RIVAND The Board of Zoning Adjustment for the City of Grapevine, Texas met in regular session August 1, 1985 at 307 West Dallas Road, Room. 204, Grapevine, Texas with the following members present to wit: Doug Lamb Gerald Thompson Garry Tischler Bill Waldrip Kay Gilliam John Ferguson Chairman Member Member Member First Alternate Second Alternate constituting a quorum, with Member, Ron Troy, absent, and the following City Staff present to wit: H. T. (Tcuffny) Hardy Director of Community Development Jim Van Treese Assistant Building Official Joy Carroll Administrative Aide Mary Peddycoart Secretary Also present were Ted Ware City Council Representative for the Board of Zoning Adjustment and Richard Atkins Planning and Zoning Representative for the Board of Zoning Adjustment. Chairman Laub called the meting to order at approximately 6:00 P.M. Chairman Lamb announced that the Oath of Truth would be administered to anyone present wishing to speak either for or against any of the zoning cases to be heard by the Board at this meting. WIN C-omb, At At this time, a motion was made • Bill Waldrip to table this variance request until the September 5, 1985 regular meeting. The motion was seconded by Gerald Thompson and prevailed ♦ the following vote: Ayes: Waldrip, Thompson, Lamb, Tischler and Gilliam Nays: None Absent: Troy Brian Weir, owner of Wheat Lumber, spoke reinterating and outlining again his reasons for the variance request for Masonry. The building sides need to remain open for the stacking • lumber. He also advised that this buildihg was ordered before the new ordinance went into effect. He is agreeable to Masonry on the front • the building which faces Dooley Street. Ayes: Waldrip, Tischler, lamb, Thompson Nays: Gilliam Absent: Troy Board of Zoning Adjustment August 1, 1985 Page 3. N \Ii -])�►JRl 'i Horton & Tcunitz, developers c Dove Landing, Dove Road, Grapevine, Texas are asking for exception to Grapevine Zoning Ordinance 82-73, section 16.D.3.a.& b. with regard to side yard setbacks in this "R-5.0" Zero Lot Line subdivision. They are asking for five (5) feet and six (6') feet side yards rather than the ten (10') feet on one side and twelve (12") on the other side. This would still maintain the eleven (11') feet between the houses. They are further requesting an exception to the requirement which does not allow windows on the one (1') foot side. By allowing for building "mid-lot", this requirement could be alleviated, allowing builders to build a more conventional look, with windows on all sides. The above is an outline of a short presentation given by George Seagraves, Manager Land Development for Horton & Tornnitz, Inc. With regard to their request for exception to the requirement involving windows on all sides, this is a building code rather than a zoning ordinance requirement, and therefore, the Board of Zoning Adjustment does not have the power to grant any exception for this. There followed a period of discussion betweens the members of the Board, with input from Council members and a Planning and Zoning member present at this Board of Zoning Adjustment hearing. The general feeling among the members seems to be that to grant these exceptions would be defeating the purpose of Zero Lot Line Zoning. At this time, a motion was made by Gerald Thompson to deny this variance as requested. This motion was seconded by Bill Waldrip and prevailed by the following vote: Ayes: Thompson, Nays: None Absent: Troy BZA85-35 - G. T. Designer Hanes Waldrip, Lamb, Tischler and Gilliam The property in question is Lot 7, Block 1 of Blair Manor Estates or 2405 Whitney Lane. Mr. Gil Traverse representing G. T. Designer Homes explained that in order to preserve a large Pecan Tree at the front of the property, he would like to move the building line back five (5) thereby reducing the rear setback to twenty (20') from the required twenty-five (25'). As all members were in agreement that the tree is a definite asset to the property, a motion was made by Garry Tischler to grant the variance as requested. The motion was seconded by Bill Waldrip, and prevailed by the following vote: Ayes: Tischler, Waldrip, Lamb, Thompson and Gilliam Nays: None Absent: Troy BZA85-36 - Scholnick for Tin"berooint Joint Venture Mr. Ira Scholnick representing Timberpoint Joint Ventures spoke outlining his reasons for requesting a variance for landscaping and buffer area at Treepoint Plaza located at the Northwest corner of Timberline and S.H. 121. The final plat for this project was approved on June 18, 1985 according to the regulations for the "CC" Community Commercial District which existed prior to June 7, 1985. Under the new regulations for "CC" Community Commercial District, this tract of land would beccm unworkable for the planned project. Board of Zoning Adjustment August 1, 1985 Page 4. After a short period of discussion and further explanations given by Mr. Scholnick, a motion to grant the request for variance under the old ordinances, but with exception that masonry meet the regulations under the new ordinances was made by Gerald Thompson. The motion was seconded by Garry Tischler, and prevailed by the following vote: Ayes: Thompson, Tischler, Lamb, Waldrip and Gilliam Nays: None Absent: Troy At this time, Chairman Lamb called for a ten (10) minute recess in the proceedings. The meeting reconvened at approximately 7:35 P.M. BZA85-37 - 2Lormson - Fox and Jacobs E(LmA This variance is to convert a hcme at Lot 47 and a home at Lot 48, Block 1 of the Town Park Addition to sales offices (model homes). Mr. Lee Thompson was present representing Fox and Jacobs Homes and stated that these homes would be converted back to single-family residences prior to their sale. They have been notified as to signs, and have agreed to post same • the premises. At this time, Gerald Thompson made a motion to grant this variance as requested, which was seconded by Bill Waldrip; and which prevailed by the following vote: Ayes: Thompson, Nays: None Absent: Troy BZA85-38 - Mr. Terry Willi�ia INTAMIMFORM", Ayes: Thompson, Tischler, Lamb and Gilliam Nays: Waldrip Absent: Troy At this point in the meting, Chairman Lamb again reminded all present that the next meting and all future meetings would be held in Council Chambers, 413 Main Street. Board of Zoning Adjustment August 1, 1985 Page 5. BZA85-39 - All American Builders - Dave Huffman This is an addition to an existing structure located at 511 E. Wall Street, or Lot, 1, Block 1, A. F. Leonard Addition. Mr. Dearing, owner of the property in question, spoke and advised that the requested variance is for masonry, landscaping and open space. Mr. Dearing advised that they would be willing to landscape, but dealing with the required landscaping would make it nearly impossible to utilize the building. He further referred to the utility pole in the open space area which would prohibit conforming -to the current open space requirements. With respect to the masonry, it was pointed out that the existing building is entirely of metal, and the addition to this original building will also be metal. It was further mentioned that since the original building is metal, adding masonry to the additional building would detract from rather than enhance the appearance of the buildings. As no further discussion was necessary, a motion was made by Gerald Thompson to grant the variances as requested. The motion was seconded by Garry Tischler and prevailed by the following vote: Ayes: Thompson, Tischler, Iamb, Waldrip and Gilliam Nays: None Absent: Troy The next item for consideration by the Board of Zoning Adjustment is BZA85-40. The property in question is located at the Southwest corner of S.H. 114 and Main Street. Mr. Goff is requesting an exception to the Grapevine Zoning Ordinance 82-73,25,I,I.(Height) and 82 -73 , 25 , F, 3 . (Landscaping) . At this point in the meting, Chairman Lamb swore in Robert Knoblock and Ron Wilhelm, representatives for Mr. Goff. These men were not sworn in at the beginning of the meting, as they arrived late. Both men spoke to all present explaining how their original zoning change request and their plat had been approved by Council and the Planning and Zoning Commission prior to the new Ordinances. At the time of the original platting, the building was to be seven (7) stories in height, with a two (2) story parking deck. The landscaping with the original plat was eleven (110) percent. Chairman Lamb noted at this time, that the present landscaping will be 140, and asked all the members to note this change. Mr. Knoblock and Mr. Wilhelm advised as the land is so expensive that to reduce the building size to allow for more green area would make the project economically unfeasible. They stated that lowering the building from 106 feet to 50 feet to comply with the new ordinance, would also create an economically unfeasible project. They are asking for these variances in order to develop this project according to the approved site plan. After a short period for discussion, a motion was made by Garry Tischler to grant this variance for height and landscaping. The motion was seconded by Bill Waldrip and prevailed by the following vote: Ayes: Tischler, Waldrip, Lamb, Thompson and Gilliam Nays: None Absent:' Troy 1401V M $I@ M .1-141y • Next for consideration by the Board of Zoning Adjustment were the minutes from the June 27, 1985 special session of the Board of Zoning Adjustment. Board of Zoning Adjustment August 1, 1985 Page 6. As there were no questions or amendments to the minutes, a motion was made by Garry Tischler to approve the minutes as written. The motion was seconded • Gerald Thompson, and prevailed • the following vote: Ayes: Tischler, Thompson, Lamb, Waldrip and Gilliam Nays: None Absent: Troy As there was no further items for discussion by the Board of Zonin*, Adjustment, Garry Tischler made a motion for adjournment, which was seconded • Bill Waldrip.
