(Tomy) Hardy Shoukat Kadri Joy Welch Sue Martinez WNWHAMININJORKS Director, Community Development City Planner Secretary Secretary At 6 PM, Chairman Lamb called the meting to order and explained the procedure and purpose of the meting. ley-moammmom Chairman Lamb then issued the Oath of Truth to the following persons: Mr. John Hintz representing Landmark Homes Mr. Rob Sult representing Crow Development Mr. Dan Huffaker representing Monarch Homes Mr. Macon Foster representing Landmark Home-s Mr. David Renn representing Rogers-OBrien Mr. Blake Cogdell representing Monarch Hanes Mr. James Davidson representing Dakota Group Mr. Cameron Ross representing Monarch Homes liN21,12*010340 Board of Zo� Adjustment Case BZA 84 3 -07 - Monarch Homes The Board of Zoning Adjustment was first to conduct a public hearing to consider a request of Monarch Homes for a variance to construct a residence at 3453 Knob Oak Drive without off-street parking as required by Section 34.0 of the Appendix D. Zoning Ordinance. Mr. Rob Sult spoke, noting that there had been a slight misunderstanding relative to contractors being required to restore model hone offices back to garages, expressing a desire that builders and developers would desire to come to a satisfactory resolution of the problem. Mir. Hardy advised that in large subdivisions, builders construct model homes which are occupied for a period of one to three years until the subdivision is built out. In Grapevine, the model homes are usually constructed by enclosing the garage space which is used as an office sales area. The remainder of model homes are constructed complete except for the driveways. Further, the Building Official advised in the past builders had assured the City Staff that garage doors would be installed when models were sold for use as residences in order to comply with the Grapevine Zoning Ordinance for off-street parking, unable to be located in front yards. Therefore, since the builders are not cooperating, the City will no longer approve model ham without off- street parking, resulting in BZA cases, resulting in variance request #84-07. Further, Mr. Hardy noted that each time a model home is built in Grapevine, a BZA case will be necessary, as #84-07, 08 and 09 on the evening's agenda. 8-2-84 Page 2 Further, Mr. Hardy clarified for those present that a certificate of occupancy is not issued private residences as in commercial, and recommended that the variance be approved with the stipulation that a letter is signed • builders agreeing to restore model homes to meet ordinance requirements when they are sold for use as private residences. The secretary advised that no letters or petitions were received relative to the subject case. Ayes: Lamb, Beavers, Thompson, Tischler & Troy Nays: None Absent: Waldrip and Hall The second variance request to be heard by the Board was BZA 84-04 submitted • Monarch Homes was a duplicate request for a different address, that • 344• Knob Oak Drive without off-street parking as required by Section 34.0 of the Appendix D. Then Vice Chairman Glenn Deavers made a motion to approve the variance as requested with the stipulation that a letter • agreement would be signed and a sign posted on the model homes indicating that the garage would be restored and doors added when home was sold for private use. The Oath of Truth was administered by Chairman Lamb to Mr. Thomas Elting of Elting and Recer Architects and Planners, Inc. The subject request for for an addition to Standard Dbtor Products building located at 500 Industrial Blvd., Lot 8, Block 1, Grapevine Industrial Park. As a result of the site plan review, it was determined that the landscape requirements in the required front yard were not in compliance with Section 31 of the Grapevine Zoning Ordinance, which requires 10% of the site area to be landscaped with 50% of the required landscaping to be located in the 30 foot required front yard of the LI, Light Industrial District. Mr. Elting noted that the existing building had been constructed with plans to expand prior to Grapevine's new Zoning Ordinance which now requires landscaping in the LI district, and previously no such require- ments existed. Further, Mr. Elting noted that there would be a hardship created in over-all design if new requirements were enforced in this isolated instance for providing landscaping where a loading dock would be needed. There were no letters or petitions received, the secretary reported. Mr. Davidson, however, noted that it would have been in-possible to adjust the design since the first phase of the building was already constructed, and Mr. Hardy concurred. There being little discussion, Chairman Lamb called for a motion, and Gerald Thompson so moved to the variance as requested with a second offered from Ronald Troy, and the prevailing vote as follows: Ayes: Lamb, Deavers, Thompson, Tischler, & Troy Nays: None Absent: Waldrip & Hall BZA Minutes 8-2-84 Page 5 Imeal v vxwwIII. Mr. Renn, representing Rogers-O'Brien, builders for transwestern discussed the need for the requested variance for allowing a rear yard 25 foot short of the required 30 feet for LI District. He noted that granting the variance would allow the two new buildings to be consistent with the two existing buildings which had no rear yard requirements at the time they were constructed prior to City-initiated rezoning. The secretary noted that no correspondence was received, and no one was present to speak. Then, Gary Land, Architect for Transwestern, arrived and further detailed the need for a variance, noting that the subject case involved Phase IV of a development, and would be inconsistent with the remainder of the preceding development, should the new Zoning Ordinance be enforced. There being few questions from the Board, Chairman Lamb called for a motion, and Gary Tischler so moved to approve the variance as requested, and Vice Chairman Deavers offered a second. The prevailing vote was as follows: Ayes: Lamb, Deavers, Thompson, Tischler, & Troy Nays: None Absent: Waldrip & Hall MINUTES OF THE MEETING OF JULY 5, 1984 Finally, the Board was to consider the minutes of the meting of July 5, 1984. Mr. Troy noted that on Page 3 of the subject minutes, Peg Jones had not withdrawn her objection as stated.
