special Use Permit request on a first reading of the ordinance on December 20, 1995. Pending the outcome of the variance request, the Council would hear the request on second and final reading January 17, 1994. Gil Traverse told the Board the City Council was in favor of the request to allow a Bed & Breakfast in the College Street Historical District. Chris Coy moved, with a second by Jill Davis, to close the public hearing. The motion prevailed by the following vote: Ayes: Giffin, Coy, Hecht, Wood and Davis Nays: None Absent: Howell and Meyer Chris Coy, with a second by Jill Davis, moved a special condition did exist and that being the requirement to pave the existing driveway and parking area would not 5 BZA Minutes 1/9/95 maintain the existing semi -rural character of the historically significant house within the College Street Historical District. The motion prevailed by the following vote: Ayes: Giffin, Coy, Hecht, Wood and Davis Nays: None Absent: Howell and Meyer Chris Coy, with a second by Jill Davis, moved to approve the request to the Grapevine Comprehensive Zoning Ordinance 82 -73 for Lot 2, Block 22, Original Town of Grapevine addressed as 322 East College Street to allow a 100% percent variance to the parking and driveway standards of Section 58.B. allowing the existing gravel driveway and parking area to remain as developed. The motion prevailed by the following vote: Ayes: Giffin, Coy, Hecht, Wood and Davis Nays: None Absent: Howell and Meyer MINUTES Next the Board of Zoning Adjustment considered the minutes of the December 5, 1994, meeting. Carl Hecht moved to approve the minutes of December 5, 1994. Chris Coy seconded the motion which prevailed by the following vote: Ayes: Giffin, Coy, Hecht, Wood and Davis Nays: None Absent: Howell and Meyer ADJOURNMENT With no further discussion, Chris Coy made a motion to adjourn.
