The Board of Zoning Adjustment for the City of Grapevine, Texas met on Monday
evening, May 1, 1995, at 6:00 P.M. in the Council Chambers, Room #205, 307 West
Dallas Road, Grapevine, Texas, with the following members present to wit:

CALL TO ORDER
Chairman Chris Coy called the meeting to order at 6:00 P.M.

Mr. Dennis Luers was sworn in to serve as a member of the Board of Zoning
Adjustment replacing Mr. Jeff Wood who recently resigned by Teresa Wallace,
Planning Secretary.
NEW BUSINESS
The next item for the Board of Zoning Adjustment to consider was BZA95 -08
submitted by Mr. Randy Lennard representing Trencor, Inc. who is requesting a
variance for Lot 1, Block 1, Trencor Jetco Addition, 1400 East State Highway 26.
The request is to Grapevine Comprehensive Zoning Ordinance 82 -73, as follows:
Section 31.C., "LI" Light Industrial District, which requires outdoor storage areas to
be screened in accordance with Section 50. The screening must be constructed of

a minimum six (6) feet high masonry or wood fence. The request is to allow the
deletion of the required screening on the east, south, and west sides of the new
outdoor machine storage pad and if approved would allow this storage area to be
screened on the north side only.
Marcy Ratcliff, Planner, explained to the Board that recent amendments to Section 31,
Light Industrial District now require a conditional use permit to allow outside storage
in conjunction with a permitted or conditional use in the district provided that such
storage shall be screened in accordance with Section 50, Alternates A or E. The
applicant went before the Planning & Zoning Commission and City Council in Public
Hearing on April 18, 1995 requesting outside storage. The Planning & Zoning
Commission recommended and the City Council approved the first reading of an
ordinance for the storage area with screening only on the north side of the storage
pad pending the request before Board of Zoning Adjustment tonight. A second
reading of the ordinance will be required to approve the conditional use permit if the
Board approves the variance request.
Marcy Ratcliff stated that Staff finds a special condition for the variance request. The
property is located immediately adjacent to DFW International Airport property on the
east side. The storage pad, located directly behind the building at the rear of the
property, is screened from view by the existing building and landscaping. The
applicant is proposing to screen only along the north side of the storage pad which
is the only area visible to State Highway 26.
Gil Traverse, City Councilman, spoke to the Board regarding the size of machinery to
be stored. He told the Board the finished products to be stored will be twenty (20)
foot tall ditching equipment. The required six (6) foot screening fence would not be
adequate to hide the size of the machinery. Also, he told the Board the only property
that would be visible from the machine storage pad would be the airport property on
the east side which may never develop.
With no other guests to speak and one letter of favorable response, Ery Meyer moved
to close the public hearing. Randy Howell seconded the motion which prevailed by
the following vote:
Ayes: Coy, Howell, Meyer, Hecht, Davis

Ery Meyer moved, with a second by Carl Hecht, that a special condition does exist for
the request and that being the storage area is located at the rear of the property and

by the following vote:

Ery Meyer moved, with a second by Carl Hecht, to grant the variance to the Grapevine
Comprehensive Zoning Ordinance 82 -73, Section 31.C. Light Industrial District
Regulations for Lot 1, Block 1, Trencor Jetco Addition, specifically addressed as 1400
East State Highway 26, to allow the deletion of the required solid wall screening fence
on the east, south and west side of the outdoor concrete machine storage pad and
allow the storage area to be screened on the north side only as shown on the site
plan. The motion prevailed as follows:

Next for the Board of Adjustment to consider was BZA95 -09 submitted by Deborah
& Claude Lavigne who are requesting a variance for Lot 21, Block 2, Trail Lake
Estates and addressed as 2913 Scenic Drive. The request is to Grapevine
Comprehensive Zoning Ordinance 82 -73, Section 15.G.1., "R -7.5" Single Family
District Regulations to allow a one (1) foot encroachment into the required thirty (30)
foot front yard setback to allow a twenty nine (29) foot front yard setback for the
existing house as shown on the plot plan.
Marcy Ratcliff, Planner, explained to the Board that Mr. & Mrs. Lavigne had recently
purchased the existing house. They were informed by the title company the closing
survey showed a building line encroachment and the lender was taking exception to
the encumbrance to clear title.
Mrs. Ratcliff stated Staff finds a special condition for the request. The existing house
was built prior to the building line setback inspection requirement and the
encroachment is not the fault of the owner.
Carl Hecht moved, with a second by Jill Davis, to close the public hearing. The
motion prevailed by the following vote:
Ayes: Coy, Howell, Meyer, Hecht, Davis

After a brief discussion, Carl Hecht moved, with a second by Jill Davis, that a special
condition does exist for the request in that the house was built prior to the building
line setback inspection requirement, and the encroachment is not the fault of the
owner. The motion prevailed by the following vote:
Ayes: Coy, Howell, Meyer, Hecht, Davis
Nays: None
Carl Hecht moved, with a second by Ery Meyer, to approve the variance request to
the Grapevine Comprehensive Zoning Ordinance 82 -73, Section 15.G.1. Single Family
District regulations to Lot 21, Block 3, Trail Lake Estates, specifically addressed as
2913 Scenic Drive to allow a one (1) foot encroachment into the required thirty (30)

Next for the Board of Adjustment to consider was BZA95 -10 submitted by Gary
Cantrell who is requesting a special exception for Lot 1 A, Block A, Starr Addition and
addressed as 120 South Main Street. The request is to the Historic Landmark
Preservation Criteria Ordinance 92 -67, requirements which state all principal buildings
in the 100 Block of South Main Street shall be built to and not beyond a twenty five
(25) foot setback on the Main Street - facing elevation.
Marcy Ratcliff, Planner, explained the request is to the Historic Preservation Criteria
adopted by Ordinance 92 -67 which approved the Historic Overlay District covering the
100 block of South Main Street. Further, she stated the intent of the ordinance was
to preserve the historic character of the Original Town and the 100 block of South
Main Street which had been developed as residential.
Pictures of the proposed development were passed around to the Board to illustrate
the appearance and historic character of the proposed development which will contain
two buildings fronting on Main Street. Mrs. Ratcliff explained the applicant is
requesting to allow Building A to encroach twenty (20) feet and Building B to
encroach thirteen (13) feet into the required twenty five (25) foot front yard setback.
If the Board of Zoning Adjustment approves the request it would allow a five (5) foot
setback for Building A and a twelve (12) foot setback for Building B as shown on the
site plan.

Mrs. Ratcliff told the Board the applicant, Mr. Gary Cantrell, had been working with
the Heritage Foundation on the proposed development to create a development with
historic characteristics that would be compatible with the future city hall. Mr. Cantrell
presented his proposal to the Historic Preservation Commission on March 8, 1995.
` After reviewing his plans in conjunction with the future city hall plans to be located
just south in the 200 block of South Main Street. They made a formal
recommendation to the Board of Zoning Adjustment to approve the request. They
determined the appearance of the proposed buildings were in conformity with the
existing buildings on South Main Street. The future city hall will have a zero (0) foot
front building line setback like the majority of the existing developed property on Main
Street.
Mrs. Ratcliff told the Board that Staff finds a special condition for the request. The
Central Business District, except for the adopted preservation criteria are of the 100
Block of South Main, does not require a front building line setback and the Historic
Preservation Commission recommended approval.
Mr. Gary Cantrell was introduced to respond to questions.
Mr. Jim Armstrong, 115A South Main Street, stated he was a business owner directly
across Main Street from the proposed development. He expressed concerns about the
number of parking spaces shown on the site plan. He stated he was concerned
about potential parking problems in that area of Main Street and he did not want
people parking on his site and going across the street thereby tying up his patron
parking area.
Mrs. Ratcliff explained to Mr. Armstrong that Mr. Cantrell would be going before the
Planning and Zoning Commission with an alternate parking plan for the development.
She told Mr. Armstrong the majority of the businesses in the Central Business District
do not meet the parking requirements. Further, she explained the request presently
before the Board of Zoning Adjustment was relative to preservation criteria only.
After a brief discussion regarding the required parking, Councilman Gil Traverse
commented the Planning and Zoning Commission would be considering the parking
plan at a future date and Mr. Armstrong could be advised of the meeting if he chose
to address his concerns to the Commission.
With no other guests to speak to the request and only one letter in favor of the
request, Ery Meyer moved to close the public hearing. Randy Howell seconded the
motion which prevailed by the following vote:

request and that being the Central Business District does not require front yard
setbacks except under preservation criteria and the Historic Preservation Commission

Ery Meyer moved to approve the special exception request for Lot 1 A, Block A, Starr
Addition, addressed as 120 South Main Street to the Historic Landmark Preservation
Criteria (92 -67) to allow Building A of the proposed development to encroach twenty
(20) feet and Building B to encroach thirteen (13) feet into the twenty five (25) foot
setback to allow a five (5) foot setback for Building A and a twelve (12) foot setback
for Building B of the proposed development as shown on the site plan. Carl Hecht
seconded the motion which prevailed by the following vote:

Next for the Board of Adjustment to consider was BZA95 -11 submitted by Brad
Norman who is requesting a variance for Lot 16, Block 14, Oakcreek Estates,
addressed as 2817 Harvest Hill Drive. The request is to the Grapevine Comprehensive
Zoning Ordinance 82 -73, Section 15.G.1., R.7.5 Single Family District Regulations to
allow the existing house a one (1) foot encroachment into the required thirty (30) foot
front yard setback to allow a twenty nine (29) foot front yard setback as shown on
the plot plan.
Marcy Ratcliff, Planner, explained that Mr. & Mrs. Norman had recently purchased the
existing house. They were informed by the title company that a building line
encroachment was shown on the closing survey and the lender was taking exception
to the encumbrance to clear title.
Mrs. Ratcliff told the Board that Staff does find a special condition for the request
because the house was built prior to the building line setback inspection requirement

Mrs. Ratcliff stated two positive responses were received by Staff to approve the
request. Mr. & Mrs. Norman were introduced to answer any questions relative to the
request.
With no guests to speak to for the request, Randy Howell moved to close the public
hearing. Ery Meyer seconded the motion which prevailed by the following vote:
Ayes: Coy, Howell, Meyer, Hecht, Davis
Nays: None
Randy Howell, moved with a second by Jill Davis, that a special condition does exist
and that being the encroachment into the required front yard is not the fault of the
owner because the house was built prior to building line setback requirements. The
motion prevailed by the following vote:

Randy Howell moved to approve the variance request for Lot 16, Block 14, Oakcreek
Estates, addressed as 2817 Harvest Hill Drive to the Grapevine Comprehensive Zoning

BZA95 -12 CRAIG'S COLLISION
Next for the Board of Adjustment to consider was BZA95 -12 submitted by Craig Van
Cleve who is requesting variances for Lot 1, Block 1, Van Cleve Addition, addressed
as 2079 State Highway 114 West as follows:
Section 56.C.5., Off- Street Parking Regulations requires ninety seven (97) off - street
parking spaces for motor vehicle repair, one (1) parking space per 125 square feet of
principal use area. The proposed variance would allow a decrease of sixty seven (67)
landscaped parking spaces. If approved, the variance would allow thirty (30)
landscaped parking spaces and fifty three (53) non - landscaped parking spaces for
vehicular storage of operating and non - operating vehicles.

Section 31.C.4., LI Light Industrial District Regulations which requires screening of
outside storage areas in accordance with Section 50, Screening Alternates A or E six
(6) foot solid wood or masonry fence. The proposed variance would allow a chainlink
fence with a solid hedgerow as a screening fence along the northern and southern
perimeter of the vehicular storage areas. If approved, the variance would allow a six
(6) foot chainlink fence with a solid hedgerow along the northern and southern
perimeter of the vehicular storage area, and none along the western perimeter of the
vehicular storage area.
Marcy Ratcliff, Planner, explained the applicant, Mr. Craig Van Cleve, was proposing
to develop a collision repair center. In the site plan review process, Staff addressed
concerns that Mr. Van Cleve would not be able to meet the off - street parking
requirements for the development. Mr. Van Cleve furnished current parking
information on existing developments he owns in Farmers Branch, Duncanville and
Arlington. Staff called the cities to confirm and compare Grapevine's parking
regulations for automotive body shops. A copy of the survey showed there was a
large difference in the requirements.
Staff finds a special condition for the off - street parking request because the Zoning
Ordinance does not address vehicular storage needs for an automotive body shop.
The ordinance requires all off - street parking to be landscaped and all vehicles to be in
operating condition. Mrs. Ratcliff explained that this automotive repair use needs a
majority of its parking spaces to be used as storage of inoperable vehicles. The
Ordinance does not require storage parking area to be landscaped with planter islands.
Also, she explained, Mr. Van Cleve was also requesting to install a chain link fence,
with landscaping around the perimeter of the vehicular storage area of the facility,
instead of a six (6) foot solid wood or masonry screening fence. Staff could find no
special condition or physical hardship for this request.
Marcy Ratcliff explained that Staff recommends approval of the first request only if
the second request is denied.
Mr. Craig Van Cleve was introduced to respond to questions relative to the request.
Debbie Ryan, Attorney representing Gulf Bearing, requested to speak to the request.

She stated that Gulf Bearing was concerned about the Board granting a variance to
the screening requirements for vehicular storage. Gulf Bearing owns the property
directly to the North and is in direct view into the storage lot. She requested that the
variance be denied and applicant be required to put up a masonry or wooden fence
as required by the Ordinance. Another concern expressed was the request to reduce

the number of off - street parking spaces. Gulf Bearing has had problems with other
companies in the area using their parking lot because the developments did not have
enough off - street parking and are now parking on the frontage road of State Highway
114 West and Industrial Boulevard.
Mr. Van Cleve, owner of Craigs Collision, stated they were still going to provide 83
parking spaces on the development. He explained the request is to reduce the number
of landscaped parking spaces. He went on to explain that there would be
approximately twenty spaces needed for employees to park at the rear of the lot. He
was not asking to reduce the required landscaped parking spaces in front of the
building for customer parking, but only to the inoperable vehicles that would be parked
behind a fence in the storage area or inside the building while being repaired.
With no other guests to speak for the requests, Chris Coy moved to close the public
hearing. Ery Meyer seconded the motion which prevailed by the following vote:

After a brief discussion Chris Coy, moved with a second by Carl Hecht, that a special
condition exists for the first request and that being the Zoning Ordinance does not
address the vehicular storage needs of an automotive body shop and does not require
landscaped planter islands for storage areas. The motion prevailed by the following
vote:
Ayes: Coy, Howell, Meyer, Hecht, Davis

Chris Coy moved to approve the variance request for Lot 1, Block 1, Van Cleve
