The Board of Zoning Adjustment for the City of Grapevine, Texas met on Monday
evening, August 7, 1995, at 6:00 P.M. in the Council Chambers, Room #205, 307
West Dallas Road, Grapevine, Texas, with the following members present to wit:

Mr. Randy Howell was sworn in to serve as a regular Board of Zoning Adjustment
member by Kelly Doughty, Building Inspection Secretary.
NEW BUSINESS
BZA95 -17 - MARK PALMER
The first item for the Board of Zoning Adjustment to consider was BZA95 -17
submitted by Mark Palmer who was requesting a variance for Lot 35, Block 10, Glade
Landing Addition, specifically addressed as 5145 Haydenbend Circle. The request
was to the Grapevine Comprehensive Zoning Ordinance 82 -73, as follows:
Section 15.G.2., "R -7.5" Single Family District Regulations which requires a twenty
five (25) foot rear yard setback.

The proposed variance would allow a ten (10) foot encroachment into the required
twenty five (25) rear yard setback. If approved, it would allow a fifteen (15) foot rear
yard setback as shown on the plot plan.
A variance application was submitted to the Department of Development Services by
Mark Palmer. Mr. Palmer is proposing to add a bedroom, dining room and two patio
areas to the existing house. The subject property is located on a large cul-de-sac lot
which contains 14,364 square feet. The major portion of the expansion will be on the
southeast side of the property. The total square footage of the house would be
increased to approximately 4,881 square feet which would cover less than thirty four
(34) percent of the total lot area. The "R-7.5" Single Family District allows a
maximum building coverage of forty (40) percent of the lot area. The only portion of
the expansion that would encroach the rear yard setback is a covered patio.
Scott Williams, Building Official, explained to the Board Staff found a special condition
for the request, in that the only portion of the addition that will encroach the required
twenty five (25) foot rear yard is a covered patio. The patio is not open on three (3)
sides as required by the zoning ordinance, but the portion that will encroach the rear
yard is entirely open, Mark Palmer was present to respond to questions relative to the
request.
No written response was received.
With no other guests to speak, Carl Hecht moved to close the public hearing. Ery
Meyer seconded the motion which prevailed by the following vote:
Ayes: Coy, Meyer, Howell, Hecht, and Davis
Nays: None
After a brief discussion, Carl Hecht moved, with a second by Randy Howell, that a
special condition did exist for the request in that the covered patio is the only portion
of the addition that will encroach the required twenty five (25) foot rear yard.

Carl Hecht moved, with a second by Randy Howell, to grant the variance to the
Grapevine Comprehensive Zoning Ordinance 82-73, Section 15.G.2., "R-7.5" Single
Family District Regulations for Lot 35, Block 10, Glade Landing Addition, specifically
addressed as 5145 Haydenbend Circle, to allow a ten (10) foot encroachment into the
required twenty five (25) foot rear yard setback allowing a fifteen (15) foot rear yard
setback as shown on the plot plan. The motion prevailed by the following vote:

BZA95 -18 - GARY CANTRELL
Next for the Board of Adjustment to consider was BZA95 -18 submitted by Gary
Cantrell who requested a special exception for Lot 1A, Block A, Starr Addition and
addressed as 120 South Main Street. The request was to the Historic Landmark
Preservation Criteria, Ordinance 92 -67, which states all principal buildings in the 100
Block of South Main Street shall be built to and not beyond a twenty five (25) foot
setback on the Main Street - facing elevation.
An application was submitted to the Department of Development Services by Mr.
Gary Cantrell. Mr. Cantrell came before the Board of Zoning Adjustment and was
granted a special exception to the Historic Landmark Preservation Criteria on May 1,
1995. They acknowledged the general appearance of the proposed development is
in line with the Preservation Criteria except for the setbacks. The Historic
Preservation Commission agreed that the encroachment would not hinder the existing
and proposed developments on South Main Street.
Due to a lack of adequate parking for the proposed development and concerns with
the size differential of the future City Hall, Mr. Cantrell was requested to revise his
site plan to face both buildings on Main Street with parking in the rear. After
reviewing the revised drawings, the Historic Preservation Commission made a formal
recommendation to the Board of Zoning Adjustment for approval of the special
exception request. The Planning & Zoning Commission approved the revised parking
plan on July 18, 1995.
Mr. Williams explained the applicant is now requesting both buildings of the proposed
development to encroach twenty five (25) feet into the required twenty five (25) foot
setback on the Main Street - facing elevation allowing a zero (0) foot setback for both
buildings as shown on the site plan.
Mr. Williams told the Board that Staff found a special condition for the request. The
100 block of Main Street is the only block in the Central Business District with a front
yard setback, which is due to the preservation criteria. The applicant is attempting
to replicate the downtown streetscape architecture by placing the buildings on the
front property line with parking at the rear of the property.
Mr. Williams noted the Historical Preservation Commission approved the proposed
design on their July 26, 1995 meeting. Gary Cantrell was present to respond to
questions relative to the request.

H. T. (Tommy) Hardy, Director of Development Services, explained the intent of Mr.
Cantrell in the beginning was to create buildings similar to the two homes that were
once located on this lot. Mr. Cantrell has been working with the City to create a
development with historic characteristics that would be compatible with the future
city hall. The future city hall will have a zero (0) foot front building line setback like
the majority of the existing developed property on Main Street.
With no other guests to speak to the request, Randy Howell moved to close the public
hearing. Ery Meyer seconded the motion which prevailed by the following vote:

After a brief discussion, Ery Meyer moved that a special condition did exists for the
request and being the Central Business District does not require front yard setbacks
except under preservation criteria and the Historic Preservation Commission
recommended approval. Carl Hecht seconded the motion which prevailed by the
following vote:

Ery Meyer moved to approve the special exception request for Lot 1 A, Block A, Starr
Addition, addressed as 120 South Main Street to the Historic Landmark Preservation
Criteria (92-67) to allow both buildings of the proposed development to encroach
twenty five (25) feet into the required twenty five (25) foot setback on the Main
Street-facing elevation allowing a zero (0) foot setback for both buildings as shown
on the site plan. Randy Howell seconded the motion which prevailed by the following
