Board of Zoning Adjustments to conduct a public hearing relative to Application BZA 84-03 submitted by Mr. Ples Schnitz, Jr. for a 4-foot side yard variance on property located at 2824 Creekwood Drive North and consideration of same. B. Board of Zoning Adjustments to conduct a public hearing relative to Application BZA 84-04 submitted by Mr. Wayne Moffat for a six-foot variance in the 25-foot rear yard requirement for the construction of a two story deck on property located at 3006 Sweet Briar and consideration of same. Meeting of March 1, 1984 IN ACCORDANCE WITH ARTICLE 6252-17, AMENDED BY CHAPTER 227, ACTS OF THE 61ST LEGISLATURE, REGULAR SESSION, THE REGULAR BOARD OF ZONING ADJUSTMENTS MEETING AGENDA WAS PREPARED AND POSTED ON THIS THE 31ST DAY • MAY, 1984 AT 11:00 A.M. a. I i • • , 0 1 0 •- 1W bwei ARI-1, 111— The Board of Zoning Adjustment of the City of Grapevine, Texas, met in a regular session on Thursday, June 7, 1984 at 6 PM in the Conference Room of the Police-Library Building, 307 West Dallas Road, with the following persons present, to wit: Glenn Deavers Vice Chairman Doug Lamb Member Gary Tischler Member Bill Waldrip Member constituting a quorum, with Chairman Gerald Thompson and Alternate members Steve Hall and Ron Troy absent, and the following City Staff, to wit: H. T. (Tamiy) Hardy Joy Welch Director of Community Development Secretary CALL TO ORDER Vice Chairman Deavers called the meting to order and explained the procedures and purposes of the meting. OATH OF OFFICE The secretary administered the Oath of Office to Vice Chairman Deavers and Members Doug Lamb and Gary Tischler. ELECTION OF OFFICERS The first order of business was for the Board to elect officers for the year. It was the general consensus of those present to waive the election of officers until the next meeting, hoping to enable a more ccuplete attendance. Then Doug Lamb made a motion to table the election of officers, and Gary Tischler seconded the motion which prevailed by the following vote: Ayes: Deavers, Lamb, Tischler and Waldrip Nays: None Absent: Hall & Troy & Thompson Vice Chairman Deavers administered the Oath of Truth to Wayne Moffat and Frank Gentile, who both wished to speak relative to the evening's agenda. NEW BUSINESS Board of Zoning Adjustment Case BZA 84-03- Mr. Ples Schnitz, Jr. It was noted that Mr. Schnitz wished a four foot side yard variance on property located at 2824 Creekwood Drive North, for the purpose of constructing a swimming pool. Mr. Hardy advised that in reviewing the permit application, it was noted that if the pool was constructed as indicated on the site plan, it would be located two feet from the side yard. Since Section 9-B of the Appendix D Zoning Ordinance requires all accessory uses to be located six feet from the side property line, the permit request was denied. As a result of the denial, Mr. Schnitz requested a variance to enable him to construct the pool as submitted in his permit application. There was no one present to speak relative to the subject case, and Mr. Hardy noted that Mr. Schnitz was the owner of the property and the contractor who would be building the pool if the variance was granted is Mr. Bowling. NUMMUMS =- 6-7-84 Page 2 Following a brief discussion relative to Mr. Hardy's notations, Mr. Waldrip made a notion to grant the variance as requested, and Mr. Lamb seconded the motion which prevailed by the following vote. Ayes: Deavers, Lamb, Tischler & Waldrip Nays: None Absent: Hall & Troy & Thompson The next item for the Board to consider was BZA 84-04, submitted by Mr. Wayne Moffat who requested a six foot variance in the 25 foot rear yard requirement for the construction of a two story deck on property located at 3006 Sweet Briar. It was noted that on May 11, 1984, a final building inspection was made by the Building Inspection Department of a residence Mr. Moffat is constructing at 3006 Sweet Briar, located in the Trail Lake Subdivision. As a result of that inspection, the inspector found that Mr. Moffat had constructed a two-story deck in the required 25 foot rear yard. The inspection was denied due to the encroachment into the rear yard. Mr. Moffat is requesting a variance so he would be allowed to leave the deck as constructed, which is encroaching 6 feet into the required 25 foot rear yard. Mr. Moffat spoke indicating that he misunderstood the code and had not realized the deck should have been within the 25 foot requirement. Mr. Gentile, residing on Sweet Briar directly behind the subject residence spoke indicating that he had no objection to the deck being constructed at this time and that he had discussed any possible problems with the property owner and believed everything was to the satisfaction of all parties concerned. Mx. Gentile also mntioned the existing drainage problems in the area. Pictures were displayed depicting the extent of such problems. There being no further discussion, Gary Tischler made a motion to grant the variance as requested, and Vice Chairman Deavers seconded the motion which prevailed by the following vote: Ayes: Deavers, Lamb, Tischler & Waldrip Nays: None Absent: Hall & Troy& Thompson MINUTES OF THE MEETING OF MARCH 4, 1984 The next item of business for consideration by the Board was the Minutes of the meting of March 4, 1984. It was the general consensus to table consideration of the minutes until the next meeting. Mr. Hardy discussed the draft zoning ordinance which was distributed to those present, indicating that it would not be complete until after the rezoning process; however, it was a result of the rezoning and very close to being what the final ordinance would be.
